(Photo by \u200dDrew \u200cAngerer\/Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/brooke-mallory\">Brooke Mallory<\/a><\/h2>\n<h3>4:35 PM \u2013 Wednesday, September 6, 2023<\/h3>\n<p>Towards the \u2063end of the month, Hunter\u200b Biden will be \u200dthe subject of \u200da federal grand jury\u2063 indictment for his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/josh-hammer-the-chesa-boudin-inflection-point-in-the-fight-for-civilizational-sanity\/\" title=\"Josh Hammer: The Chesa Boudin Inflection Point in the Fight for Civilizational Sanity\">gun-related offenses<\/a>, the Justice Department\u2064 <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.82797\/gov.uscourts.ded.82797.37.0.pdf\" data-type=\"link\" data-id=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.ded.82797\/gov.uscourts.ded.82797.37.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">announced in a court filing<\/a> on Wednesday.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The petition was made in\u2064 response to a court order issued orally on August 31<sup>st<\/sup> that requested an update on the case from the \u2063Justice Department and Biden\u2019s attorneys, as well as any actions they felt the Delaware court should take.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe Speedy Trial Act requires that the government obtain the return of an indictment by \u200da\u2063 grand\u2064 jury by Friday, September \u200b29, 2023, at the earliest. The government intends to seek the return of an indictment in this case\u200b before \u200dthat date,\u201d \u200bSpecial\u200d Counsel David Weiss said.<\/p>\n<\/blockquote>\n<p>Soon after Weiss\u2019 report was \u200dsubmitted, attorneys for Hunter did the same, stating that the 53-year-old has been abiding by the terms of a prior diversion arrangement\u2062 made with federal\u200c prosecutors to avoid a felony firearms charge.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cMr. Biden has been following and will continue to follow the conditions of that Agreement, which the U.S. Attorney\u2019s Office agreed and signed and informed the Court on July 20, 2023 that\u2062 the Probation Office had agreed to and had recommended be put into effect,\u201d his lawyers stated.<\/p>\n<\/blockquote>\n<p>As part of the\u200c <a href=\"https:\/\/www.oann.com\/newsroom\/hunter-biden-attorneys-claim-gun-portion-of-plea-deal-is-valid-after-special-counsel-report\/\">diversion arrangement<\/a>, Biden\u2062 would need to refrain from alcohol and drug use, submit to drug testing,\u200d forgo committing other felonies \u2062for two\u2063 years, and consent to never again owning a handgun.<\/p>\n<p>The first son\u2019s plea deal with federal prosecutors in June, which would have allowed him to avoid prosecution on a felony charge of owning a firearm while addicted to crack cocaine, \u200dfell through in \u2062a Delaware courtroom\u200c in July. <\/p>\n<p>As\u200d a result, the first son\u200c was not eligible for broad immunity \u200dprotection.<\/p>\n<p>Under the terms of the ill-fated agreement,\u2063 Hunter would have been sentenced to two years of\u2062 probation for\u200d two tax offenses and to a diversion program for the weapons \u200callegation.<\/p>\n<p>Weiss\u200b departed \u200bfrom the predetermined course of action during\u2063 a contentious, three-hour hearing in a federal courtroom in Wilmington, Delaware, where U.S. District Judge Maryellen Noreika was expected to\u2063 certify the\u2064 agreement.<\/p>\n<p>Noreika was told that the agreement, which was unprecedented at \u2064the time, did not stop investigators from continuing \u200btheir ongoing \u2062inquiry\u2064 into Hunter\u2019s alleged crimes, including his alleged violations\u2063 of the Foreign Agents Registration Act.<\/p>\n<p>Chris Clark, an attorney for\u2062 Hunter, referred to\u200b the \u2062plea\u2062 deal\u2064 as \u201cnull and void\u201d after hearing Weiss suggest that the prosecution would file more charges.<\/p>\n<p>However, according to\u2063 Wednesday\u2019s status report, Hunter\u2019s legal team reportedly feels that the deal is still in effect, \u200bat \u2062least in regard to\u2062 the gun accusation.<\/p>\n<p>Attorney General Merrick Garland appointed Weiss as special counsel in the case on August 11<sup>th<\/sup>. He did\u200b so after citing \u201cthe <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-investigation-garland-appoints-david-weiss-as-special-counsel\/\" title=\"David Weiss has been appointed as special counsel for the Hunter Biden investigation by Garland.\">extraordinary circumstances relating<\/a> to \u2062this matter\u201d in support of his choice to give the Delaware U.S. attorney broad authority to file\u200d charges, issue subpoenas, and obtain search warrants\u200b related to the case.<\/p>\n<p>IRS investigators in charge of the case testified before Congress earlier this month, \u2064saying that U.S. attorneys chosen by President Biden prevented Weiss from filing \u2064charges against his son in Southern California and Washington, D.C., and that Weiss had been <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-says-hunter-biden-will-be-indicted-on-gun-charges-later-this-month\/\" title=\"Hunter Biden to face gun charges, DOJ confirms.\">denied special counsel status earlier<\/a> in the \u200binvestigation despite \u2062requesting it.<\/p>\n<p>Both statements have been refuted by Garland and Weiss.<\/p>\n<div class=\"wp-block-file\"><object class=\"wp-block-file__embed\" data=\"https:\/\/c3.oann.com\/wp-content\/uploads\/2023\/09\/gov.uscourts.ded_.82797.37.0.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of gov.uscourts.ded_.82797.37.0.\"><\/object><a id=\"wp-block-file--media-5dba0d2f-2e22-491a-ba6d-b34c72bc6e9f\" href=\"https:\/\/c3.oann.com\/wp-content\/uploads\/2023\/09\/gov.uscourts.ded_.82797.37.0.pdf\">gov.uscourts.ded_.82797.37.0<\/a><a href=\"https:\/\/c3.oann.com\/wp-content\/uploads\/2023\/09\/gov.uscourts.ded_.82797.37.0.pdf\" class=\"wp-block-file__button wp-element-button\" download aria-describedby=\"wp-block-file--media-5dba0d2f-2e22-491a-ba6d-b34c72bc6e9f\">Download<\/a><\/div>\n<p>Stay informed!
