Jean Carroll after \u2063she first publicly accused \u2064him four years ago of sexually\u2064 assaulting her\u200d at a Manhattan department store during the mid-1990s.<\/p>\n<p>U.S. District Court Judge Lewis Kaplan in New York said\u2063 an upcoming trial scheduled for \u2062January 2024 \u201cshall be \u2064limited to \u200bthe \u2063issue of damages only.\u201d<\/p>\n<blockquote>\n<p>\u201cThe\u200d truth \u200dor \u2062falsity of Mr. Trump\u2019s 2019 statements therefore depends \u2014 like the \u200ctruth or falsity of his 2022 statement \u2014 \u200don whether Ms. Carroll lied about Mr. Trump sexually assaulting her. The jury\u2019s finding that she did not therefore is binding \u2064in this case and precludes Mr. Trump\u200d from \u2063contesting the falsity of his 2019 statements,\u201d Kaplan\u2064 wrote in a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.nysd.543790\/gov.uscourts.nysd.543790.214.0.pdf\" target=\"_blank\" rel=\"noopener\">25-page ruling<\/a>.<\/p>\n<\/blockquote>\n<p>Trump lost a legal battle \u2062against \u2062Carroll earlier\u200c this year\u200c when a New York federal \u200djury\u200d found the former president allegedly committed battery against \u200cthe \u200cformer\u2063 columnist \u200band later \u200cdefamed her while denying\u200c her \u200bclaim. Trump, \u200cwho \u2064has \u200clong denied the allegations\u2062 against him from Carroll, appealed the jury\u2019s verdict in which he was\u200c ordered to pay $5 million in damages.<\/p>\n<p>Carroll sued Trump last November \u2062in New York, the same day\u200c a new law \u200dopened a one-time, one-year window for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-appeals-carroll-verdict-as-carroll-mulls-over-filing-third-defamation-lawsuit-over-town-hall-remarks\/\" title=\"Trump appeals Carroll verdict, possible third defamation lawsuit.\">adult sexual assault survivors<\/a> outside\u2063 the statute of limitations to seek civil damages for sexual battery.<\/p>\n<p>Trump\u2019s legal \u2062team filed the counterclaim \u2064in \u200dJune, which said Carroll \u201cdisregarded the jury\u2019s finding\u2062 that Counterclaimant did not rape her,\u201d as part of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-found-liable-for-defamation-in-second-e-jean-carroll-case-judge-rules\/\" title=\"Judge rules Trump liable for defamation in second E. Jean Carroll case.\">separate defamation lawsuit brought<\/a> by the writer in 2019 \u2063and set\u2062 to go to trial in January.\u200b But Kaplan <a href=\"https:\/\/www.dailywire.com\/news\/judge-tosses-trumps-defamation-claim-against-e-jean-carroll\" target=\"_blank\" rel=\"noopener\">tossed<\/a> the counterclaim last month.<\/p>\n<p>Judge Kaplan\u200c also denied\u200d a bid from \u200bTrump\u2019s\u2064 attorneys to reduce any more damages\u200d awarded to Carroll.<\/p>\n<p>Trump has \u2062dismissed his losses to Carroll as \u201ca Miscarriage of Justice\u2062 and \u200ba\u200c total Scam\u201d on his\u200d Truth Social page.<\/p>\n<p><strong><a href=\"https:\/\/onelink.to\/dwapp\">CLICK HERE TO GET THE DAILY WIRE\u2063 APP<\/a><\/strong><\/p>\n<p>\u201cThe trial was very unfair, with the other side\u200d being able to do and \u200bpresent \u2062virtually anything they \u200dwanted, and our side being largely and wrongfully shut down by an absolutely hostile, biased, \u2064and out of \u200dcontrol judge,\u201d he wrote in \u2064July.<\/p>\n<p>Trump attorney \u200bAlina Habba reportedly argued that Carroll\u2019s earlier case would nullify\u200d the judge\u2019s ruling if \u2063the appeals court \u2062favored the \u2064former \u2064president\u2019s claim.<\/p>\n<p>\u201cWe remain very confident\u2064 that the Carroll II verdict will be overturned \u2062on appeal, \u200bwhich will render this decision\u200c moot,\u201d Habba \u2063told NBC News in a <a href=\"https:\/\/www.nbcnews.com\/politics\/donald-trump\/trump-liable-defamation-second-e-jean-carroll-case-judge-rules-rcna103632\" target=\"_blank\" rel=\"noopener\">statement<\/a>. \u201cWe also anticipate that the Second Circuit will stay this trial as it \u200bconsiders \u2062the meritorious defenses that have been raised by President Trump.\u201d<\/p>\n<p>Trump is running a 2024 campaign for a second term \u200cin the White House. In \u200daddition to civil litigation, he faces multiple indictments at the state and federal \u2063levels.
