But a \u200bnew <a href=\"https:\/\/emersoncollegepolling.com\/d-c-poll-64-of-residents-would-find-trump-guilty-ahead-of-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">poll<\/a> out Monday suggests former President Donald \u2063Trump can\u2019t get \u2062a fair trial in Washington, D.C. in the case his 2024\u200d rival\u2019s Justice Department is pursuing against him over his objections to the last \u200cpresidential election.<\/p>\n<p>According to an\u200b Emerson College survey, a majority of Washington D.C. residents,\u2064 64 \u200cpercent, said\u2064 they would vote in favor \u200bof a conviction over the former\u200b president\u2019s objections to \u2064the 2020 election results. Only 8 percent said they would find Trump\u200c innocent,\u200c and another 28 \u2062percent were unsure.<\/p>\n<p>District residents were also divided on \u2062their \u2063desire \u2063to serve on \u2062the jury. More than half, 55 percent, said they would want to sit on the trial jury while 45 percent reported they would not.<\/p>\n<p>Emerson College Polling Executive Director\u2064 Spencer Kimball said the survey results showed \u201cthose who are more impartial \u200babout the trial are less likely to want to serve \u200don \u2062the jury.\u201d<\/p>\n<p>\u201cThose who want to \u200dserve find Trump \u2064guilty \u200crather than innocent <strong>68% to 9%<\/strong> with 23% \u2063unsure, while those who\u2063 don\u2019t want to serve think Trump is guilty <strong>60% to\u200d 6%<\/strong>, with 34% unsure,\u201d \u200bKimball said.<\/p>\n<p>The former president <a href=\"https:\/\/www.politico.com\/news\/2023\/08\/07\/trump-judge-chutkan-transfer-venue-00110094\" target=\"_blank\" rel=\"noreferrer noopener\">cited<\/a> D.C.\u2019s\u200c far-left voting\u200b record \u2064last month as a reason to move \u2064the\u2063 trial, \u200dwhich pertains \u200dto \u200cthe events of Jan. 6, 2021, out\u2062 of the Beltway bubble. The district overwhelmingly <a href=\"https:\/\/www.nytimes.com\/interactive\/2020\/11\/03\/us\/elections\/results-district-of-columbia-president.html\" target=\"_blank\" rel=\"noreferrer noopener\">voted<\/a> to deliver its three electoral votes to\u200b President\u200c Joe Biden \u2062in the last\u200d election, 92 to\u200d 5 \u2064percent.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/new-poll-shows-trump-wont-get-a-fair-jury-trial-from-d-c-residents-whove-already-decided-hes-guilty\/\" title=\"Poll: D.C. Residents Biased Against Trump, Denying Fair Jury Trial\">federal \u200bjudge overseeing<\/a> the case, however, has a\u2063 record of bias that\u2062 only casts <a href=\"https:\/\/thefederalist.com\/2023\/08\/15\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" target=\"_blank\" rel=\"noreferrer noopener\">further doubt<\/a> \u200d on\u200d the former\u2062 president\u2019s \u2064prospects\u200b of a fair trial \u2014 and\u2063 she is unlikely to approve the defendant\u2019s request that\u2063 she recuse herself.<\/p>\n<p>U.S. District Court Judge Tanya Chutkan is an \u2064Obama appointee\u2062 who developed a reputation \u200bin recent years as a \u2062\u201ctough punisher of Capitol rioters,\u201d \u2063 <a href=\"https:\/\/apnews.com\/article\/trump-indictment-judge-tanya-chutkan-capitol-riot-9ba5c18d315697d759521425ea203012\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to\u2064 the Associated Press. Chutkan repeatedly denied requests to \u2062move Jan. 6 riot cases outside of\u200b D.C. and handed down severe sentences to 38 \u200cdefendants.<\/p>\n<p>\u201cOther judges typically have handed down sentences that are more lenient than those requested by prosecutors,\u201d the AP reported. \u201cChutkan, however, has matched \u200cor <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-tanya-chutkans-record-should-disqualify-her-from-presiding-over-trumps-j6-trial\/\" title=\"Judge Tanya Chutkan's record disqualifies her for presiding over Trump's J6 trial.\">exceeded prosecutors\u2019 recommendations<\/a> in 19 of her 38 \u200bsentences. In four\u2062 of those cases, prosecutors weren\u2019t \u2063seeking any jail time at\u2064 all.\u201d<\/p>\n<p>In her denial\u200b of a Jan. 6 defendant\u2019s request\u200d to relocate his politically\u200b charged trial from the \u2064Democrat-dominated district last \u2064year, Judge Chutkan claimed residents\u2019 lopsided political views were\u2062 not\u2064 enough of\u200d a reason to transfer the case.<\/p>\n<p>\u201cJurors\u2019 political leanings\u200d are not, by themselves, evidence that those jurors cannot fairly and impartially consider \u200dthe evidence presented \u2062and \u200capply the law\u200d as instructed \u200bby\u200c the court,\u201d Chutkan <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/trump-wants-his-election-conspiracy-trial-moved-away-from-washington-that-wont-be-easy\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>.<\/p>\n<p>The Emerson College survey\u2063 out Monday interviewed 500\u2062 D.C. residents\u2063 between Aug. 29\u2063 to Sept. 2 and was conducted with a 4.3 \u2064percent\u2064 margin of error.<\/p>\n<hr>\n<h3>About the Author<\/h3>\n<p>Tristan Justice is the\u200b western correspondent for \u2062The Federalist and the author of \u2062Social Justice Redux, a \u2062conservative\u200d newsletter on culture, health, and wellness.
