You can redress the government. You can twist \u200carms politically.\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt is\u2062 not illegal to\u2062 object to presidential elections,\u201d continued Davis. \u201cIt\u2019s allowed by the Electoral Count Act \u200bof 1887.\u2062 It\u2019s \u200cnot illegal to twist arms politically that\u2019s allowed\u200c by\u200c the First Amendment.<\/p>\n<\/blockquote>\n<p>Meadows is also awaiting\u2063 a ruling\u200b from U.S. District Judge Steve Jones on his <a href=\"https:\/\/www.oann.com\/newsroom\/former-white-house-chief-of-staff-white-mark-meadows-files-to-move-fulton-county-case-to-federal-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">bid to move<\/a> his case\u200c into the federal \u2062jurisdiction.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThere\u2019s no question this case \u200bshould \u2064be \u2063in federal court,\u201d Davis said. \u201cThese are charges against a former federal official based upon things that he did within his official \u200cduty.\u201d<\/p>\n<\/blockquote>\n<p>Federal statute <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/1442\" target=\"_blank\" rel=\"noreferrer noopener\">28 U.S.\u200d Code \u00a7\u200d 1442<\/a> \u2063which says, \u2064\u201cA civil action or criminal prosecution that is commenced in a <a href=\"https:\/\/www.law.cornell.edu\/definitions\/uscode.php?width=840&#038;height=800&#038;iframe=true&#038;def_id=28-USC-1383817500-315185671&#038;term_occur=999&#038;term_src=title:28:part:IV:chapter:89:section:1442\" target=\"_blank\" rel=\"noreferrer noopener\">State court<\/a> and that is against or directed to \u2062any \u2062of the\u2064 following may be removed by them to the district court of the United States for\u200d the district \u200dand \u2062division\u200d embracing the place \u200cwherein \u2064it is \u200bpending\u2026any officer (or any person acting under that officer) of \u2064the United States.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAnd once you get this out of this \u2062Georgia Court, you\u2019ll get it to the \u2064federal court in Georgia,\u201d Davis said. \u201cAnd then you can move to dismiss these charges on government immunity and First Amendment grounds.\u201d<\/p>\n<\/blockquote>\n<p>Trump has not filed to \u2064move his case to federal jurisdiction, yet many legal experts, including Davis, expect him to do so. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThere\u2019s presidential immunity,\u201d said Davis. \u201cAnd the case law is very clear that if\u2063 you\u2019re acting\u200b within your presidential powers \u200cor in the outer perimeter of your presidential powers, \u2062you \u200dhave \u2064immunity.\u201d<\/p>\n<\/blockquote>\n<p>Trump\u2019s \u200dlegal teams \u2062are expected to argue that he is entitled to sweeping protection against\u2064 criminal prosecution for actions he took regarding his White House\u2064 duties. Trump attorney \u200cJohn \u200cLauro has already said Trump will file a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/meadows-awaits-judges-decision-on-whether-to-move-case-to-federal-court\/\" title=\"Meadows awaits judge's ruling on case transfer to federal court.\">pretrial\u2062 motion arguing presidential\u2062 immunity<\/a> in his\u2063 federal Jan. 6 \u200dcase. <\/p>\n<p>Davis explained this indictment is criminalizing government officials for acting within the \u200bparameters of their jobs.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cYou\u2064 can\u2019t have it\u200c where these government officials worry about\u200b being\u2064 criminally charged for performing their\u200d official duties,\u201d\u200b Davis said.<\/p>\n<\/blockquote>\n<p>Stay informed!
