Meta\u2019s Facebook, Instagram, Marketplace and WhatsApp also qualified as gatekeepers.<\/p>\n<p>The companies will \u200bhave\u200d six months to demonstrate their compliance with their obligations and can be fined up \u2063to 10% of their annual global\u200b turnover for DMA violations.<\/p>\n<p>Gatekeepers could ask for an interim measure\u2064 to suspend the application of the rules but they would need \u2062to launch a\u200b legal case in the EU Court \u2062of Justice in Luxembourg to do that,\u2064 a senior Commission official said.\u2062 \u201cWe haven\u2019t seen anything like that so\u2064 far.\u201d<\/p>\n<p>Following the introduction of separate \u200clegislation, the Digital Services Act, Zalando took the Commission to court in June. <\/p>\n<p>\u201cIt\u2019s D-Day for #DMA!,\u201d EU industry chief Thierry Breton said on X, formerly known as \u2062Twitter. \u201cThe most impactful online companies will\u200c now have to play by our EU rules.\u201d<\/p>\n<p>A Microsoft spokesperson said \u200dit accepts its gatekeeper designation, while Meta,\u200d Google \u200dand Amazon spokespersons said they\u200b were reviewing the designations.<\/p>\n<p>Apple and TikTok were less welcoming.<\/p>\n<p>TikTok said it\u2062 \u201cfundamentally disagree with this decision\u201d and \u201cdisappointed that no market investigation was conducted prior to\u2064 this decision and\u2063 are evaluating our next steps.\u201d <\/p>\n<p>An Apple spokesperson said the company remained \u201cvery \u2062concerned about the privacy and data\u200d security risks the DMA poses for our users.\u201d <\/p>\n<p>The iPhone maker had <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minnesota-lawmaker-concerned-over-bill-allowing-government-to-track-alleged-hate-and-bias-incidents\/\" title=\"Minnesota Lawmaker Concerned Over Bill Allowing Government to Track Alleged \u2018Hate and Bias Incidents\u2019\">earlier raised concerns<\/a> that the DMA would lead to more installing of apps that do not come via Apple\u2019s App Store, or \u201cside-loading\u201d.<\/p>\n<p>\u201cThe\u2064 Commission should balance the\u200c need to protect \u2064user security and privacy with the very real risk\u200b that gatekeeper app stores will use\u2063 security and privacy as excuses\u200b to dilute \u2064compliance with their DMA obligations,\u201d said Stavroula Vryna, partner\u200c at law firm Clifford Chance.    <\/p>\n<p>Alphabet\u2019s Gmail, Microsoft\u2019s\u200c Outlook and Samsung\u2019s browser were exempted after the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/big-techs-core-businesses-face-overhaul-under-eu-tech-rules\/\" title=\"EU tech rules to bring major changes to Big Tech's core businesses.\">companies provided sufficiently justified arguments showing<\/a> that these services \u200ddo not qualify as gatekeepers, the Commission said.<\/p>\n<p>The Commission has also opened four market investigations to further assess Microsoft\u2019s and Apple\u2019s \u200csubmissions that some of \u2064their \u2062core platforms \u200csuch\u2063 as Bing, Edge and Microsoft Advertising, and Apple\u2019s iMessage services \u200bdo not qualify as gateways.  <\/p>\n<p>\u201ciMessage is designed and marketed for\u200b personal consumer communications,\u200d and we look forward\u2064 to explaining to the commission why iMessage is outside\u200b the\u2063 scope of the DMA,\u201d an Apple spokesperson\u200d said.<\/p>\n<p>  (Reporting by Supantha Mukherjee in \u200bStockholm, Foo Yun Chee in Brussels and Martin Coulter in London;
