He was acquitted of assaulting, resisting, or impeding\u2062 certain officers, and\u2063 the jury was unable to reach a \u2062verdict on two other counts.<\/p>\n<p>Similar to the Oath Keepers trial, Mr. Tarrio was accused of plotting to\u2064 disrupt\u200c the peaceful transfer of power from President Donald J. \u2064Trump to Joseph Biden Jr.<\/p>\n<p>Defense\u2063 attorney Sabino Jauregui rejected the \u2064characterization of his client as a terrorist, instead describing Mr. Tarrio as a &#8220;misguided\u200d patriot.&#8221;<\/p>\n<p>Assistant U.S. Attorney Conor \u2064Mulroe disagreed, labeling the events of Jan. 6 as a &#8220;calculated act of\u200b terrorism.&#8221;<\/p>\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<p>Although \u2064Mr. Tarrio was not physically present in Washington on Jan. 6, prosecutors argued that he \u2063communicated with the Proud\u2063 Boys through social media, \u2064using phrases like &#8220;1776&#8221; and issuing warnings\u2062 to elected officials. They \u200dclaimed that Mr. Tarrio was\u2063 consumed with the idea of revolution leading up to \u2062Jan. 6.<\/p>\n<p>In their <a href=\"https:\/\/s3.documentcloud.org\/documents\/23937468\/sentencing-memorandum-by-henry-enrique-tarrio.pdf\" target=\"_blank\" rel=\"noopener\">sentencing \u200cmemorandum,<\/a> defense attorneys Nayib Hassan and Mr. Jauregui criticized the Department of Justice for recommending \u200ban &#8220;upward departure&#8221; in sentencing based on alleged terrorism.
