Scott Perry (R-Pa.), who has been fighting to keep the\u2062 records protected.<\/p>\n<div class=\"my-5\">\n<blockquote>\n<p>A three-judge panel of the D.C. Circuit Court of Appeals issued a ruling (<a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/E4BC36AFE6A510E285258A210052CA9F\/$file\/23-3001.nopassword.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) on Sept. 5\u200d that vacates parts of a lower court\u200d ruling that gave Mr. Smith&#8217;s prosecutors access\u200b to around 2,000 records from Mr. Perry&#8217;s phone.<\/p>\n<\/blockquote><\/div>\n<p>While the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/court-blocks-jack-smiths-bid-to-obtain-rep-scott-perrys-fbi-seized-phone-records\/\" title=\"Court denies Jack Smith's request for Rep. (Mandel Ngan\/AFP via Getty Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>A separate order released on Sept. 5 by the\u200b appeals court gave both Mr. Perry&#8217;s lawyers and Mr. Smith&#8217;s\u200c team a week to indicate whether they think any parts of the \u2062ruling should remain secret.<\/p>\n<div class=\"my-5\">\n<blockquote>\n<p>&#8220;In the event the parties conclude that the record or any portion of it should remain under seal, the parties are directed to identify the proposed redactions and provide an explanation for each proposed\u200d redaction,&#8221; reads a summary order filed in the docket.<\/p>\n<\/blockquote>\n<h2>More Details<\/h2>\n<p>A phone belonging to Mr. Perry, an ally \u2063of\u2064 former President Donald\u200b Trump, was seized one day after the former president&#8217;s Mar-a-Lago residence was raided by FBI agents in the summer of 2022.<\/p>\n<div class=\"my-5\">\n<p>Mr. Perry <a href=\"https:\/\/www.theepochtimes.com\/rep-scott-perry-says-fbi-seized-his-cell-phone-after-mar-a-lago-raid_4654179.html\" target=\"_blank\" rel=\"noopener\">told The Epoch Times<\/a> \u2063in August 2022 that three FBI \u2062agents had seized the phone from him, \u2063with the lawmaker adding that the agents made no attempt to contact his lawyer.<\/p>\n<\/p><\/div>\n<\/p><\/div>\n<p>\u201cI\u2019m outraged\u2014though not surprised\u2014that the FBI under the direction of [Attorney General] Merrick Garland\u2019s [Department of Justice (DOJ)], would seize the phone of a sitting Member of Congress,&#8221; the congressman said in a\u2064 statement.<\/p>\n<p>&#8220;My phone contains info about my legislative and political activities, and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-fbi-confiscates-cell-phone-of-republican-congressman\/\" title=\"BREAKING: FBI Confiscates Cell Phone Of Republican Congressman\">personal\/private discussions<\/a> with \u2064my wife, family, constituents, and friends.\u200c None of this is the government\u2019s business,&#8221; he\u2064 added.<\/p>\n<div class=\"my-5\">\n<p>Not long after his phone was \u2063seized, Mr. \u2064Perry <a href=\"https:\/\/www.theepochtimes.com\/us\/congressman-sues-biden-administration-over-seized-phone-data-4686227\" target=\"_blank\" rel=\"noopener\">sued the Biden administration<\/a>, asking a \u2062federal court\u2063 in Washington\u200b to \u200chalt\u2064 review of his phone \u2062data, compel\u2062 government officials to return the data and \u2063any other property it seized, \u200cand prohibit officials from acquiring any other \u2062information until the matter is fully litigated.<\/p>\n<\/p><\/div>\n<div class=\"my-5\">\n<p>On Dec. 28, 2022, U.S. District Court Chief Judge Beryl Howell <a href=\"https:\/\/www.theepochtimes.com\/us\/judge-rejected-congressmans-bid-to-shield-emails-from-doj-5082751\" target=\"_blank\" rel=\"noopener\">rejected<\/a> Mr. Perry&#8217;s\u200d bid to shield the records. \u200bJudge Howell, an Obama appointee, ruled that the DOJ could access 2,055 records from the lawmaker&#8217;s seized phone. She said that another three records could be partially \u2064accessed, while ruling \u2063that Mr. Perry correctly asserted privilege over 161 other records.<\/p>\n<\/p><\/div>\n<p>The legal fight over Mr. Perry&#8217;s records began before Mr. \u2063Smith was appointed special counsel last November but \u2064seems to have continued under Mr. Smith&#8217;s watch \u2064as he probes allegations of interference in the certification of the 2020 election.<\/p>\n<div class=\"my-5\">\n<blockquote>\n<p>Now, the appeals court&#8217;s decision on Sept. 5 rejects portions of Judge Howell&#8217;s ruling, with the summary\u200b judgment ordering it &#8220;vacated in part and \u200dremanded to the district\u2064 court to apply the correct standard to Representative Perry\u2019s communications with individuals outside \u200cthe federal\u200c government.&#8221;<\/p>\n<\/blockquote><\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A federal appeals court has barred special counsel Jack Smith&#8217;s team from accessing Rep.
