Scott Perry \u200d(R-PA). This\u2062 data \u200dis crucial to the ongoing investigation into Donald Trump and potential interference\u200b in the 2020 election.<\/p>\n<blockquote>\n<p>A \u200bthree-judge panel on the U.S. Circuit \u200bCourt for the District of\u200b Columbia overruled\u200d part of a lower court&#8217;s \u200ddecision, \u2063which would have granted Smith&#8217;s team access to a significant portion of the\u200b data sought from Perry&#8217;s phone. The \u200bdetails of this ruling remain under seal as\u2063 of Tuesday afternoon.<\/p>\n<\/blockquote>\n<p>Last year \u2062in \u2064August, \u2062federal investigators seized Perry&#8217;s phone, coinciding with the \u200bFBI raid on former\u200b President Trump&#8217;s Mar-a-Lago home. Scott Perry's phone faces a court setback.\">lower\u200b court ruling initially allowed<\/a>\u200c the Justice Department access \u2064to approximately 2,200 texts, emails, and attachments from Perry&#8217;s phone. They\u2062 contended\u2064 that members of Congress are protected by the Constitution&#8217;s &#8220;speech or debate&#8221; clause.<\/p>\n<p>The Department \u2062of Justice, on\u200d the other hand, argued that extending \u200bthe speech or \u2062debate protection too \u2064broadly could\u200b shield members of Congress from almost any investigation, providing them with excessive\u2063 protection.<\/p>\n<p>Perry\u2062 appealed the lower\u200d court&#8217;s ruling in December, \u200dleading to months\u200c of\u2064 deliberation \u200cby the appeals \u2064court. The sealed ruling,\u2064 spanning 29 pages, was formulated\u2062 by a three-judge panel consisting \u200cof Neomi \u200bRao,\u200d a Trump appointee\u2064 who wrote the main \u200bopinion, Judge\u200d Karen LeCraft Henderson, nominated by \u200bPresident George H.W.
