The lawsuit, which had been previously\u200d blocked\u200d by a\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sidney-powell-is-an-american-legal-giant\/\" title=\"Sidney Powell Is an American Legal Giant\">federal judge<\/a>, can now move\u2064 forward.<\/p>\n<p>The doctors filed\u200c the lawsuit against the Department of Health and \u2062Human Services and the FDA, claiming that \u200ctheir\u200d medical practices \u200bwere harmed due to the FDA&#8217;s advice \u2062against taking ivermectin. Some doctors believe that ivermectin \u2062could be a potential treatment for COVID-19. \u200dThe suit also names HHS Secretary Xavier Beccera and FDA Commissioner \u2062Robert Califf as defendants.<\/p>\n<blockquote>\n<p>&#8220;FDA is\u200d not a physician. It has authority to inform, announce,\u200d and apprise \u2014 but not to \u2062endorse, denounce, or advise,&#8221; wrote Judge Don Willett for the U.S. Court of Appeals for the \u2062Fifth \u2063Circuit. &#8220;The Doctors have plausibly alleged that FDA\u2019s Posts fell on the wrong side of the line between telling about and telling to.&#8221;<\/p>\n<\/blockquote>\n<p>The ruling specifically referenced an FDA post that went viral, stating,\u200b &#8220;you are not a horse&#8221; in response \u200dto people using ivermectin. While the FDA has approved\u200d ivermectin\u200c for certain infections, it has cautioned against using it to \u2062treat COVID-19.<\/p>\n<blockquote>\n<p>&#8220;The messaging\u200b traveled widely\u2062 across legacy and online media. Left unmentioned in most \u2063of that messaging: \u2064ivermectin also comes\u2063 in \u2064a human version. And\u2064 while the human version is\u2064 not FDA-approved \u2064to treat \u200dthe coronavirus, some people were using it off-label for that purpose,&#8221;\u2062 the ruling said.<\/p>\n<\/blockquote>\n<p>The doctors involved in the lawsuit claim that the FDA&#8217;s messaging\u200b interfered with their ability to practice medicine. \u200cThey argue that the FDA&#8217;s \u200cactions regarding ivermectin violate the Administrative Procedure Act\u2063 (APA), which governs how administrative agencies \u2064operate.<\/p>\n<blockquote>\n<p>&#8220;As such, the Doctors can use the \u200cAPA to assert their ultra \u2064vires claims \u200dagainst\u2062 the Agencies and the Officials,&#8221; the ruling stated. &#8220;Even <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fed-court-permits-doctors-lawsuit-alleging-fda-exceeded-its-authority-with-anti-ivermectin-campaign\/\" title=\"Court allows doctor's lawsuit claiming FDA overstepped in anti-Ivermectin campaign.\">tweet-sized doses<\/a> of personalized medical advice are beyond \u200dthe\u200c FDA&#8217;s statutory authority.&#8221;<\/p>\n<\/blockquote>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1693504018745000&#038;usg=AOvVaw1RMMjCvCBOBYdpkw5O_njE\">CLICK \u2063HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Mary Talley Bowden, one of the doctors \u200dinvolved in the lawsuit, \u200cexpressed her joy \u2062over the\u200d ruling on \u2062social media.<\/p>\n<blockquote>\n<p>&#8220;A small win, or at least a step forward, in a monumental battle to protect \u200bthe \u200ddoctor-patient \u2064relationship from government tyranny. ONWARD!&#8221; she wrote.<\/p>\n<\/blockquote>\n<p>Bowden faced suspension from Houston Methodist Hospital after <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/not-a-physician-federal-judges-say-doctors-can-continue-suit-against-fda-over-ivermectin\/\" title=\"Federal judges have ruled that doctors can proceed with their lawsuit against the FDA over Ivermectin, despite not being physicians.\">publicly opposing vaccine mandates<\/a> and advocating for the use of ivermectin to treat COVID-19.
