Version: 4.0.47--><h2>California Democrats Push for \u2064Bill to Strip Constitutional Protections Against Racial Discrimination<\/h2>\n<p>On Friday, September 1, the California assembly\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/house-holds-hearing-on-capitol-break-in-security-failures\/\" title=\"House holds hearing on capitol break-in security failures\">appropriations committee held<\/a> a <a href=\"http:\/\/cferfoundation.org\/posts\" target=\"_blank\" rel=\"noopener\">hearing<\/a> \u2063in which they <a href=\"http:\/\/billtrack50.com\/billdetail\/1576426\" target=\"_blank\" rel=\"noopener\">voted<\/a> to move forward with a bill that would strip California\u2019s Constitution of its protections against racial\u200c discrimination.<\/p>\n<h3>Current Constitutional Protections<\/h3>\n<blockquote>\n<p><em>\u201cThe State shall\u200d not discriminate \u2062against,\u200c or \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-strikes-down-californias-corporate-racial-diversity-law\/\" title=\"Judge Strikes Down California\u2019s Corporate Racial Diversity Law\">grant preferential treatment<\/a> to, any individual group on the basis of race,\u200b sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.\u201d<\/em><\/p>\n<\/blockquote>\n<p>The bill, called \u2062ACA-7, seeks \u2063to amend this section of the State Constitution by adding:<\/p>\n<blockquote>\n<p><em>\u201cThe State may\u200d use state money to\u200d fund \u2063research-based, or \u200cresearch-informed, and culturally specific programs\u200d in\u2062 any industry, including, but not limited \u2062to, public employment,\u2064 public education, and public contracting, if those\u2064 programs are established or otherwise \u2063implemented by the State\u2063 for purposes of increasing the life expectancy of,\u200b improving \u2062educational\u200b outcomes for, or \u200clifting out of poverty specific groups based on race, color, ethnicity, national origin, or marginalized \u200dgenders, sexes, or sexual orientations.\u201d<\/em><\/p>\n<\/blockquote>\n<p>In short, California\u200d Democratic\u2064 lawmakers don\u2019t like the simple yet unequivocal ban on discrimination in the \u200bState\u2019s Constitution.\u200c They want to \u2063replace it \u200dwith a system where all the California government\u200c has to do is \u2063find\u2064 an academic paper or professor \u200dclaiming \u200bthat their race-based programs and affirmative action\u200d initiatives do, in fact, \u201cimprove\u200d educational outcomes\u201d\u2062 or \u200c\u201clift out of poverty\u201d certain minorities, and they can go \u200don discriminating based on \u200drace, forcing Californians\u2019 tax dollars to support race-based preferential \u200btreatment in perpetuity.<\/p>\n<p>It is \u2063quite ironic \u200cand very\u200c sad that California Democrats have \u200dgotten to\u200d a point where they are so convinced that they are the ones fighting \u200cfor justice and\u200d individual rights while openly championing a bill that would\u2062 destroy the protections that grant \u2064every American the\u2063 same rights\u2063 and opportunities, \u2063the\u200b protections that\u200d allow \u200bevery American \u200bto \u2064be assessed \u200cbased\u200b on their own\u200d merit and character, regardless of the color of their \u2063skin. Of course, the supporters of ACA-7 believe that certain groups \u2014 blacks, for example \u2014 have been so marginalized by past discrimination and by current \u2063institutional\u2062 racism, that treating everyone \u2063the \u2062same and providing everyone with the same \u2063opportunities regardless\u200c of race is actually a form of injustice. Yes, there\u2063 are real income\u200c and\u2064 achievement gaps for blacks and\u200c Hispanics in this country. But racial \u2062discrimination will not\u2063 solve \u2063those \u200dproblems. Racial discrimination should never be the answer \u2064in any context. It will create a\u200d country \u200cdivided into groups constantly fighting over which group gets to be raised \u200dup and which group has to\u2062 be\u200d pushed down. ACA-7 is\u2064 a morally abhorrent bill because it \u200dwould enshrine that kind \u2063of \u200ddivision.<\/p>\n<p>California Democrats likely won\u2019t find my arguments above convincing, but they should still \u2063drop ACA-7. Why?\u200c Because it\u2019s a losing issue for them.\u200b First and \u200dforemost, it\u2019s \u2062unpopular with voters. According to the Wall\u200c Street Journal, ACA-7 is deeply\u2064 unpopular\u2064 with <a href=\"http:\/\/wsj.com\/articles\/california-racial-discrimination-state-constitution-amendment-aca7-d1577878\" target=\"_blank\" rel=\"noopener\">Asian Americans<\/a>, who\u2063 have been waking up to the fact that race-based preferential treatment that throws merit \u2062out the\u2064 window seriously hurts\u2062 them and their futures. If Democrats go forward with this bill, they \u200cwill \u200dalienate even more of their Asian American voters, who \u2063have already begun to shift away because of \u200bDemocrat \u200cpolicies on crime.<\/p>\n<p>And \u2062it\u2019s not just Asian \u2062Americans who dislike \u200daffirmative action. The same\u2063 Wall Street Journal op\/ed cites a\u2064 Pew \u2063Research survey\u2064 conducted back \u200cin \u2062June which found \u2064that \u200cthe majority \u200cof \u2063Americans believe\u200d that considering race and ethnicity in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-assembly-pushes-new-amendment-in-favor-of-racial-discrimination\/\" title=\"California Assembly Proposes Amendment Supporting Racial Discrimination\">college admissions makes college\u2064 admissions<\/a> less fair \u200cthan more \u200cfair. If ACA-7 manages to pass \u2063in the state Senate, it will still have to be voted on by Californians \u2063in a \u2064referendum. The people of California don\u2019t\u2064 want state-sponsored racial \u2064discrimination. That\u2019s why they enshrined anti-discrimination into California\u2019s Constitution in the first place. In\u2063 all likelihood, ACA-7 will fail in\u200b the referendum, and California Democrats will\u2063 have wasted millions of dollars\u2064 campaigning for \u2064it and gained\u200c nothing except disdain from \u2063their constituents.<\/p>\n<p>And if somehow \u2063Democrats do convince enough Californians \u2064to pass this amendment, all that work will eventually come to nothing anyway, because the Supreme Court,\u2062 which ruled decisively against affirmative \u2063action back in June, will strike it down.<\/p>\n<p>California Democrats \u2063should abandon ACA-7 immediately.
