David\u2063 Bernstein, a professor\u2063 at George Mason University\u2019s Antonin Scalia School\u2064 of Law, stated that the provision was\u200c &#8220;blatantly illegal&#8221; and potentially violated\u2062 Title VII \u2062and the 1866 Civil Rights Act.\u200b He further emphasized that an\u2064 applicant who \u200dwas unable to apply due\u2063 to their race would\u2064 have grounds to sue NASCAR.<\/p>\n<p>While\u2062 NASCAR\u200b has made changes to the internship\u2064 requirements, it is \u2062worth noting that the racing league \u2063still \u2063maintains \u2063other diversity programs that seemingly\u2062 discriminate based on\u200d race.<\/p>\n<p>The internship was part of \u200ba larger\u2064 campaign \u200ccalled &#8220;drive for diversity,&#8221; which also encompasses the &#8220;driver development program&#8221; and \u2063the &#8220;pit crew \u200bdevelopment program.&#8221;<\/p>\n<div class=\"image\"><\/div>\n<p>The \u200bdriver development program \u2063is \u2064specifically designed for \u2064&#8221;top minority and female drivers,&#8221; while the pit crew development program targets &#8220;aspiring minority and female pit crew\u2063 members.&#8221; These programs have not been altered.<\/p>\n<div class=\"image\"><\/div>\n<div class=\"image\"><\/div>\n<p>According to the program requirements,\u200d participants must either be female or a &#8220;member of one or \u200dmore&#8230; ethnic minority classifications,&#8221; including African American, Asian, \u2063Hispanic or \u200cLatino,\u2062 Native American, Native Hawaiian or Pacific Islander, and \u2064individuals of two\u200b or more races.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>NASCAR eliminated a racial prerequisite in their &#8220;diversity internship program&#8221; that unfairly targeted white candidates, prompted by a report from The Daily Wire.
