However, he\u200d said that the Jan.\u200b 6 incident was merely &#8220;a protest that became \u200ca riot&#8221; and not an insurrection against the United States.<\/p>\n<p>&#8220;According to these\u2062 advocates, Trump can be barred from the ballot \u200bwithout any charge, let alone a conviction, of insurrection\u2063 or rebellion,&#8221; Mr. Turley said.<\/p>\n<p>Mr. Turley added that he views that some people who proposed the \u200dtheory also &#8220;argue that there is no action needed from Congress&#8221; and that &#8220;state and\u200d federal\u200c judges could just bar those who are deemed as supporting rebellion through their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-says-election-challenges-not-over-as-electoral-college-vote-looms\/\" title=\"Trump Says Election Challenges \u2018Not Over\u2019 as Electoral College Vote Looms\">election challenges<\/a> and\u200c claims.&#8221;<\/p>\n<p>Over the \u200dweekend,\u200c Sen. Tim Kaine (D-Va.), a former \u200dDemocratic vice presidential candidate, stated that there was a &#8220;powerful argument&#8221; for\u200d barring President \u200bTrump under the 14th Amendment.<\/p>\n<p>&#8220;The language \u200c(of the amendment) is \u200dspecific: If you give aid\u200d and comfort\u200d to those\u2062 who engage\u200d in an insurrection against the Constitution of the United States\u2014it doesn\u2019t say against the United States, it\u200b says against the Constitution.\u200d In my view, the\u2063 attack \u2062on\u2062 the Capitol that day was designed for a particular purpose \u2026 \u200band that was to disrupt the peaceful \u200dtransfer of power as is \u2063laid out \u2063in the Constitution,&#8221; \u200bhe told <a href=\"https:\/\/abcnews.go.com\/Politics\/powerful-argument-trump-disqualified-presidency-14th-amendment-kaine\/story?id=102886037\" target=\"_blank\" rel=\"noopener\">ABC \u200bNews<\/a>.<\/p>\n<p>The former\u200b president has long denied Democrat allegations that he initiated a riot \u200cor insurrection at\u2063 the Capitol. (Joe Raedle\/Getty Images)<\/figcaption><\/figure>\n<p>Also, Rep.\u200b Adam Schiff \u200d(D-Calif.), who had promoted \u2064often \u200cfalse claims that the former\u200c president colluded with the Russian government \u2062during his administration, also said that the disqualification theory &#8220;fits Donald Trump\u2064 to a T&#8221; during a recent MSNBC interview.\u200c He\u200c also \u2064cited the incident at the Capitol on Jan. 6, again claiming it was an insurrection led by President Trump.<\/p>\n<p>Some Democrats, \u2064including state officials, have said that the theory likely doesn&#8217;t\u200b hold \u200cwater.<\/p>\n<p>Among them, Arizona Secretary of State Adrian Fontes told \u200ca podcast several\u2062 days ago that the \u2063Arizona Supreme Court ruled that there is &#8220;no statutory process \u200cin <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/waffle-arizona-house-speaker-claims-they-cant-enforce-constitution-wont-commit-to-calling-legislative-hearing\/\" title=\"WAFFLE: Arizona House Speaker Claims They Can\u2019t Enforce Constitution, Won\u2019t Commit To Calling Legislative Hearing\">federal law<\/a> to enforce Section\u2064 3 of the 14th amendment&#8221; and that &#8220;you can&#8217;t just enforce it.&#8221;<\/p>\n<p>&#8220;That\u2019s what the Arizona Supreme Court said, \u200bso that\u2019s the state of \u2063the law\u200b in Arizona. Now, do \u200cI agree with that? No, that\u2019s stupid,&#8221; Mr. Fontes \u2064said, saying that he disagrees with the ruling but would follow the law in\u200d that case.<\/p>\n<p>Other than Mr. Turley&#8217;s comment to Fox News, another constitutional scholar and political science professor told\u2064 <a href=\"https:\/\/abcnews.go.com\/Politics\/14th-amendment-section-3-new-legal-battle-trump\/story?id=102547316\" target=\"_blank\" rel=\"noopener\">ABC \u200cNews<\/a> that the 14th Amendment theory faces an uphill battle.<\/p>\n<p>&#8220;The challenge\u200c here is that the \u206314th \u2063Amendment isn&#8217;t necessarily\u200b self-executing. In \u200bother words, it doesn&#8217;t just automatically happen and there is some question \u2063about \u200bwhat it means to \u2063be engaged in insurrection or rebellion\u200c and how that is defined.
