(Photo by Sarah Silbiger\/Getty Images<\/span><\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/brooke-mallory\">Brooke \u2063Mallory<\/a><br \/>11:48 AM \u2013 Monday, September 4, 2023<\/h2>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-doj-ends-trump-sanctuary-cities-policy\/\" title=\"Biden\u2019s DOJ Ends Trump Sanctuary Cities Policy\">federal appeals court overturned<\/a> a prior judgment on Friday, enabling the Food and Drug \u200dAdministration\u2019s (FDA) lawsuit involving its campaign against the use of ivermectin to treat COVID-19\u2063 to proceed.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>In a\u200d lawsuit \u2064filed against the FDA \u200clast year, three different doctors asserted\u2062 that the agency had overstepped its boundaries in its\u2063 anti-ivermectin campaign, \u201cacting\u200d more like a medical \u2064body than a regulator.\u201d<\/p>\n<p>A district judge had originally \u200cruled that the lawsuit could not proceed, but in a Friday decision, the 5<sup>th<\/sup> Circuit Appeals judge gave the physicians new \u2064hope by remanding the matter to a lower court \u2064for reconsideration.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cFDA is not a physician. It has authority to inform, announce, and apprise \u2014 but not to endorse, \u2064denounce, or advise,\u201d\u2062 said Judge\u2062 Don Willett. \u201cThe Doctors have plausibly alleged that FDA\u2019s Posts \u2064fell on the wrong\u200d side of the line between telling about and telling to.\u201d<\/p>\n<\/blockquote>\n<p>Ivermectin \u200bis \u2064an anti-parasite drug that is frequently prescribed to horses but also occasionally prescribed to people as well. The FDA\u2019s campaign, which \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-appeals-court-revives-fda-lawsuit-regarding-anti-ivermectin-campaign\/\" title=\"Federal Appeals Court breathes new life into FDA lawsuit over Anti-Ivermectin Campaign.\">featured viral posters stating \u201c<\/a>You are not a \u2064horse,\u201d underscored the\u2062 agency\u2019s warnings that it should not\u200d be used to treat \u2062the COVID-19 virus.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAlthough [the] FDA has approved ivermectin for certain \u2064uses \u2064in humans and animals, it has not \u200bauthorized or approved ivermectin for use in preventing or treating COVID-19, nor\u2063 has\u2062 the agency stated that it is safe or effective for that use,\u201d the agency\u2019s recommendations stated.<\/p>\n<\/blockquote>\n<p>While a handful of people were reportedly hospitalized and some\u2062 even died from the\u200d drug, which occurs if one takes ivermectin in addition to certain other medications, many \u2063groups \u2062still welcomed it as a miracle\u200d cure\u200b and claimed to receive beneficial results for their health.<\/p>\n<p>However, In \u20632021, a review of 14 studies \u200bon the use of ivermectin concluded that there was insufficient evidence to justify its usage, adding that \u201cfew [of the studies] are\u200b considered high quality.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>Yet, \u201cIt must be \u2062acknowledged that some of these studies \u2062were possibly \u200cintentionally designed to yield predetermined findings,\u201d researchers maintained.<\/p>\n<\/blockquote>\n<p>Besides\u200d COVID-19,\u200c there have also been \u2064reports from those suffering from autoimmune disorders who claim that ivermectin \u2063helped combat their negative symptoms and that they have been taking the anti-parasite drug for \u200dyears.<\/p>\n<p>The National \u200cInstitutes of Health \u2063and the World Health Organization are two organizations that \u2062have consistently advised against using ivermectin\u200d to treat COVID-19.<\/p>\n<p>The \u200canti-ivermectin FDA campaign, according to the three doctors, damaged their doctoral\u2063 reputations since they had previously \u200bencouraged the use of the drug. One doctor was expelled from a medical\u200c school, and another was even suspended\u200b from working at a \u2064hospital.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis case has broad implications for protecting the \u2063practice of medicine from unlawful \u200cinterference by the FDA,\u201d\u2063 the doctors\u2019 attorney, Jared Kelson, said in a statement. \u201cIt\u2019s about ensuring that federal \u2064agencies act only within their\u200d statutory authority.
