Adam Schiff (D-Calif.)\u200d has called on\u2063 the U.S. Supreme Court\u200b to make the final decision.<\/p>\n<p>Section 3 \u2064of the 14th Amendment, which was enacted after\u2062 the \u2064Civil War, prohibits individuals from\u2062 holding office if they have engaged in &#8220;insurrection or rebellion&#8221; \u200dagainst the\u200b United States or \u2062have provided aid or comfort to its enemies. In\u200c an interview with MSNBC, Schiff emphasized that the 14th Amendment\u2063 case against President Trump is a &#8220;valid argument.&#8221;<\/p>\n<p>&#8220;The law doesn&#8217;t require that you be convicted of insurrection. Ultimately, only time will tell,&#8221; Schiff stated.<\/p>\n<p>Another Democrat, Sen. Tim Kaine (D-Va.), also expressed support for removing President Trump from the 2024 ballot. In an \u2063interview with ABC, Kaine argued \u200bthat the attack on the \u2064Capitol was intended to disrupt the peaceful transfer\u200c of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tim-kaine-says-there-is-a-powerful-argument-that-trump-may-be-disqualified-from-office\/\" title=\"Tim Kaine suggests Trump could be disqualified from office.\">power outlined<\/a> \u2063in the \u2062U.S. Constitution.<\/p>\n<p>&#8220;My sense is it&#8217;s probably going to\u200b get resolved in the courts,&#8221; Kaine said. &#8220;But, you know, I \u200bthink what we\u2063 have \u200bto focus on in our \u200dside is we \u2063just got to win in 2024.&#8221;<\/p>\n<p>Kaine criticized 2024 Republican presidential\u200b contenders who have pledged to vote for Trump\u2064 even if he is \u200dconvicted of\u200d a crime. He believes that their willingness to support Trump despite his attempts to overturn the peaceful \u200ctransfer of power demonstrates a lack \u200cof moral compass.<\/p>\n<p>In\u200b response to the \u2062Democrats&#8217; efforts, former Assistant U.S. Attorney Sol Wisenberg called their \u2063use of the 14th\u2063 Amendment &#8220;hypocritical&#8221; and &#8220;anti-democratic.&#8221; He argued\u200c that\u200b allowing a state secretary of \u200cstate to unilaterally declare someone ineligible for office without \u2064due process or a \u200dtrial is absurd.<\/p>\n<h2>Disqualification Lawsuit Dismissed, Trump Warns of Retaliation<\/h2>\n<p>Recently, a federal judge from Florida dismissed a lawsuit that sought to disqualify President\u2063 Trump from the\u200c 2024 race. \u200bThe lawsuit, filed by Florida tax attorney\u200c Lawrence \u2063Caplan, argued for disqualification under Section 3 of the 14th Amendment.<\/p>\n<p>However, Judge Robin \u200bL.
