Despite the landmark\u200c verdicts, appellate courts\u2062 swiftly intervened, overturning the decisions and allowing fluoridation\u200b to continue, raising \u200ccritical concerns \u2064about unresolved potential risks.<\/p>\n<p>Now, as \u2062a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bidens-swamp-brings-back-sue-and-settle-to-hide-behind-courts-as-it-stomps-out-fossil-fuels\/\" title=\"Biden\u2019s Swamp Brings Back \u2018Sue And Settle\u2019 To Hide Behind Courts As It Stomps Out Fossil Fuels\">current lawsuit brought<\/a> against the U.S. Environmental\u200d Protection Agency\u200c (EPA) by the Fluoride Action Network <a href=\"https:\/\/www.theepochtimes.com\/health\/fluoride-lawsuit-against-epa-alleged-corruption-shocking-under-oath-federal-statements-5262963\">seeks to ban fluoride<\/a> from water\u200d supplies nationwide, the key question \u200dlingers: Will history repeat itself?<\/p>\n<h2>Historic Judicial\u2064 Findings<\/h2>\n<p>The\u200d trials\u200d unfolded, \u2064beginning in\u2062 Pennsylvania in 1978, then Illinois in 1980, and \u200dending in Texas in 1982.<\/p>\n<p>At the forefront of these cases \u200cstood lawyer <a href=\"http:\/\/scua.library.umass.edu\/graham-john-remington-1940\/\">John Remington Graham<\/a>, who has decades of experience\u200c in constitutional, environmental, and criminal law. He was the plaintiffs\u2019 counsel.<\/p>\n<p>A chronicle of these\u200d monumental courtroom\u200d clashes was <a href=\"https:\/\/www.documentcloud.org\/documents\/23864533-graham-morin_fsu-1999_w-graph?responsive=1&#038;title=1\">documented in a 1999 article<\/a> \u2062 published in\u2063 the\u200c Journal of Land Use and Environmental Law, penned by \u200cMr. Graham \u2064and Pierre-Jean Morin, who holds a doctorate in experimental medicine and was the scientific advisor in the Texas litigation. The trials\u2064 are also detailed in the \u200bchapter on forensic medicine in their book &#8220;<a href=\"https:\/\/www.scribd.com\/document\/313476172\/LE-VICE-JURIDIQUE-DE-LA-FLUORATION-DE-L-EAU-POTABLE-Front-Commun-Pour-Une-Eau-Saine\"><span class=\"s1\">Fluoridation: Autopsy of a Scientific Error<\/span><\/a>.&#8221;<\/p>\n<p>The lawsuits aimed to secure judicial recognition of the adverse repercussions stemming from water fluoridation.\u200b Among the alleged effects were concerns such\u200d as cancer \u2064proliferation, genetic harm, intolerant reactions, chronic toxicity, \u2064and perceived\u2062 violations\u200b of constitutional rights.<\/p>\n<p>Despite winning \u200beach case at trial, the \u200dfinal result was inevitable, Mr. Graham told\u200b The Epoch \u200bTimes.<\/p>\n<p>\u201cLooking back on it now, I can\u200b see that \u200bthe reason why we couldn\u2019t go \u200cany further\u200c was because we were\u200b saying something that was politically impossible,\u201d he said. \u201cWe were\u2063 saying and proved that \u2064fluoridation causes cancer.\u201d<\/p>\n<h3><strong>Pennsylvania 1978: Aitkenhead v. \u2063Borough of West View<\/strong><\/h3>\n<p>In 1978, plaintiffs filed a lawsuit seeking to\u200d block the planned fluoridation of \u2062the water\u200c supply in \u2064West View, Pennsylvania, arguing it posed\u2063 a public health\u200b risk.<\/p>\n<p>Dean Burk, who retired in \u200d1974 as the head of the cytochemistry section of the \u200bNational Cancer Institute\u200b and whose career there \u200bspanned \u200d35 years, presented the scientific work.<\/p>\n<p>His study compared cancer rates over 30 years\u2064 in 10\u200b of\u200c the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/water-fluoridations-purported-cancer-connection-trials-yielded-mixed-results\/\" title=\"Mixed results from trials have been found regarding the alleged link between water fluoridation and cancer.\">largest fluoridated cities versus 10<\/a> of the \u2064largest unfluoridated cities.<\/p>\n<p>\u201cArtificial fluoridation appears to\u200d cause or induce \u200babout 20\u201330 excess cancer deaths for every 100,000 persons exposed per\u200c year after\u200d about 15\u201320 years,\u201d according to <a href=\"https:\/\/essigdb.berkeley.edu\/cgi\/eme_people_query?table=eme_people&#038;one=T&#038;name_full=Dean+Burk\">the findings<\/a>.<\/p>\n<p>Extrapolating to \u200b130 million Americans\u200c drinking fluoridated water means that \u2064over 40,000 excess cancer deaths per year can be \u200dattributed to fluoridation, the 1999 \u200dlaw review article noted.<\/p>\n<p>Burk\u2019s findings were later challenged, which muddied the \u2064waters over fluoride\u2019s link\u2063 to cancer. However, during the trial, even a key expert for the\u200c defense was hesitant about water fluoridation.<\/p>\n<p>That witness, \u200cDaniel Taves, declined to \u200drecommend fluoridation based on the presented data, noting he needed more information.<\/p>\n<p>After extensive expert testimony over five months, Judge John \u2063Flaherty <a href=\"https:\/\/www.elr.info\/sites\/default\/files\/litigation\/9.20056.htm\">issued a preliminary injunction<\/a> to \u200chalt fluoridation due to evidence linking it to \u2063increased cancer mortality.<\/p>\n<p>However, his jurisdiction was limited on appeal, denying\u200d further judicial \u200dreview since\u2062 the court deemed\u200d the case \u2063an administrative agency matter to be handled\u200d by \u2062the <a href=\"https:\/\/casetext.com\/case\/aitkenhead-et-al-v-w-view-boro-et-al\/\">Department of Environmental Resources<\/a>.<\/p>\n<p>\u201cWhile the \u2062 <a href=\"https:\/\/woodmed.com\/index.php\/health-information\/fluoride-controversy?start=6\">appellate court acknowledged<\/a> the validity of the judge\u2019s conclusion that fluoride was responsible for causing cancer, it also concluded that the \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bolsonaro-tells-ben-shapiro-why-his-battle-to-save-brazil-from-socialist-clutches-is-americas-fight-too\/\" title=\"Bolsonaro Tells Ben Shapiro Why His Battle To Save Brazil From Socialist Clutches Is America\u2019s Fight, Too\">judge lacked jurisdiction<\/a> to proceed further and that exclusive jurisdiction rested with the administrative agency,\u201d Mr. Graham said.<\/p>\n<h3>Illinois 1980: Illinois \u200cPure Water Committee, Inc. \u200cv. Director\u2063 of \u200cPublic Health<\/h3>\n<p>The case was tried from April to June 1980 before Judge Ronald Niemann.<\/p>\n<p>The \u2063defense brought in a state epidemiologist who argued that the work of the\u2064 plaintiffs\u2019 expert, Burk, linking \u200dfluoridation and \u200ccancer, was invalid.<\/p>\n<p>The epidemiologist claimed adjustments for\u2064 demographic\u2062 factors, which would eliminate the cancer\u2063 association, needed to be\u200d added \u2063but provided no figures to support his projections, according to \u2064the\u200c 1999 article \u200din the Journal of Land\u200d Use and Environmental Law.<\/p>\n<p>After the three-month trial, Judge \u200dNiemann ruled the mandatory fluoridation law exposed the public to\u200b uncertain health risks, was unreasonable, and violated due \u2064process.<\/p>\n<p>\u201cThis record is barren of any \u2063credible and reputable scientific epidemiological \u2064studies and\/or analysis of statistical data which would support the Illinois Legislature\u2019s determination that fluoridation of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/calif-faces-worse-drought-since-1977\/\" title=\"Calif. faces worse drought since 1977\">water supplies<\/a> \u2063is both a safe and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-the-1994-assault-weapons-ban-didnt-work\/\" title=\"Why The 1994 Assault Weapons Ban Didn\u2019t Work\">effective means<\/a> of promoting public \u200chealth,\u201d he\u2064 said\u200b at the time.<\/p>\n<p>Judge Niemann entered\u200c a permanent injunction against fluoridation in\u2064 Illinois \u2062in \u200bFebruary 1982.<\/p>\n<p>However, upon appeal, the Illinois Supreme \u200bCourt reversed his judgment by citing broad interpretations \u2062of police power\u2014the\u2063 state government\u2019s authority to regulate for public\u2063 welfare, including safety and health.<\/p>\n<p>Unlike \u2064the prior case in Pennsylvania, where the appellate court\u200d upheld the findings, here, the \u2063higher court disagreed.<\/p>\n<p>Judge Niemann found enough initial evidence suggesting\u2064 a fluoridation risk, even if uncertain, according to the 1999 article.\u2062 But the Illinois Supreme Court said he\u2063 only showed the question of the safety of fluoridation \u200dwas \u201cdebatable,\u201d not an unreasonable government<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Water fluoridation has long been a contentious issue, with legal battles and scientific discussions clouding its practice.
