Under Texas \u2063House Bill 393, the court\u2063 is now authorized to order \u2063restitution for a \u200dchild whose \u200dparent\u2064 or guardian was a\u200d victim of intoxicated manslaughter. The legislation specifies that the court will determine\u200c a monthly payment \u2063amount for the\u200b child&#8217;s support until they reach 18 years of age or graduate from high school.<\/p>\n<h3>Factors Considered in\u200c Determining Restitution<\/h3>\n<p>When deciding the restitution amount, \u200cthe\u2062 court will take into account various factors, including the child&#8217;s financial \u2064situation and needs. The finances of the surviving parent, \u200bguardian, or the Department of Family and\u2063 Protective Services may also be considered. Additionally, the child&#8217;s standard of living, overall well-being, and \u2062any childcare costs incurred by the surviving parent will influence the\u200c court&#8217;s decision.<\/p>\n<p>Intoxicated manslaughter in Texas carries a\u200b potential penalty of up to two decades\u200d in \u200dprison. The person convicted of this offense must\u200b initiate\u200c child support payments within one \u2064year\u2063 of\u200b their release. Ms. Williams, a Missouri \u200dwoman, has been instrumental in advocating for stricter laws\u200d against impaired driving.<\/p>\n<blockquote>\n<p>&#8220;Bentley\u2019s Law was created out of a \u200btragedy\u2064 that has affected the lives \u200bof two beautiful boys, Bentley and Mason, and the \u2063lives of\u200b our family. These\u200d crashes are totally preventable, and I will \u2062continue\u2064 to fight for \u200cchange for all who \u200dhave suffered \u2062from impaired drivers. Many families like mine suffer such a loss every second of every day, and Bentley\u2019s Law will bring change to hold the offender accountable\u200b for such horrific actions.&#8221;<\/p>\n<\/blockquote>\n<p>Tennessee became the first\u200c state to pass &#8220;Bentley&#8217;s Law&#8221;\u2063 in July 2022, and more than 20 other\u2062 states are considering similar legislation.<\/p>\n<h2>Drunk\u200b Driving in Texas: A Troubling Reality<\/h2>\n<p>Texas\u200b ranks third in the\u200d nation for \u2063drunk \u200cdriving rates, according to a Forbes analysis in late 2022.
