They had intended to empty the apartment next door to evict that tenant.<\/p>\n<p>A leasing agent said, \u201cThere\u200b was a misunderstanding, and maintenance accidentally cleared out Abney\u2019s unit\u201d instead of \u200dthe correct unit\u2062 next\u2063 door.<\/p>\n<blockquote>\n<p>After dumping the items in the dumpster, they were picked over by the \u200dother residents of the complex. Abney was distraught when he found out what had \u200dhappened to his things.<\/p>\n<\/blockquote>\n<p>\u201cThey came to my door and cleaned everything out from my clothes to my\u2064 daughter\u2019s clothes, toothbrush, bathing items, pretty much left me with nothing,\u201d he said.<\/p>\n<p>The management \u200dwas initially very apologetic when they found \u2062out what happened. They told Abney\u200d that it had been a \u200bmistake and asked if \u200bthere was\u2064 anything they could do to help.<\/p>\n<p>But things quickly changed\u200c when they found \u2064out who Abney \u2064was.<\/p>\n<p>It turns out Abney and\u200d his 9-year-old \u200bdaughter\u2063 were living in an apartment that had actually been leased to Abney\u2019s ex-girlfriend, who had \u200bsince moved out of Texas. Abney\u2063 had been subletting the apartment without permission.<\/p>\n<p>Abney had \u2064been paying the rent \u2014 nearly $3,000 \u2064\u2014 every month, but because his name was not on \u2063the lease, the management legally could \u200dnot let him stay unless he filled out his own rental application.<\/p>\n<p>\u201cWe are [bound] by \u200claw. We cannot discuss anything with you or anybody who is not [on] her lease,\u201d the \u2062apartment manager \u200csaid.<\/p>\n<p>Twenty-four hours \u2063after issuing the ultimatum, they issued Abney an eviction notice.<\/p>\n<p>Abney is now working with an attorney to fight the\u2063 <a href=\"https:\/\/www.westernjournal.com\/40-people-given-eviction-notices-government-makes-room-refugees\/\" target=\"_blank\" rel=\"noopener\">eviction<\/a>, arguing that it should not matter that \u200bhis name was\u200d not on the lease,\u200d since he had been paying the rent to \u200dthe apartment manager every month.<\/p>\n<p>\u201cImagine \u2063having to tell your child that her\u2063 favorite toy was gone, that her baby photos were\u2064 forever lost, the back-to-school\u2064 supplies she\u2019d lovingly chosen were\u200d tossed, and that her new school uniforms \u200bwere gone \u2013 it was a parent\u2019s nightmare,\u201d Abney said in his lawsuit,\u200c which seeks\u200d $200,000 to $1 million\u2063 in \u200dcompensation,\u2062 the <a href=\"https:\/\/www.dallasnews.com\/business\/real-estate\/2023\/08\/18\/man-alleges-deep-ellum-landlord-threw-away-his-things-by-mistake-then-kicked-him-out\/\" target=\"_blank\" rel=\"noopener\">Dallas Morning News<\/a> reported.<\/p>\n<p>This situation is really unfortunate, and \u200dno one\u2063 really wins when these things happen. Oftentimes, when it comes to situations like these, there \u2062is a human element that gets lost, as it comes down to the fine print\u200c that not everyone understands.<\/p>\n<p>Abney does not appear to have been a bad tenant. By all accounts, he paid \u200bhis rent and\u200c did nothing to \u2064harm either the management or the other residents\u200c of the \u200ccomplex.<\/p>\n<p>Unfortunately, in this case, the\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-axes-cdc-ban-on-evictions-constitution-persists-despite-pandemic\/\" title=\"Federal Judge Axes CDC Ban On Evictions: Constitution \u2018Persists\u2019 Despite Pandemic\">property managers<\/a> have\u200b their \u200dhands tied by the law.
