Mr. Burrell was \u206316 at the time of \u2063the slaying and was sentenced to life.\u200d He\u2064 always maintained his innocence.<\/p>\n<p>The Associated Press and APM\u2063 Reports in \u20622020 uncovered new evidence\u200d and serious flaws in \u2064that \u2062police investigation, ultimately leading to \u2063the creation of an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorney-myon-burrell-locked-up-for-life-as-teen-in-killing-but-later-freed-denies-new-charges\/\" title=\"Attorney: Myon Burrell, Previously Imprisoned as Teen but Later Exonerated, Denies Fresh Charges.\">independent national legal panel<\/a> to review the case.\u2063 That\u2063 led the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/serial-killer-wants-a-firing-squad-lawyers-say-method-is-less-painful\/\" title=\"Serial Killer Wants A Firing Squad, Lawyers Say Method Is Less Painful\">state pardons board<\/a> to commute Mr. Burrell\u2019s \u200csentence after \u2062he had spent more than half his life in prison. However, his request for a \u2063pardon \u2063was denied so his felony\u2063 conviction for \u2062first-degree murder remained on his record, making it still illegal for him to have a gun.<\/p>\n<p>Mr. \u2063Burrell\u2062 was arrested on Tuesday, and charged Friday with one count of possession of a firearm by an ineligible person because \u200cof\u200d his prior conviction, \u2063and \u200cone count\u200b of \u2064possession of a\u200c controlled substance. The complaint \u2064says officers in \u2064suburban Robbinsdale who \u200bsearched his SUV found a Glock 17 9 mm handgun with an extended magazine in the center console. The presumptive \u2062sentence \u2063on\u200d the \u2062gun charge is\u200c five years under\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/here-we-go-again-dekalb-county-georgia-is-re-scanning-advance-ballots-because-of-memory-card-issue\/\" title=\"Here We Go Again: DeKalb County Georgia is Re-Scanning Advance Ballots Because of \u2018Memory Card Issue\u2019\">state guidelines<\/a>.<\/p>\n<p>Mr. Burrell \u2062appeared before Judge Peter Cahill, who presided over\u2064 the 2021 trial of former Minneapolis Officer Derek \u2063Chauvin for \u2063the death of\u200b George Floyd.<\/p>\n<p>In a courtroom full of Mr. Burrell\u2019s relatives and supporters, Judge Cahill put several conditions on Mr. Burrell&#8217;s \u2063bail, including that he not possess a gun or other weapon, and that he stay away from illegal drugs. He \u200calso set\u200b Mr. Burrell\u2019s next\u200b court date for Oct. 17.<\/p>\n<p>Mr. Applebaum told reporters afterward that Mr. Burrell denies the allegations and would be able to make bail.<\/p>\n<p>He would \u200bnot concede claims that Mr. Burrell \u200bpossessed \u2063or controlled a gun or had drugs in his car, \u201cbut if\u2064 he did I guess it might \u2064not be a real \u200bstretch of the imagination\u201d for Mr. Burrell to believe he needed a gun for protection.<\/p>\n<p>\u201cIf he was culpable, if he was responsible for that \u2063gun, maybe people would understand that, when you are\u200b literally \u2062raised \u200bin a prison, that your\u2064 thought process isn\u2019t \u2064the same as the rest of ours,\u201d Mr. Applebaum\u2064 said.<\/p>\n<p>\u201cHe \u2063wasn\u2019t out there waiving the gun \u200baround, he wasn\u2019t brandishing it, it was in a center console. I think it\u2019s easy for people who live in relative safety and prosperity to judge people who maybe live in dangerous neighborhoods about how you should conduct yourself,\u201d Mr. Applebaum said.<\/p>\n<p>The \u2064Dakota County Attorney&#8217;s Office is prosecuting the case because\u200d the Hennepin County Attorney&#8217;s Office has a conflict of interest. Mr. Burrell was \u2064a paid staffer on County Attorney \u2063Mary\u200d Moriarty&#8217;s 2022 campaign, and \u200dshe had worked for \u200chis release when she \u2063was\u200d a public defender.<\/p>\n<p>According to the complaint, a Robbinsdale police officer on routine patrol stopped Mr. Burrell after \u200dseeing \u2062his SUV cross the center line twice while \u2063going above\u200c the speed limit of 30 mph.
