While the rulings deal with rules that are new in \u2062terms of the technology used, they turn on old speech-related questions\u200d that courts have decided in the past.<\/p>\n<p>One central consideration is \u2063the\u2062 Supreme Court&#8217;s 1997 ruling \u2063in <em>Reno \u2063v. ACLU<\/em>, Techfreedom Internet Policy\u200d Counsel <strong>Corbin Bernhold<\/strong> told the Washington \u200cExaminer.\u200d The decision declared\u200b that sections of the Communications\u200d Decency Act \u200cof 1996 \u2062restricting adult content through age verification were unconstitutional.<\/p>\n<p>The courts have upheld this\u200c decision several times since \u2062the initial ruling. The U.S. Court of Appeals for the 3rd Circuit ruled in 2003 that requiring age verification chills speech and harms those who desire to\u2063 be \u2062anonymous. The court ruled again in favor of not requiring age restrictions in 2008, noting that &#8220;many users who are not willing \u200dto access information non-anonymously will be deterred from accessing\u200b the desired \u2063information.&#8221;<\/p>\n<p>Nevertheless, lawmakers in favor of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/here-are-the-states-that-pornhub-cut-off-because-of-new-age-verification-rules\/\" title=\"Pornhub cut off states due to new age verification rules.\">age verification rules<\/a>\u2062 may not be deterred. Gov. Spencer Cox (R-UT), one of the first governors to\u200b sign age verification legislation for social media, argued that Reno was &#8220;wrongly decided&#8221; and\u200c that &#8220;new facts&#8221; demanded the states to act. Cox said that the internet has changed and cited the rise of platforms such as Facebook and X, the social media website previously called Twitter, \u2063as proof of a need for rules related to age.<\/p>\n<p>The legal process will \u200chave to play \u200dout before the final fate of the Texas and Arkansas laws is determined. However, analysts do not expect \u2063the decisions to deter \u2064state leaders from continuing to push similar legislation. State lawmakers \u2062know that \u200dtheir voters wish to\u2064 see them take action, \u2063 <strong>Jason Kelley<\/strong>, the director of activism at the Electronic Frontier Foundation, told the \u2064Washington Examiner. Residents typically do \u200dnot \u200bpay attention to what happens after the passage of legislation.<\/p>\n<h3>The Injunctions<\/h3>\n<p>U.S. District \u2064Judge <strong>David Alan Ezra<\/strong> \u2064granted a preliminary injunction blocking H.B. \u20621181, Texas&#8217;s newly passed age verification law, a day before it \u200dwould go into effect. Ezra ruled that \u2063the law violated First \u200dAmendment rights and claimed that better tools than an outright ban could be used \u2064to address parental concerns about children&#8217;s rights.<\/p>\n<p>Texas intends to\u2063 challenge the injunction, a representative of the attorney\u200d general&#8217;s office told \u2064the Washington Examiner.<\/p>\n<p>District Judge <strong>Timothy Brooks<\/strong> offered a similar injunction that same day, stating that Arkansas&#8217;s social media age verification law violated First Amendment rights and singled \u2063out certain types of \u2063speech to be regulated.<\/p>\n<p>&#8220;We&#8217;re \u2063pleased the court sided with\u2063 the First\u2063 Amendment and\u200b stopped Arkansas&#8217;\u200b unconstitutional \u2063law from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arkansas-social-media-law-blocked-by-judge-hours-before-going-into-effect\/\" title=\"Judge blocks Arkansas social media law hours before implementation.\">censoring free speech online<\/a> and undermining the privacy of Arkansans,\u2064 their families, and their businesses\u2063 as our\u2063 case proceeds,&#8221; <strong>Chris Marchese<\/strong>, the director of the NetChoice Litigation Center, \u200dsaid. Louisiana \u2062enacted restrictions on adult content in January, requiring users\u200d to verify their identities through a government-operated\u2062 website before accessing adult content.\u200d Several states enacted copycat bills.\u2062 Some of the leading pornographic \u200dwebsites, including Pornhub, responded by cutting off access to their \u2062content within the states.<\/p>\n<p>Congress is considering legislation that could include similar restrictions.\u200b Sens. Brian Schatz (D-HI)\u200b and Tom \u200cCotton (R-AK) introduced the Protecting Kids on Social Media Act in April, \u200ba bill that would set a minimum age of 13 for users \u200cto be allowed to have accounts on social media \u2063apps such as Instagram or\u200c TikTok, while users between the ages of 13 and 17 would require parental approval.
