Those are just two\u2062 of the \u2062seven, possibly eight, criminal and civil trials\u2064 for which President Trump is scheduled during the 12 months \u200cprior to the 2024 presidential election, in which he is the leading Republican candidate.<\/p>\n<p>Stacking the trials virtually on \u2062top of one\u200d another \u200dis unfair to the\u200c defendant, according to Kevin J. He \u2062has consistently led the field of more than \u200da dozen challengers for the \u200bRepublican nomination by some 40 percentage points.<\/p>\n<p>In \u200cthe \u200cend, one\u200b or \u200dmore of the trials will \u2064have to be rescheduled in the interest of justice,\u200b Mr. O\u2019Brien\u200b believes.<\/p>\n<h2>Spiraling Calendar<\/h2>\n<p>President\u2063 Trump\u2019s legal troubles have snowballed since March when\u200c he was indicted in state court in New York on charges of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rep-jordan-subpoenas-former-manhattan-prosecutor-who-pushed-for-trump-indictment\/\" title=\"Rep. Jordan Subpoenas Former Manhattan Prosecutor Who Pushed for Trump Indictment\">falsifying business records related<\/a> to payments made to Stormy Daniels\u200b before the 2016 presidential election. Judge Juan Merchan scheduled \u200cthat trial for March 25.<\/p>\n<p>In\u2062 June, the former \u2062president was\u2063 indicted in federal court in Florida\u2064 on charges \u200crelated\u2063 to classified documents kept at his residence, Mar-a-Lago, Palm Beach. Additional charges were added in July. Judge Aileen Cannon initially\u2064 set that trial to begin on\u200b Aug. 15 but agreed to delay it until May 20 at the request of the defense.<\/p>\n<p>In August, President Trump was indicted\u200d in Washington, on federal charges for\u2063 allegedly conspiring with six \u2064unnamed,\u200b unindicted co-conspirators to\u200d overturn the 2020 election results in events culminating on January 6, 2021.<\/p>\n<p>Special Counsel \u2062Jack Smith, the prosecutor in the Florida and\u200d Washington cases,\u200d asked \u200cJudge Tanya Chutkan to\u200d schedule the Georgia \u200ccase to \u200dbegin Jan. 2.\u2062 Judge Chutkan\u200c set the trial date for \u2062March 4.<\/p>\n<p>Later\u200b in \u200bAugust, President\u2064 Trump and 18 others were indicted in a Georgia state court on charges concerning an alleged conspiracy to overturn that state\u2019s 2020 presidential \u2062election results.<\/p>\n<p>Two co-defendants in the Georgia case,\u200d former campaign lawyers \u200bKenneth Chesebro and \u2062Sidney \u200bPowell, \u2064have asked that their trials begin on Oct. 23, citing \u200dtheir right to a speedy trial. President Trump has\u2062 asked to \u200bsever his case from \u200cthat of his \u2064co-defendants. Judge Scott McAfee has not\u200b ruled on \u200beither request.<\/p>\n<p>In New York, President Trump is named\u2062 in three civil \u200clawsuits with trials scheduled \u2062to begin on Oct. 2, Jan. 25, and Jan. 29.<\/p>\n<h2>Complications for\u200c the Defense<\/h2>\n<p>Though the two federal\u2062 criminal trials will\u2063 begin\u200b 11 weeks apart, other \u200dcourt deadlines overlap, creating a \u2062nearly impossible challenge \u2063to mounting\u200b a defense.<\/p>\n<p>\u201cIt is not \u2062a \u2018March 4\u2019\u2063 trial,\u201d \u200dAttorney William Shipley said,\u200d referring to the Washington trial.<\/p>\n<p>\u201cThis schedule\u2063 has \u200bthe defense \u200battorneys filing motions\u200c in \u200bDecember. They have 4\u200b months to review millions of pages of discovery, do their \u200cown investigation of matters contained\u2063 in that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/analysis-conflicting-dates-in-trump-trials-unfair-must-be-resolved-experts-say\/\" title=\"Experts argue that the unfairness caused by conflicting dates in Trump trials must be resolved.\">discovery\u2014including interviewing witnesses<\/a> (both [government] witnesses and others who were not \u200cpart \u200bof [government] investigation)\u2014and formulating\u2062 their \u2062own defense plan,\u201d \u200bMr.\u200b Shipley, who has represented a number of defendants in cases \u2062related\u2064 to the events \u2063of \u200cJanuary 6,\u2063 <a href=\"https:\/\/twitter.com\/shipwreckedcrew\/status\/1696918444871180625\" target=\"_blank\" rel=\"noopener\">wrote<\/a> on the\u200d social media platform X on Aug. 30.<\/p>\n<p>\u201cThis is at the same time there are pretrial proceedings already scheduled in the Florida case involving the documents.\u201d<\/p>\n<p>The schedules for both trials list \u200bmore than a \u2062dozen deadlines for \u2064filing \u2063motions or other documents. Many of those filings will require a response from the other party, creating the possibility\u2062 of submitting hundreds of pages of legal documents to each court through the fall \u200dand early winter.<\/p>\n<p>Speaking of Judge \u2063Chutkan\u2019s scheduling choice, Mr. Shipley wrote, \u201cWhat she \u200dhas done indirectly\u2064 is derail the \u2063FL case\u2014a tactical move to reduce\u200d the\u2063 influence of decisions by the\u200b judge in that \u2063case that might cause problems \u2064for SCO Smith.\u201d<\/p>\n<p>The\u2064 proposed\u2063 trial schedules simply cannot be met, according to Mr. O\u2019Brien. Court cases \u200btend to lengthen as \u2063attorneys wrangle over pre-trial questions. And life itself is \u200btoo complicated to bank on the clockwork precision required to\u2063 manage even one trial on \u2063schedule, let alone eight.<\/p>\n<p>\u201cI&#8217;ve been \u2062in big cases before.
