Judge \u200dDavid \u2064Ezra, appointed during the Reagan administration, declared HB\u2064 1181 unconstitutional and issued a preliminary injunction, stating that the law goes beyond the \u2062protection of minors.<\/p>\n<p>Judge Ezra further ruled \u200dthat the law is vague and would infringe upon Texans&#8217; First Amendment rights. In his ruling, he expressed concerns about the government&#8217;s ability to access personal and intimate information through the verification process.<\/p>\n<blockquote>\n<p>&#8220;It runs the risk that the state can monitor when an adult views \u200dsexually explicit \u200bmaterials and what kind of\u200d websites they visit,&#8221; Ezra wrote. &#8220;In effect, the law risks forcing \u200bindividuals to divulge specific details of their sexuality to the\u2062 state government \u200dto gain \u200caccess to certain speech.&#8221;<\/p>\n<\/blockquote>\n<p>The judge emphasized\u200b that such\u2063 restrictions have a chilling effect on individuals&#8217; freedom of expression. The\u2063 law would have required \u2064websites with one-third pornographic content to display \u200cpublic health warnings about the psychological dangers of\u2064 pornography and verify users&#8217; ages through identification \u200cor other \u2062methods.<\/p>\n<p>Additionally, adult websites would \u200dhave been obligated to inform users about the potential\u200c biological addiction, harm to brain development, desensitization of brain reward\u200d circuits, conditioned responses, weakened brain function, and other associated risks of pornography.<\/p>\n<p><b><a href=\"https:\/\/onelink.to\/dwapp\" target=\"_blank\" rel=\"noopener noreferrer\" aria-describedby=\"sk-tooltip-9096\" data-saferedirecturl=\"https:\/\/www.google.com\/url?q=https:\/\/onelink.to\/dwapp&#038;source=gmail&#038;ust=1693504018745000&#038;usg=AOvVaw1RMMjCvCBOBYdpkw5O_njE\">CLICK HERE TO GET THE DAILYWIRE+ APP<\/a><\/b><\/p>\n<p>Furthermore, these websites would have been required to\u200d display a mental health hotline number\u200d and inform users about the potential negative effects on self-esteem,\u2064 body \u2062image, eating disorders, and emotional and mental health. \u200dThey would also have to \u200balert users about\u200b the connection between pornography consumption and\u2062 the \u2064demand for prostitution and child exploitation.<\/p>\n<p>Judge Ezra criticized the law for presenting scientific findings\u200d as facts, despite the contested or\u2062 unsupported nature of some of these claims. Violating companies would have faced \u2063a daily fine of $10,000 if it was deemed to \u2063be in the public interest, and fines of up to\u2063 $250,000 per violation if a child accessed sexual material.<\/p>\n<p>The \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-rules-texas-pornography-age-verification-law-unconstitutional\/\" title=\"Texas pornography age verification law deemed unconstitutional by judge.\">judge \u200dreferenced previous court decisions<\/a>, including the striking down of the Child Online Protection \u200dAct and the majority of the Communications \u200dDecency Act, to support his ruling. Several adult video companies,\u2062 including a Romanian company, and \u2062an anonymous adult performer who has videos on Pornhub, are also involved in the lawsuit.<\/p>\n<p>It is\u200d worth noting that Texas is not the only state to have \u2063implemented \u2064age restrictions\u200b on pornographic websites.
