Despite efforts, members of the \u200bLGBT community\u2062 in Florida find\u200b themselves losing debates, \u2064losing ground, \u2062and, more noticeably, losing their tempers.<\/p>\n<p>Evidence of the growing frustration was on full display at\u200b the Aug. 23,\u2062 2023 <a href=\"https:\/\/thefloridachannel.org\/videos\/8-23-23-state-board-of-education-meeting\/\" target=\"_blank\" rel=\"noopener\">meeting<\/a> of the\u2062 Florida State\u200d Board of Education (SBE) in \u2064Naples,\u2063 as members passed \u2063additional measures to further restrict transgender ideology \u200din the state&#8217;s education system. Verbal attacks against Board members and supporters \u2062of the \u200bproposals became increasingly\u2062 more personal.<\/p>\n<p>At one point, the \u200blevel of civility had sunk so low that\u200c SBE Chair Ben Gibson advised the opponents that the Board\u200c was &#8220;trying to be very respectful and civil&#8221; to them\u200b and \u200dasked that they &#8220;maintain respect and civility as well.&#8221;<\/p>\n<p>Board Member Christy Grazie, speaking virtually, addressed the notable\u200b &#8220;angst&#8221; she \u200dobserved. She\u200c tried to explain that &#8220;bathroom spaces are very intimate and\u200d private,&#8221; which is why they have been historically segregated by biological sex.\u2064 She\u200c further suggested that America&#8217;s culture should not be forced to go against this historical trend simply to accommodate a &#8220;new ideology&#8221; that is &#8220;challenging the science \u2064of male and\u2062 female, which doesn&#8217;t \u2062change.&#8221;<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<h2>Books<\/h2>\n<p>At the\u200d Aug.\u2062 23 meeting, a \u200bnew \u200drule\u200b was adopted to establish \u200cthe \u200cposition\u2064 of a &#8220;magistrate,&#8221;\u200d who will weigh complaints\u200c filed by parents who challenge the procedure through which a book was approved.<\/p>\n<p>Rain Johnson, a 10th-grade student \u200cat a private school in Lakeland, held up a \u200dcopy of &#8220;Some Assembly Required: The Not-So-Secret Life of a Transgender Teen,&#8221; informing the \u2062Board she was &#8220;trans&#8221; and \u200c&#8221;gay&#8221; before she &#8220;read a book.&#8221; She then angrily suggested that trying to &#8220;bypass a system already in place to ban books&#8221; was &#8220;simply \u2064stupid and very confusing.&#8221;<\/p>\n<p>The new magistrate would not &#8220;bypass&#8221; but\u200b rather ensure that the &#8220;system already in place&#8221; was upheld.<\/p>\n<p>CJ Smith said, &#8220;The system is already ridiculous enough without\u2063 adding more steps,&#8221; accusing the Board of &#8220;<a href=\"https:\/\/www.webmd.com\/parenting\/what-is-snowplow-parenting\" target=\"_blank\" rel=\"noopener\">snowplow parenting<\/a>&#8221; and suggesting \u200cthey&#8217;re &#8220;making the assumption that children in general cannot handle certain topics.&#8221;<\/p>\n<p>Kaity Danehy-Samitz defined the measure that allows some parents \u200b&#8221;the right to fight against\u200c something they don&#8217;t\u200d believe \u2062in&#8221; as &#8220;fascism \u200bwith extra steps.&#8221;<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Kaity Danehy-Samitz speaks during public comments \u2063at the August 23, 2023 meeting\u2062 of \u200cthe Florida \u200cState Board\u200b of Education in Naples,\u2062 Florida (Screenshot\/The Florida Channel).<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Sarah Parker accused\u2063 the Board of banning the\u200d education of black people, insinuating \u2064that black parents work late hours and are unable to sign permission forms allowing their children to read restricted books.<\/p>\n<h2>Bathrooms<\/h2>\n<p>The measure that inspired the most heated objections was the \u200dproposal to expand\u2062 restrictions \u2064on the use of restrooms to biological sex from just K-12 \u2064schools to include colleges\u2062 and private schools.<\/p>\n<p>Rain Johnson asked why\u2063 the \u2063Board\u2062 was \u200c&#8221;obsessed about kids&#8217; genitals.&#8221;<\/p>\n<p>&#8220;Why do we need to think of children&#8217;s genitals?&#8221; She screamed. &#8220;Please!&#8221;<\/p>\n<p>Ms. Danehy-Samitz \u2064accused Board members of &#8220;voting\u200b in alignment&#8221; with supporters\u2062 of the measure, whom she labeled \u2062as an &#8220;extremist hate\u200b group.&#8221;<\/p>\n<p>&#8220;We&#8217;re not \u2064going to keep taking it,&#8221; she warned, pausing, looking to her \u2062friends before\u200d laughing.<\/p>\n<p>&#8220;I really, really look forward to getting to know every \u2064single \u200cone of you,&#8221; she told the Board.\u2062 &#8220;Have \u2062a \u200dgood day. Jesus is disappointed.&#8221;<\/p>\n<p>Lola Smith, a Collier \u2064County student identifying\u2063 as non-binary, argued that &#8220;students are \u2062not being harmed or \u200dharassed&#8221; by\u200c transgender\u200b or non-binary \u2063students in school\u2064 bathrooms.<\/p>\n<p>The argument was echoed\u200c by others.<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>India Miller speaks during public comments during the August 23, 2023 meeting of the Florida State Department of Education\u200b (Patricia Tolson\/The Epoch Times).<\/figcaption><\/figure>\n<\/p><\/div>\n<p>India Miller, a transgender\u2062 individual said transgender people have been using restrooms \u2062that don&#8217;t align with their\u200c biological sex &#8220;for \u2064decades,&#8221; insisting there have been &#8220;no issues.&#8221;<\/p>\n<p>Sarah Parker said the risks posed\u2064 by transgender individuals in restrooms were a &#8220;non-issue.&#8221;<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Sarah Parker speaks\u200b during\u200b public comments \u2064during the August 23, 2023 meeting of the Florida State Department of Education (Screenshot\/The \u200cFlorida Channel).<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Those \u200cclaims are wrong.<\/p>\n<p><strong>Virginia<\/strong>: A\u2063 biological\u200d male\u200d student who identified as a female abducted and sexually assaulted a female student at a school in May \u200b2021. Rather than taking legal action against \u200cthe offender, the school allowed him to transfer \u2063to another school, where he abducted and \u200dsexually assaulted a second female student in\u200b October 2021.<\/p>\n<p><strong>New Mexico<\/strong>: A \u206312-year-old girl was raped by a transgender student in the &#8220;trans-inclusive&#8221; bathroom\u200d in October 2021.<\/p>\n<p><strong>Oklahoma<\/strong>: A transgender student physically assaulted \u200ctwo female students in the restroom in \u200cOctober 2022.<\/p>\n<p><strong>Oklahoma<\/strong>: Another transgender student severely \u2062beat a 15-year-old female sophomore in the girl&#8217;s bathroom in October 2022.<\/p>\n<p><strong>California<\/strong>: \u200bA transgender student entered a girls&#8217; locker room. After\u200b being confronted, the male student spit on\u200b the girls and exposed his genitalia. Ron DeSantis, state legislators have already\u2064 passed\u2063 a plethora of restricting LGBT ideology.<\/p>\n<p><strong>SB1028<\/strong> was \u2064signed into\u200c law on June 1, 2021, establishing the \u200d&#8221;Fairness in Women&#8217;s Sports Act,&#8221; \u2064which mandates that an individual&#8217;s participation in school\u200c sports at all levels must be based on biological sex\u2063 at birth.<\/p>\n<p><b>CS\/CS\/HB 1557, <\/b>the Parental Rights\u200b in Education measure, branded by \u200dopponents as the \u2064&#8221;Don&#8217;t Say Gay Bill,&#8221; was signed into law on March 28, 2022.\u2063 The measure\u200d forbids &#8220;classroom \u2063instruction on sexual orientation or\u200d gender identity \u200bin kindergarten through grade 3.&#8221;<\/p>\n<p>While a February 2022 study (<a href=\"https:\/\/www.unfporl.org\/uploads\/1\/4\/4\/5\/144559024\/certified.rf.unf-porl-press-release-2-22-22.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) from the\u200c Public \u2062Opinion Research Lab at the University of \u200cNorth Florida found that 49\u2064 percent of\u2062 Floridians opposed the original law prior\u2062 to\u200c its \u200dpassage,\u2064 a\u2062 <a href=\"https:\/\/www.scribd.com\/document\/566049088\/Floridians-for-Economic-Advancement-Dem-Primary-Panel-Release#fullscreen&#038;from_embed\" target=\"_blank\" rel=\"noopener\">survey<\/a> released by Floridians for Economic Advancement after the\u200d bill&#8217;s passage\u200c found \u200cthat 52 percent of Florida&#8217;s Democrat voters opposed teaching children in kindergarten through \u200dthird grade\u2063 about sexual orientation in the classroom.<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Florida Gov. (Douglas R. \u200cClifford\/Tampa Bay Times via AP)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>Nationally,\u2063 a September 2022 New York\u200b Times and Siena Poll showed that 70 percent opposed \u2064lessons on sexual orientation and gender identity being taught\u200d to \u2063elementary school children.<\/p>\n<p>On \u200dMay 17,\u200b Mr. \u2063DeSantis signed four <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/north-dakota-governor-signs-bill-regarding-transgender-student-pronouns-and-bathroom-use\/\" title=\"ND governor approves bill on transgender student pronouns and bathroom access.\">transgender-related bills<\/a> into law.<\/p>\n<p><strong>CS\/HB 1521<\/strong> prohibits anyone from &#8220;willfully entering \u200crestroom or changing\u2063 facility designated for the opposite\u200c sex and refusing to depart when asked to do so,&#8221; and authorizes the attorney general \u2062&#8221;to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/senate-democrats-urge-ftc-to-probe-twitter\/\" title=\"Senate Democrats Urge FTC to Probe Twitter\">bring enforcement actions<\/a>.&#8221;<\/p>\n<p><strong>CS\/SB\u2063 254<\/strong> grants Florida courts &#8220;temporary emergency jurisdiction&#8221; over children under the age \u2064of \u200b18 and allows \u2062&#8221;for purposes of warrants\u2064 to take physical custody of a \u200cchild&#8221; that is being &#8220;subjected to\u2062 sex-reassignment prescriptions or procedures.&#8221; The law also prohibits the expenditure of\u200b state funds for &#8220;sex-reassignment\u200b prescriptions\u2064 or procedures&#8221; and requires the immediate suspension of \u200dthe &#8220;license of\u2064 a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/planned-parenthood-spent-271-million-in-federal-funds-between-2016-and-2018-audit-finds\/\" title=\"Planned Parenthood Spent 1 Million in Federal Funds Between 2016 and 2018, Audit Finds\">health care practitioner<\/a> \u2063who is arrested for committing,\u200b attempting,\u2062 soliciting, or \u2063conspiring to \u2062commit&#8221; violations of \u200dthe law.<\/p>\n<p><strong>SB 1438<\/strong> prohibits someone &#8220;from knowingly admitting a child to an adult\u2064 live performance&#8221; that &#8220;depicts or simulates nudity, sexual\u2063 conduct, or \u200bspecific sexual\u2063 activities.&#8221; Violators of \u200bthe law will \u2062be charged with a \u2063first-degree\u200b misdemeanor, punishable by up to one year in prison and a fine up to $1,000.\u200b Businesses that have \u200da liquor license and knowingly violate the law will have that license suspended. The\u2064 first\u200d violation \u200creceives a $5,000 fine. The second gets\u200c a fine\u2063 for $10,000.<\/p>\n<p>On June 24, a\u2063 District Judge in \u2063Florida issued a temporary \u2064injection \u2063(<a href=\"https:\/\/s3.documentcloud.org\/documents\/23862373\/hamburger-marys-update.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) against the law.<\/p>\n<p><strong>CS\/CS\/HB 1069\u2062 <\/strong>extended the\u200b prohibition on sexual\u2064 orientation or gender\u200b identity instruction from pre-K through the eighth grade and\u200b prohibits school boards from imposing requirements that \u2063force \u200dpersonnel or students to use pronouns that do not correspond with someone&#8217;s biological\u200b sex.<\/p>\n<p>On April 19, the Florida DOE approved a rule (<a href=\"https:\/\/flrules.org\/Faw\/FAWDocuments\/FAWVOLUMEFOLDERS2023\/4952\/4952doc.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) to \u2064prohibit classroom instruction on sexual orientation and\u2064 gender identity in pre-K\u200d through third grade without exception and \u200bin grades four through 12 except under specific circumstances.<\/p>\n<p>These measures \u2063come on top of efforts to ban books in \u2063Florida&#8217;s schools \u200bthat are considered inappropriate for children.<\/p>\n<p>On \u2064Oct. 19, 2022, the Florida DOE\u2062 announced the passage of Rule 6A-7.0713 \u2064(<a href=\"https:\/\/www.documentcloud.org\/documents\/23585029-final-rule-6a-70713\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), \u2062amending HB 1467 (<a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2022\/1467\/BillText\/er\/PDF\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), which expanded the scope of school library media centers to say\u2063 books in classroom libraries must also be approved by a media\u2064 specialist.\u200c The notice sent \u200csome\u200c Florida \u200cteachers scrambling to <a href=\"https:\/\/www.theepochtimes.com\/us\/florida-teachers-shut-down-classroom-libraries-in-fear-of-felony-charges-5006486\" target=\"_blank\" rel=\"noopener\">shut\u2064 down their classroom\u200b libraries<\/a> in fear of being charged with \u200ca third-degree felony.<\/p>\n<p>According to the June\u2064 2023 \u2063LGBTQ+ Business Climate Index survey (<a href=\"https:\/\/outleadership.com\/wp-content\/uploads\/2023\/05\/2023-State-LGBTQ-Business-Climate-Index.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) from Out Leadership released\u200c in June\u2014which ranks states on \u200ba scale from 1-100 according\u2062 to LGBT\u2063 friendliness,\u200d New York ranked \u2064highest with a score of\u200d 93.67. Also in the\u2062 top five were Connecticut (93.27), Massachusetts (92.67), New Jersey (90) \u200cand Colorado (88.67).<\/p>\n<p>Among the five least friendly states, Arkansas ranked first with a score of 32, followed by South Carolina (32.5), Louisiana \u200b(33.5), Tennessee (34.4) and South Dakota (34.97).<\/p>\n<p>Surprisingly, \u2063Florida ranked 33rd among the 50 states with a score of 50.6, only a slight fall from its 2022 score of 53.43<\/p>\n<h2>By the Numbers<\/h2>\n<p>At a May 17\u200c press \u2063conference, \u200cEquity Florida Senior Political Director Joe Saunders said, \u201cDeSantis \u2064has just signed into law the \u200blargest slate of anti-LGBTQ bills in one legislative session \u2064in \u200cthe state\u2019s history. This is an\u2064 all-out attack on\u200c freedom.\u201d<\/p>\n<p>However, polling shows that most Americans support such \u200cmeasures.<\/p>\n<p>A\u2063 Washington Post\/KFF\u2064 survey published\u2063 May \u20645 showed that the majority of Americans support anti-trans policies, including 68 percent who <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-depth-were-not-going-to-keep-taking-it-tempers-flare-as-floridas-lgbt-community-loses-ground\/\" title=\"Florida's LGBT community is growing increasingly frustrated as they face setbacks and discrimination.\">oppose providing puberty-blocking medication<\/a> to kids aged 10-14 and\u200b 58\u200d percent who oppose the same for kids between 15-17.<\/p>\n<p>Nearly\u2064 60 percent said gender\u2062 is determined\u200b by your \u200cbirth \u200dsex, and the vast majority believe trans-women should\u200d not be allowed \u2064to compete against biological females in youth sports (62 percent), high school (66 percent), college \u2063(65 percent),\u2063 and professional sports (65 percent).<\/p>\n<p>While 64 percent \u200dbelieve teaching students in grades 9-12 about\u2063 &#8220;trans identity&#8221; is appropriate, the majority believe \u2062it is inappropriate to teach the subject\u200d to children in kindergarten-third grade\u2064 (77 percent),\u2064 grades 4-5\u2064 (70 percent), and grades 6-8\u200c (62 percent).<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/activists-persecute-mom-for-objecting-to-new-sex-ed-curriculum\/\" title=\"Mom persecuted by activists for opposing new sex ed curriculum.\">gender-neutral sign<\/a> \u2063is posted outside a bathroom \u200dat Oval Park Grill in Durham, N.C., on May 11, 2016. Davis\/Getty Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>An Aug. 29 survey conducted by researchers at Arizona State University, Stanford University \u200din\u2063 California, and the University \u200dof Houston, Texas\u2062 confirmed that society is unwilling to provide more rights to transgender\u2062 people, including the ability to\u2063 &#8220;choose for themselves which bathroom to use.&#8221;<\/p>\n<p>In Arizona, 54 percent opposed \u2063allowing transgender people to choose which bathroom they would use. Only 25 percent\u2062 expressed support. In California, a considerably \u2064more\u200d trans-tolerant state, 45 \u2063percent were opposed, while 35 percent expressed support.
