(Photo by\u200b Joe \u2064Raedle\/Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/daniel-baldwin\">Daniel Baldwin<\/a><\/h2>\n<h3>8:00\u200c AM \u2013 Friday, September 1,\u200c 2023<\/h3>\n<p>As the 45<sup>th<\/sup> President Donald Trump continues to\u2062 dominate the Republican primary, liberal groups have explored invoking a section of the 14<sup>th<\/sup> Amendment to possibly bar Trump\u200c from running for office in certain states.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt\u2019s an absolutely insane theory,\u201d said constitutional attorney Jesse Binnall.<\/p>\n<\/blockquote>\n<p>They claim Section 3 of the 14<sup>th<\/sup> Amendment\u2064 reads: \u201cNo \u2063person shall\u2063 be a \u2062Senator or Representative in Congress, or elector of President and Vice President, or hold any \u2064office, civil or military, under the United States, \u200dor under any state, \u2062who, having previously taken\u200d an oath, as a member of Congress, \u2063or as\u200c an \u2063officer \u200bof the United States, or as a member of \u200cany state legislature,\u200d or as\u200c an executive or judicial officer of any\u200c state, to support the Constitution of the United\u2062 States, shall have engaged in insurrection or rebellion against the same, or given aid\u2062 or \u200ccomfort to the \u200cenemies thereof. \u200bBut Congress may by a vote\u200c of \u200dtwo-thirds of each\u2063 House, \u200cremove\u2064 such disability.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<blockquote class=\"wp-block-quote\">\n<p>\u201cOn January\u200d 6<sup>th<\/sup>, 2021, Donald Trump encouraged people\u2063 to peacefully and patriotically make their\u2064 voices\u2063 heard,\u201d Binnall told \u2062One America News. \u201cThat is not an\u2064 insurrection. That is not giving\u200b aid or comfort\u2063 to the enemy. \u2063You know what is giving aid and comfort to the enemy? Engaging in business with either our enemies \u2063or other corrupt countries such as Ukraine \u2014 what the \u2063Bidens\u200c have done.\u201d<\/p>\n<\/blockquote>\n<p>\u201cSo under this \u200dtheory, Secretary\u2063 of States shouldn\u2019t remove Donald Trump \u2062from the ballot,\u201d Binnall \u2064continued. \u201cThey \u2062should remove Joe Biden from the ballot, but nobody\u2019s saying that.\u201d<\/p>\n<\/blockquote>\n<p>Arizona Secretary of State Adrian Fontes addressed this possible issue in an interview with\u200c local outlets.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cNow, the\u200d Arizona Supreme \u2062Court said that because \u2063there\u2019s no statutory process in federal law to enforce Section 3 of the\u2063 14<sup>th<\/sup> Amendment, you can\u2019t enforce it,\u201d Fontes said on \u201cThe\u2062 Gaggle\u201d podcast by The Arizona \u200cRepublic and azcentral.com.<\/p>\n<\/blockquote>\n<p>Binnall emphasized that even talking about\u2064 this possibility\u200b is a slippery slope for both sides.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt\u2019s absolute insanity to start taking people off the\u2064 ballot unilaterally,\u201d Binnall said. \u201cJust having bureaucrats pull\u200b people off the \u2063ballot, which is what these <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorneys-blast-lefts-newest-plot-to-remove-pres-trump-from-ballot\/\" title=\"Attorneys criticize left's latest scheme to remove Pres. Trump from ballot.\">extreme left-wing people<\/a> want to\u2062 have \u200dhappen.\u201d<\/p>\n<\/blockquote>\n<p>He claimed that\u2062 under \u2064no reading of Section 3 of the 14<sup>th<\/sup> \u2064Amendment would support removing Trump from the ballot in any state. He specifically highlighted \u2062the \u200duse of the word \u201cofficer\u201d in the text to \u200dsupport Trump.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIf you want to be technical\u200b about it, a plain reading\u2062 of \u2063the text of \u200dSection 3 of the 14<sup>th<\/sup> \u200bAmendment, \u200cthe president \u2062is not\u2064 an officer of the United States,\u201d\u200b Binnall explained. \u2063\u201cThe officers of the United States are people who are appointed by the president, not \u2062the president himself. They specifically provided\u2062 four members of Congress, and they therefore\u2063 excluded the \u2063president.\u201d<\/p>\n<\/blockquote>\n<p>Some \u200dleft-wing groups are likely\u2062 to \u2062bring lawsuits regarding this part of the Constitution as election\u200d season nears. It could trigger \u200blegal chaos that goes as high as the U.S. Supreme Court.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThey don\u2019t want the people to choose \u2062the\u200d next president,\u201d Binnall said.\u201d<\/p>\n<p>\u201cWe \u200dmust, at \u200bthe end of this, make sure \u200bthat \u2063this never happens\u200b again,\u201d Binnall \u2064continued. \u201cAnd \u2063the way \u2064that we\u2063 do that is accountability,\u2064 criminal accountability, for the \u200dpeople that \u200care doing \u200bthis to \u200dour \u200dcountry.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed!
