Version: 4.0.47--><h2>Intellectual Poverty: Judge Dismisses Lawsuit Against Trump<\/h2>\n<p>How intellectually impoverished is the argument that the 14th Amendment prevents \u200bDonald Trump from running for president?<\/p>\n<p>So much so, in fact, that a \u2063Barack Obama-appointed judge swiftly dismissed a lawsuit from a group arguing the former president shouldn\u2019t be able to appear on\u200d the \u200bFlorida primary ballot because of \u200dthe events \u200bof Jan. 6,\u2064 2021.<\/p>\n<p>According to the <a href=\"https:\/\/www.palmbeachpost.com\/story\/news\/trump\/2023\/08\/31\/judge-dismisses-14th-amendment-lawsuit-against-trump-on-florida-ballot\/70726059007\/\" target=\"_blank\" rel=\"noopener\">Palm Beach Post<\/a>, Judge Robin Rosenberg didn\u2019t rule on whether the 14th Amendment could apply to <a href=\"https:\/\/www.westernjournal.com\/trump-polling-27-higher-biden-among-independents-according-new-poll\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s 2024 candidacy<\/a>.<\/p>\n<p>\u201cInstead, Rosenberg ruled that the plaintiffs, Boynton Beach attorney Lawrence Caplan and two others, lacked \u2062\u2018standing\u2019\u200d to bring the challenge,\u201d the outlet reported.<\/p>\n<blockquote>\n<p>\u201cPlaintiffs lack standing to challenge Defendant\u2019s qualifications for seeking the Presidency,\u201d the ruling read.<\/p>\n<\/blockquote>\n<p>Instead, she\u200d said, \u201cthe injuries alleged\u201d from the events of <a href=\"https:\/\/www.westernjournal.com\/capitol-incursion-defendant-who-sat-at-pelosis-desk-rejects-federal-plea-deal\/\" target=\"_blank\" rel=\"noopener\">Jan. 6, 2021<\/a>, \u201care not cognizable and not particular to them\u201d and that \u201can individual citizen does not have standing to challenge whether\u200d another individual is qualified\u2063 to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/leonardo-dicaprio-joins-hollywood-elites-to-deliver-lesson-on-looming-climate-armageddon\/\" title=\"Leonardo DiCaprio Joins Hollywood Elites to Deliver Lesson on Looming Climate 'Armageddon'\">hold public office<\/a>.\u201d<\/p>\n<p>In the ruling, the judge also cited prior precedent, in which \u2063plaintiffs weren\u2019t able to keep candidates off the \u2064ballot because of\u200d their association with Jan. 6.<\/p>\n<h3>Challenging\u2063 the 14th Amendment<\/h3>\n<p>Palm Beach-based attorney Lawrence Caplan \u2014 who filed the lawsuit, along with two other individuals \u2014 didn\u2019t\u2062 comment after \u2062the ruling, \u200balthough he had previously said that standing\u200d might be the biggest hurdle his lawsuit would face. \u2063Nevertheless, he had previously claimed\u200b the Constitution prohibited Trump from running again.<\/p>\n<p>\u201cThe 14th Amendment is \u2062very clear that you \u2064do not need a conviction. You need to be accused and obviously there has to be a rationale for the accusation,\u201d Caplan said. \u201cI\u2064 read the amendment and I \u200bread the facts of the indictment, and they match\u200b very closely.\u201d<\/p>\n<p>The theory that \u200cthe <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/#:~:text=No%20State%20shall%20make%20or,equal%20protection%20of%20the%20laws.\" target=\"_blank\" rel=\"noopener\">14th\u2063 Amendment<\/a> provides a legal remedy \u200cto keep certain candidates who wished to challenge the results of the 2020 election off the ballot isn\u2019t \u2062a new \u200cone. It\u2019s\u200b also one that hasn\u2019t gotten very\u200b far in court.<\/p>\n<p>The \u2064 <a href=\"https:\/\/constitution.congress.gov\/browse\/amendment-14\/\" target=\"_blank\" rel=\"noopener\">amendment<\/a>, ratified in the wake of the Civil War, states: \u201cNo person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or\u200b military,\u200c under the \u2064United States, or under any State,\u2062 who, having previously taken an oath, \u2064as a member \u200dof Congress, or as an officer of \u2062the United States, or as a member of any \u2064State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort \u2063to the enemies thereof.\u201d<\/p>\n<p>The intent was, quite obviously, to bar previously <a href=\"https:\/\/www.westernjournal.com\/instead-trying-win-election-fair-square-democrats-moving-kick-gop-candidates-ballot-entirely\/\" target=\"_blank\" rel=\"noopener\">elected officials who supported the Confederacy<\/a> from running for high office unless Congress, by a two-thirds vote,\u200b reinstated their ability to do so.<\/p>\n<p>However, various liberal activists, who are fond \u200bof referring to the events of Jan. 6 as an \u201cinsurrection,\u201d have tried to use the provision to get various Republicans \u200cdisqualified from\u200d appearing on the ballot. So far, not a single one has been successful.<\/p>\n<p>The most <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/your-false-narrative-will-cost-lives-desantis-fires-back-at-ap-for-partisan-smear-piece-about-promotion-of-covid-19-drug\/\" title=\"\u2018Your False Narrative Will Cost Lives\u2019: DeSantis Fires Back At AP For \u2018Partisan Smear Piece\u2019 About Promotion Of COVID-19 Drug\">vigorous push<\/a> was arguably against \u200dformer GOP Rep. Madison Cawthorn of North Carolina, who spoke at \u2062Trump\u2019s \u201cStop the \u200bSteal\u201d rally prior to the Capitol incursion.<\/p>\n<p>A <a href=\"https:\/\/www.westernjournal.com\/gop-rep-madison-cawthorn-celebrates-huge-victory-judge-strikes-legal-challenge-re-election-bid\/\" target=\"_blank\" rel=\"noopener\">judge ruled in 2022<\/a> that the state\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/huge-win-for-trump-judge-swiftly-dismisses-lawsuit-against-him-rules-plaintiffs-have-no-standing\/\" title=\"Trump wins big: Judge quickly dismisses lawsuit, rules plaintiffs have no standing.\">candidate challenge process didn\u2019<\/a>t apply to the relevant portion of the amendment and a \u200dreview of Cawthorn\u2019s eligibility by \u200dthe State Board \u2062of Elections would not go forward. (Cawthorn, who faced a <a href=\"https:\/\/www.westernjournal.com\/rep-cawthorn-appears-confirm-disturbing-video-another-male\/\" target=\"_blank\" rel=\"noopener\">myriad of\u2062 other character questions<\/a> that had nothing to do with the events of \u200dJan. 6, <a href=\"https:\/\/www.westernjournal.com\/time-dark-maga-madison-cawthorn-announces-new-mission-primary-defeat\/\" target=\"_blank\" rel=\"noopener\">lost his primary<\/a> in a deep-red district.)<\/p>\n<p>A\u2064 similar 14th Amendment disqualification legal push came against GOP Rep. Marjorie Taylor\u2063 Greene of \u200cGeorgia, although a judge also struck that down.\u200c Greene would\u2064 go on to win both the \u2064party primary and general election by wide margins.<\/p>\n<p>However, the granddaddy of all legal pushes \u2014\u200c that against former President Donald Trump \u2014 is of a different nature for several reasons, most notably the scope of the effort and the indictments against him.<\/p>\n<p>In addition to the Florida lawsuit, <a href=\"https:\/\/www.westernjournal.com\/attorney-general-carefully-reviewing-argument-keep-trump-off-ballot\/\" target=\"_blank\" rel=\"noopener\">the office<\/a> of the New Hampshire attorney general announced it was\u2064 \u201ccarefully reviewing\u201d 14th Amendment arguments to keep \u2062Trump off the ballot late last month.<\/p>\n<p>\u201cNot being a lawyer and not wanting to make a decision in \u2063a vacuum, I will be soliciting some legal opinions on what is appropriate or not before I make any decision,\u201d <a href=\"https:\/\/www.westernjournal.com\/states-top-election-official-considers-barring-trump-critical-gop-primary\/\" target=\"_blank\" rel=\"noopener\">said<\/a> New Hampshire Secretary of\u200b State David Scanlan, a \u200dRepublican of the very equivocal\u200b variety, in an interview published Aug. 25.<\/p>\n<p>Earlier in the summer, two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/blm-leaders-slam-adam-schiff-urge-newsom-not-to-appoint-him-as-ca-attorney-general\/\" title=\"BLM Leaders Slam Adam Schiff, Urge Newsom Not To Appoint Him As CA Attorney General\">activist groups<\/a>\u200b also announced they had launched a legal effort to keep Trump off \u2064the ballot in five states: California, Colorado, Georgia, Oregon and Nevada. While only two of those states are likely in play for Trump in 2024 \u2014 Georgia and Nevada \u2014 keeping him \u200don the sidelines there could affect down-ballot races in all five.<\/p>\n<p>And here\u2019s where the erroneous and capricious misapplication of the 14th Amendment could sway more \u200bindulgent judges: Unlike Cawthorn or Greene, Trump faces two indictments related to Jan. 6, one federal\u200d and one in\u2063 the state of Georgia.<\/p>\n<p>As Human \u200cEvents editor and\u200c conservative activist Jack Posobiec predicted in July, these indictments were going to \u200dbe a pretext for liberal\u2062 activists to finally try\u200d and make the 14th Amendment\u2062 argument stick:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">.<a href=\"https:\/\/twitter.com\/JackPosobiec?\">@JackPosobiec<\/a> : \u201cThey are going to go to\u2062 federal judges and they\u2019re\u200b gonna file these cases to knock Trump off the ballot.\u201d <a href=\"https:\/\/t.co\/mFMxdxkq3E\">pic.twitter.com\/mFMxdxkq3E<\/a><\/p>\n<p>\u2014 Human Events (@HumanEvents) <a href=\"https:\/\/twitter.com\/HumanEvents\/status\/1681369649496182784?\">July 18, 2023<\/a><\/p>\n<\/blockquote>\n<p>Will it\u2062 work? If this was any indication, no: The lawsuit in Florida was dismissed for lack of standing just one week <a href=\"https:\/\/www.westernjournal.com\/trump-faces-yet-another-court-battle-render-ineligible-ballot\/\" target=\"_blank\" rel=\"noopener\">after it was\u2064 filed<\/a>. And \u200cwhile prospective litigants can try to judge-shop all they want, the fact remains\u200c that if an Obama-appointed judge took less\u200d than a week to boot this one out of\u2062 court, chances\u2063 that activist groups can claim standing and have it stick are slim.<\/p>\n<p>This \u200csaid, candidates themselves might have\u200c a better chance of succeeding. It\u2019d be difficult to\u200d see any of the GOP front-runners trying\u2063 it, considering that even hinting it was an\u2063 option\u2062 would be instant death.<\/p>\n<p>The Biden White House, on the other hand, doesn\u2019t have\u2064 to worry as much about\u2064 the wrath of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/brutal-marjorie-taylor-greene-destroys-nasty-ga-election-official-gabe-sterling-after-his-latest-attack-on-president-trump-and-herself\/\" title=\"BRUTAL!
