Among \u2062those charged for partaking in this so-called \u201cconspiracy\u201d are David\u200c Shafer, \u200bone of\u2062 Georgia\u2019s 2020 Republican \u200delectors, and Ray Smith, who served as one of Trump\u2019s lawyers at the \u2064time of the contest.<\/p>\n<blockquote>\n<p>Specifically, Willis claimed Shafer and \u2064the other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/exclusive-fani-willis-possesses-evidence-exonerating-georgias-alternate-electors\/\" title=\"Fani Willis holds proof clearing Georgia's alternate electors.\">alternate electors \u201cunlawfully falsely held<\/a> themselves out\u201d \u200bas \u2064Georgia\u2019s \u201cduly \u2063elected and qualified\u201d presidential electors. She further insisted\u200d these electors \u2014 with Smith\u2019s assistance \u2014 intentionally attempted to \u201cmislead\u201d figures \u200dsuch as then-Vice President Mike Pence and Georgia Secretary of\u2064 State Brad \u200dRaffensberger \u201cinto believing that\u2062 they actually were\u200d such \u2063officers.\u201d<\/p>\n<\/blockquote>\n<p>However,\u200d among the documents Willis obtained during her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nolte-jeff-garlin-out-at-the-goldbergs-following-misconduct-allegations\/\" title=\"Nolte: Jeff Garlin Out at 'The Goldbergs' Following Misconduct Allegations\">years-long investigation<\/a>\u2064 of \u2063Republicans was a meeting transcript refuting \u200cher allegations.<\/p>\n<p>A transcript of the Georgia \u2063Republican electors\u2019 Dec. 14, \u20622020, meeting, obtained by The Federalist, explicitly shows the intent behind casting alternate electors was not to \u2064impersonate public officers, \u2062as \u2064Willis alleged,\u200d but to \u200blawfully preserve Trump\u2019s legal challenge to the state\u2019s election results. At the meeting\u2019s \u200doutset, Shafer \u2063specifically noted how he and his fellow Republicans were acting as \u201cRepublican nominees\u200c for Presidential Elector,\u201d not as\u200b \u201cduly elected and qualified\u201d presidential\u200c electors.<\/p>\n<blockquote>\n<p>\u201c[President Trump] has\u2063 filed a contest to the certified returns. That \u200dcontest \u2014 is pending \u200c [and has] not been decided or even heard by any judge with the authority to hear it,\u201d Shafer said. \u201cAnd\u200d so in \u200corder to preserve his rights, it\u2019s important that the\u2063 Republican nominees for Presidential Elector meet here today and cast their \u200dvotes.\u201d<\/p>\n<\/blockquote>\n<p>For context, Shafer and Trump <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed<\/a> a\u200b lawsuit against\u2062 Secretary\u2063 of\u200b State Raffensberger in Fulton County\u200c state court\u2064 on\u200d Dec. 4, \u20632020, alleging tens of thousands of illegal\u200c votes \u200dhad been cast in the state\u2019s presidential election. The suit came after a recount, requested by Trump, deemed Biden the winner of Georgia\u2019s 16 electoral votes by a margin of \u206411,779. The recount prompted Raffensberger to recertify the election on Dec. 7 while Trump\u2019s legal challenge \u200dremained ongoing.<\/p>\n<p>By the time\u200d Dec. \u206414, 2020,\u200d arrived\u200d \u2014 the\u2062 day \u2064on which nominees for\u200b presidential electors are required by federal\u2063 law to meet \u2014 Trump and Shafer\u2019s lawsuit\u200c was \u2062still pending. As\u2064 such, Georgia\u2019s \u200bRepublican nominees, including\u2062 Shafer, cast their electoral votes for Trump\u200c while the state\u2019s Democrat nominees cast theirs for Biden.<\/p>\n<p>During the Dec. 14, 2020, meeting, Shafer further clarified the legal rationale for\u200d filing alternate electors in a conversation with Smith, asking\u200c Trump\u2019s then-lawyer: \u201cAnd so the only\u2062 way for us to have any judge consider the merits of our \u2063complaint, the thousands of people we allege voted unlawfully, is for us to have this \u200cmeeting and permit \u2062the contest to continue?\u201d<\/p>\n<p>\u201cThat\u2019s correct,\u201d Smith replied.<\/p>\n<h2>The\u200b \u2018Fake Electors\u2019 Charges Are \u2063Fake\u200b News<\/h2>\n<p>Contrary to Willis\u2019 indictments,\u200d constitutional law specialists such as Todd Zywicki, a professor at George Mason University\u2019s Antonin\u200b Scalia Law \u2063School, have argued the\u200d casting \u200cof\u2062 alternate electors\u2063 in Georgia was perfectly legitimate and adheres to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/woody-allens-publisher-threatens-to-sue-hbo-over-disturbing-new-documentary\/\" title=\"Woody Allen\u2019s Publisher Threatens To Sue HBO Over Disturbing New Documentary\">existing legal precedent<\/a>. In a July 18 letter requesting a meeting with Willis, Shafer\u2019s legal team enclosed an expert declaration issued by\u2062 Zywicki, in which he \u2062contended the actions undertaken by Trump\u2019s legal\u2063 team and \u200bthe\u2063 Republican electors in Georgia \u201cfollowed the Hawaii \u2063precedent \u200cprecisely\u201d and used \u201cmaterially identical forms and the same\u2064 procedures as \u200dthe contingent 1960 Hawaii Democratic Presidential\u200b Electors.\u201d<\/p>\n<p>\u201cAt \u2064the same time, the contingent Georgia Republican Presidential Electors publicly announced that the votes they cast and related actions they took were expressly contingent on the outcome of the pending \u200belection contest \u200dand were cast\u200d only to protect \u2063and preserve \u200bthe remedies for that \u200dcontest and \u2062the ability of the \u200bState\u200b of Georgia to have \u200da valid electoral ballot for Congress to count on \u2064January 6, 2021 regardless \u2063of the\u2063 ultimate outcome [of] that contest,\u201d Zywicki wrote.<\/p>\n<p>The law professor furthermore noted that \u2064in casting their votes for\u2064 Biden, Georgia\u2019s \u200cDemocrat electors were also \u201cacting contingently \u2026 as their status as Presidential Electors\u2063 was directly contingent on the outcome\u201d of Trump\u2019s contesting of the state\u2019s election results in court. Similar to their Republican counterparts, the Democrat electors\u200b \u201cmade no\u2064 similar announcement that their votes and actions on December 14, 2020 were contingent on the outcome of the election contest.\u201d<\/p>\n<h2>Shafer\u2019s Ongoing Legal Fight<\/h2>\n<p>In light of the charges levied \u200bagainst their client, Shafer\u2019s legal\u200d team filed a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.gand.310324\/gov.uscourts.gand.310324.2669.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">motion<\/a> last week to have\u200b his case moved from Fulton County Superior Court to the\u2063 U.S. District Court \u2063for the Northern District of Georgia.<\/p>\n<p>In the filing,\u2062 Shafer\u2019s \u200dlawyers argued that neither Georgia nor Willis possesses the legal authority to charge Shafer \u200cfor actions he took in\u200c his capacity as a \u200clawful presidential elector and \u2063further\u2063 requested \u2063the federal court \u201cassert its habeas\u2063 or\u2062 equitable jurisdiction to bar the State\u2019s\u200c prosecution.\u201d Shafer\u2019s team further \u2063contended the state\u2019s \u200cprosecution \u201cseeks to criminalize a political dispute that only Congress possesses the\u2064 authority to\u200d resolve.\u201d<\/p>\n<p>\u201cLike\u2062 Members of \u2063Congress, presidential electors are created by the Constitution, elected by the States, but serve a federal role under\u200b federal authority,\u201d the motion reads. \u201cJust as Members of Congress are federal officers\u201d under federal\u2064 law, \u201cso too then,\u200c by the\u200d same analogy, are presidential electors.
