The judge referred to the protest action at an abortion clinic, for which Handy was convicted, as a &#8220;crime of violence.&#8221;<\/p>\n<p>Handy, along \u2062with her four co-defendants, was convicted by a jury on August 29 of conspiring to\u2064 obstruct access to an\u200c abortion clinic in Washington. They have been incarcerated until their sentencing, which could be months away. Truesdale Adult Detention Center \u2062in \u2064Alexandria, Virginia, according to court documents.<\/p>\n<p>Judge Kollar-Kotelly\u200c denied Handy&#8217;s emergency motion on August \u206231, stating that the \u2064jury found each defendant guilty of using force and physical obstruction to prevent access to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pro-life-protester-jailed-in-dc-to-appeal-seeks-to-be-released-pending-sentencing\/\" title=\"Pro-life protester in DC jailed, seeks release pending sentencing, plans to appeal.\">reproductive\u200c health services<\/a> at the \u2063clinic. This led to the conclusion that they had committed a &#8220;crime of violence&#8221; under the \u200blaw.<\/p>\n<p>Handy&#8217;s attorneys argued that the Freedom of Access to Clinic Entrances Act (FACE \u200bAct) is \u200bnot \u200dcategorically a crime of violence, as it can\u2064 be violated\u200d through \u2063nonviolent means. However, the judge determined that the FACE Act includes offenses that involve violence against person\u200d or \u2062property, and \u200csince the \u200djury convicted \u200ceach \u200bdefendant on a \u200dsub-offense exclusively criminalizing \u2062violence, the \u200demergency motion was denied.<\/p>\n<p>Handy&#8217;s attorneys have filed a notice of appeal\u2064 with \u2064the U.S. Court of Appeals for the District\u200d of Columbia Circuit.<\/p>\n<h2>&#8216;Conspiracy Against \u200cRights&#8217;<\/h2>\n<p>In this case, the defendants were convicted of\u200d &#8220;conspiracy against rights&#8221; and\u200c conspiracy under the FACE Act. The FACE Act has faced criticism from federal lawmakers, who argue that it is selectively enforced against \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/americans-remember-the-48th-annual-march-for-life\/\" title=\"Americans remember the 48th annual March for Life\">pro-life activists<\/a>. Critics also question the\u2063 &#8220;conspiracy against rights&#8221; charge,\u2063 as the Supreme Court has determined that there is\u2064 no constitutional right to an abortion.<\/p>\n<p>The defendants were indicted\u200d in \u20632022\u200b for\u2062 conspiring to obstruct access to \u200cthe Washington Surgi-Clinic, which provides abortions.
