Greg Abbott\u200b in late June \u2064and was set to go into effect on Sept. 1.<\/p>\n<p>Under the bill, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-senate-committee-passes-bills-banning-drag-performances-in-front-of-children\/\" title=\"Texas Senate Committee Passes Bills Banning Drag Performances in Front of Children\">sexually oriented performances<\/a> would be \u2062banned\u200b from \u2063taking place on \u200bpublic property in the presence of \u200can\u2062 individual who is younger\u200d than 18 \u2064years old.<\/p>\n<p>The bill defines sexually-oriented performances as a performance in which the\u2064 performer is nude, engages\u200c in\u2063 sexual conduct,\u2064 and the performance &#8220;appeals\u200d to the prurient interest in sex.&#8221;<\/p>\n<div style=\"margin-left:0;margin-right:0;max-width:1200px\">\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>Conservative Texans \u2062protest a drag queen event held at a church in Katy, Texas, on Sept. 24, 2022. (Darlene McCormick Sanchez\/The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>Measure Needed to &#8216;Protect Children&#8217;<\/h2>\n<p>Sexual conduct, as defined\u2063 by the bill, is &#8220;the exhibition or representation, actual or\u200b simulated, of sexual acts, including vaginal\u200d sex, anal sex, and masturbation,&#8221;\u2063 the &#8220;actual or simulated,\u2063 of male or female genitals\u2062 in\u200c a \u200clewd state, including a state\u200c of\u200c sexual stimulation or arousal,&#8221; \u200cand the &#8220;exhibition of a device designed and \u2062marketed as\u2064 useful primarily for the sexual\u2064 stimulation\u200c of male or female genitals.&#8221;<\/p>\n<p>It also includes\u200b actual \u200dcontact or simulated contact between &#8220;one person and\u2062 the buttocks, breast, \u200bor any\u2063 part of the genitals of another person; or the exhibition of \u200csexual gesticulations using accessories or prosthetics that exaggerate male or female sexual characteristics.&#8221;<\/p>\n<p>The bill states\u200d that businesses that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-federal-judge-temporarily-halts-ban-on-sexualized-performances-for-kids\/\" title=\"Texas judge temporarily stops ban on sexualized performances for children.\">host sexually-oriented performances\u2062 risk<\/a> a fine of up to $10,000 per violation if they allow the shows to take place in the presence of an individual younger than 18 years of age.<\/p>\n<p>Republican lawmakers\u200b have\u200b argued that the legislation\u200d is \u200dnecessary\u200d to protect children from being sexualized and uphold\u2064 public \u2062decency. This has prompted dozens of other states, including\u2063 Tennessee, Florida, and \u200cMontana, to roll\u2064 out \u200dsimilar laws.<\/p>\n<p>The law does not \u2063specifically state \u200cthat drag performances are banned. (Brandon Bell\/Getty \u2064Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>Bill &#8216;Threatens Free Expression of Many\u2062 Texans&#8217;<\/h2>\n<p>In their lawsuit (<a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.txsd.1928300\/gov.uscourts.txsd.1928300.1.0.pdf\" target=\"_blank\" rel=\"noopener\">pdf<\/a>), plaintiffs\u2064 argue\u200d that the \u2064measure &#8220;unconstitutionally singles out drag performances as a disfavored form of expression&#8221; and that the state has &#8220;threatened the livelihood and free expression of many\u2064 Texans,\u200d including\u2064 drag \u200cperformers\u200c across&#8221; Texas by enacting this law.<\/p>\n<p>&#8220;The First \u2064and \u2063Fourteenth Amendments prohibit such strident attempts to regulate and ban free expression, and SB 12 should\u2064 be declared unconstitutional \u2064and enjoined,&#8221; they\u200b wrote in \u200btheir lawsuit. The \u200dplaintiffs and the state Attorney \u200cGeneral&#8217;s Office \u2063have until Sept. 6 to present\u2063 their legal and factual theories of the case to the judge \u2063before \u2064a final decision is made.<\/p>\n<p>ACLU Texas Attorney Brian Klosterboer welcomed the judge&#8217;s order, calling it a &#8220;much-needed\u200b reprieve for all Texans, especially our LGBTQIA+ and transgender community, who\u200d have\u200d been\u2063 relentlessly targeted by our \u200bstate legislature.&#8221;<\/p>\n<p>&#8220;This law was obviously unconstitutional from\u2063 the \u2062day\u2064 it was first\u200d proposed, and we are grateful that the court has temporarily blocked it,&#8221; he said\u200d in a statement. &#8220;Senate Bill 12\u200c is vague, overbroad, and censors\u2062 free\u200d expression.
