But now, some consumers are saying enough is enough, and they&#8217;re <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/n-m-widower-sues-alburquerque-over-sanctuary-city-policy\/\" title=\"N.M. widower sues Alburquerque over sanctuary city policy\">taking legal action<\/a> against companies they believe have crossed the line into deception.<\/p>\n<p>Burger King is the latest company to\u2064 find itself in the crosshairs \u2064of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cuomo-to-partially-reopen-indoor-dining-in-nyc-for-valentines-day-if-positivity-rates-hold\/\" title=\"Cuomo To Partially Reopen Indoor Dining In NYC For Valentine\u2019s Day, \u2018If Positivity Rates Hold\u2019\">class-action lawsuit<\/a>. A federal judge in Florida recently refused to dismiss the suit, which \u2062claims that Burger King&#8217;s ads exaggerate the amount of meat \u2064in its Whopper burger and other sandwiches. However, Burger King is not alone \u200bin facing these allegations.<\/p>\n<p>In fact, according to Perkins Coie, a law firm that tracks class-action suits, there were 214\u200c lawsuits filed against food and beverage\u200b companies in 2022, with 101\u2064 filed in just the first \u2063six months of this year. \u2063This represents a significant increase from 2010, when only 45 such lawsuits were filed.<\/p>\n<p>Pooja Nair, \u200ba \u2063partner at the law firm Ervin Cohen and\u200c Jessup, which \u2063represents food and beverage companies, explains that the wave of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-refuses-to-dismiss-burger-king-whopper-size-lawsuit-other-food-companies-also-in-crosshairs\/\" title=\"Judge denies dismissal of Burger King lawsuit - Other food companies also targeted.\">class-action lawsuits\u2062 began hitting \u2064federal \u200dcourts<\/a> \u200ca few years ago. \u200dInitially, there were false advertising claims against\u2064 chip \u2063makers for not filling their bags completely, but most of those\u2064 suits were dismissed.<\/p>\n<p>Since 2019,\u2063 however, hundreds of\u200b lawsuits have been\u200b filed alleging\u2062 that consumers are being \u2063misled by\u2063 &#8220;vanilla-flavored&#8221; products that do not actually contain pure vanilla or vanilla beans. These cases\u2063 are often \u2064filed in New York, California, and \u2063Illinois,\u2063 where federal courts are less \u2062likely to dismiss them outright.<\/p>\n<p>While the Burger King case\u2064 was filed in Miami, where the company\u200b is headquartered,\u2064 the attorney who filed it also has similar cases pending in New \u2064York against Wendy&#8217;s, McDonald&#8217;s, and Taco Bell. However,\u2064 the attorney did not respond to \u200ca\u200c request for comment.<\/p>\n<p>Companies often choose to\u200d settle these cases\u2062 before a lawsuit is filed, rather than going through the time and expense of fighting them in court. For \u200dexample, \u2063earlier this \u200bsummer, A&#038;W and \u2062Keurig \u200dDr Pepper agreed to pay\u200b $15 million to settle claims that they had deceived customers with the label &#8220;Made\u200d with aged vanilla&#8221; on\u200c cans of soda that \u200cactually used synthetic flavoring.<\/p>\n<p>There are several factors contributing to the rise \u2062in \u2064these \u2064lawsuits. One is the power of social media, \u200dwhich can quickly\u200c spread images of disappointing products and \u200binform potential plaintiffs. Additionally, consumers\u2062 are becoming more aware of health \u2063and nutrition, causing\u2062 them to \u2062question product claims.<\/p>\n<p>Ben Michael, an attorney in\u200b Texas, suggests that inflation may\u2063 also be a factor, as restaurants may have reduced portion sizes to cut \u200ccosts without updating their menus accordingly. Burger King denies these claims, stating that the beef patties\u200b in its ads are the same as those \u200dserved in its\u2062 restaurants nationwide.<\/p>\n<p>While some of the plaintiffs&#8217; claims were \u2063dismissed by the judge, \u2062others, including claims of negligent misrepresentation, will proceed.
