Under \u2064this \u2062proposal, any American who sells guns would be \u200cclassified as a firearms dealer, tightening regulations \u2063surrounding gun sales.<\/p>\n<p>Currently, individuals can sell firearms for profit without\u200d being registered\u200b as a firearm dealer. However, \u2063the new rules \u200cwould <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/23-republican-ags-warn-credit-card-companies-to-abandon-plan-to-identify-gun-sales\/\" title=\"23 Republican AGs Warn Credit Card Companies To Abandon Plan To Identify Gun Sales\">categorize gun sales<\/a> as business \u200dactivities, requiring individuals to obtain a license and \u200cundergo background checks.<\/p>\n<blockquote>\n<p>\u201cSpecifically, the proposed\u2062 rule,\u200c if finalized, would clarify that an individual would be presumed to be\u200d \u2018engaged in the business\u2019 of\u200d dealing in firearms\u2014and therefore \u200cbe required to become a\u200d licensed firearms dealer\u2064 and \u200crun background\u200d checks\u2014if they meet certain conditions,\u201d said \u2062an Aug. 31 White House statement.<\/p>\n<\/blockquote>\n<h3>Changes to the Definition of a \u200d&#8221;Firearms Dealer&#8221;<\/h3>\n<p>The proposed rules would apply\u200c to\u200c individuals\u2062 who repeatedly \u200bsell firearms within \u200b30 \u2063days of purchase, sell new firearms in their original packaging, \u200dor sell multiple firearms of \u2063the same make and model. Additionally,\u200c individuals who were \u200bpreviously federally-licensed firearms dealers would fall under this categorization if they sell firearms from their business inventory that were not transferred to\u2064 a personal collection at least a year before the sale.<\/p>\n<p>The Department of Justice&#8217;s \u200dBureau of \u200dAlcohol, Tobacco, Firearms and Explosives \u2064(ATF) Director, \u200cSteven\u2062 Dettelbach, explained \u2064the reasoning behind these proposed\u2063 changes:<\/p>\n<blockquote>\n<p>\u201cAn increasing number of individuals engaged in the business of selling firearms for profit have chosen not to register as federal\u200b firearms licensees, as required by law. Instead, they have sought to make money through the off-book, illicit sale of firearms. These activities undermine the law, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/john-r-lott-jr-bidens-political-biases-on-crime-in-his-sotu-endanger-public-safety\/\" title=\"John R. Lott, Jr.: Biden's Political Biases on Crime in His SOTU Endanger Public Safety\">endanger public safety<\/a>,\u200c create significant burdens\u200b on law enforcement, and\u2062 are unfair to the \u2062many licensed dealers \u2064who make considerable efforts \u200bto follow the law.<\/p>\n<p>\u201cThe Gun Control \u2064Act\u2019s exceptions to the license\u200c requirement exist to allow all law-abiding Americans to exercise their Second Amendment rights\u2014not to facilitate the intentional evasion of the background-check system. This new proposed rule\u2064 would clarify\u2063 the \u2063circumstances in \u200cwhich a person is \u2018engaged in the business\u2019 of\u200d dealing in firearms,\u200b and \u200dthus \u2064required to obtain a license and follow \u200dthe laws Congress has established for firearms dealers.\u201d<\/p>\n<\/blockquote>\n<p>However, critics of the administration&#8217;s \u200cgun control\u200c move, such as Gun \u200bOwners of America, argue that these regulations will further enhance\u2062 the ATF&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/atf-accused-of-making-illegal-gun-registry\/\" title=\"ATF Accused of Making Illegal Gun Registry\">illegal gun registry<\/a> and\u200b make it more difficult\u200b for \u2064private individuals to sell guns. They claim that these rules effectively force individuals to \u200ceither \u200dbecome <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/psaki-biden-considering-executive-action-on-guns\/\" title=\"Psaki: Biden Considering Executive Action On Guns\">licensed gun dealers<\/a> \u2062or\u200b go\u200c through the inconvenience of coordinating trips to find a gun store.<\/p>\n<p>Erich Pratt, the Senior Vice\u2064 President of \u200dGun Owners of America, expressed concerns about the proposal:<\/p>\n<blockquote>\n<p>\u201cFirst, they said five guns, but now, \u200banyone who sells a single\u2063 firearm in a given year and makes even a penny of profit will be subject to dealer requirements, including a \u200cbackground \u200ccheck.\u201d<\/p>\n<\/blockquote>\n<h2>Ending the &#8220;Gun Show&#8221; and &#8220;Internet&#8221; Loopholes<\/h2>\n<p>The Biden administration\u2062 aims to \u200dclose the so-called &#8220;gun show loophole&#8221; and \u2064&#8221;internet loophole&#8221; through these proposed rules. Currently, federal \u200claw does not require unlicensed private firearms sellers to conduct background checks on gun purchasers. The new definitions would\u2064 not apply\u2064 to individuals who are not\u200c selling guns \u2062for profit,\u200b such\u2062 as those selling firearms to family members or engaging in \u2064the buying and selling of collectible firearms as a \u2064hobby.<\/p>\n<p>Attorney\u2063 General\u2063 Merrick B. Garland emphasized the \u2063purpose \u200dof \u200cthe Bipartisan Safer Communities Act \u2064(BSCA), which expanded the definition \u200dof &#8220;engaging in the\u200c business of firearms dealing&#8221;\u200b to cover\u200b those who primarily earn a profit from dealing in firearms:<\/p>\n<blockquote>\n<p>BSCA \u201cwas passed by Congress to reduce gun violence, including by expanding the background checks that keep guns out of the hands of criminals. This proposed rule\u200d implements Congress\u2019s mandate to expand the definition of who must obtain a license and conduct a background check before selling firearms.\u201d<\/p>\n<\/blockquote>\n<p>Second Amendment \u200badvocates worry that these \u200bnew rules\u200c could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-proposes-radical-new-rule-for-americans-selling-firearms\/\" title=\"White House suggests groundbreaking rule for Americans selling firearms.\">effectively\u200b outlaw private firearm transfers<\/a>.
