Legal experts warn that this could lead \u200dto endless litigation.<\/span><\/p>\n<p><span>The proposed <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240ACA7\" target=\"_blank\" rel=\"noopener\">initiative<\/a>, which is set for a final legislative hearing on Friday, aims to create a ballot measure for \u20642024. \u200bIt would ask voters to approve a measure allowing certain \u2064public\u2062 programs\u200b to consider race,\u2063 color, ethnicity, &#8220;marginalized genders,&#8221; sex, or \u200csexual orientation. This comes just four years after Californians \u200crejected \u2064a similar initiative \u2063in 2020, \u200ddespite liberal \u200bgroups investing nearly <a href=\"https:\/\/edsource.org\/2020\/yes-on-prop-16-has-big-fundraising-lead-in-effort-to-restore-affirmative-action-in-california\/642647\" target=\"_blank\" rel=\"noopener\">$20 million<\/a> to sway\u2063 voters \u2064in its favor.<\/span><\/p>\n<p><span>However, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/asian-american-activists-blast-bidens-pandering-anti-racism-order\/\" title=\"Asian-American Activists Blast Biden\u2019s \u2018Pandering\u2019 Anti-Racism Order\">legal experts<\/a> believe that even if\u2064 the proposal survives \u2064the\u200d costly\u200b ballot initiative process, it is unlikely\u200b to hold \u200cup in\u2063 court. The <a href=\"https:\/\/freebeacon.com\/courts\/supreme-court-affirmative-action\/\" target=\"_blank\" rel=\"noopener\">Supreme Court&#8217;s June ruling<\/a> banning race-based admissions \u200bin colleges and\u2062 universities\u200d could also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/sneaking-past-scotus-california-dems-attempt-affirmative-action-workaround\/\" title=\"California Democrats are trying to find a way around the Supreme Court's ruling on affirmative action.\">curtail race-based policymaking<\/a>. This raises \u2063concerns about the proposal&#8217;s compliance with the U.S. and California constitutions&#8217; guarantee\u2062 of equal protection under the law.<\/span><\/p>\n<p><span>&#8220;The state \u2063would essentially be \u200dinviting \u200blitigation,&#8221; said Alison Somin, a\u200c legal fellow for the Pacific Legal Foundation.<\/span><\/p>\n<p><span>The measure,\u200c introduced by Assemblyman Corey Jackson (D.) \u2064and co-authored \u2062by \u200bMia \u200dBonta (D.), the\u200d wife of the \u2062California attorney general, attempts to find\u200c a workaround to the state&#8217;s affirmative\u2063 action\u200c ban, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/congress-investigates-biden-admin-for-canceling-veterans-memorial-event\/\" title=\"Congress Investigates Biden Admin for Canceling Veterans\u2019 Memorial Event\">initially approved<\/a>\u2062 by voters in 1996. The bill&#8217;s analysis states that its purpose \u200dis to &#8220;mitigate\u200d the \u2064impacts&#8221; of the ban \u200cby\u200b allowing certain programs \u200daimed at improving life expectancy, academic results, or\u2064 reducing poverty in specific\u2063 demographics. These programs would need to be &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/purdue-university-backtracks-on-mandatory-white-privilege-class-for-music-students-after-outcry\/\" title=\"Purdue University Backtracks On Mandatory \u2018White Privilege\u2019 Class For Music Students After Outcry\">research-based<\/a>,&#8221;\u2062 &#8220;research-informed,&#8221; or &#8220;culturally specific,&#8221; with\u200c funding determined by the governor.<\/span><\/p>\n<p>Jackson did not \u2063respond to a request for comment.<\/p>\n<p><span>Devon Westhill, president and general counsel for\u200d the\u2062 Center for Equal \u2064Opportunity, views these qualifiers as\u2062 an attempt to meet the Supreme\u2063 Court&#8217;s \u2063requirement for specific justifications in\u2064 making race-based decisions. However, he doubts that the bill would \u2062pass the \u2063necessary scrutiny.<\/span><\/p>\n<p><span>&#8220;California would face an almost insurmountable challenge,&#8221; Westhill said. &#8220;They would need to meet a very\u2063 strict test.&#8221;<\/span><\/p>\n<p><span>The latest legislative analysis of the bill supports this argument. Since the June Supreme\u2064 Court ruling, the measure &#8220;is more likely to \u2064have a difficult time\u2064 withstanding scrutiny if challenged in federal court,&#8221; according to \u2064a \u200dconsultant for the state appropriations \u2062committee <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billAnalysisClient.xhtml?bill_id=202320240ACA7\" target=\"_blank\" rel=\"noopener\">wrote \u200bthis week<\/a>.<\/span><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>California Democrats are seeking to create an exception to the state&#8217;s affirmative action ban, potentially inviting prolonged legal battles.
