But it is also very, \u2064very reasonable in a case \u200dlike this where you\u2019re looking\u200d at the possibility of millions and millions of documents \u200cthat have \u200cto be reviewed to not \u2063want to be railroaded.\u201d<\/p>\n<\/blockquote>\n<p>Steve \u200bSadow, Trump\u2019s attorney\u200c in the case, argued that an\u2062 Oct. 23, 2023 trial date scheduled for \u200dco-defendant Kenneth Chesebro, who has invoked his right to a speedy trial, would be unfair to the 45<sup>th<\/sup> president.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cUndersigned lead counsel will not have sufficient time to prepare President Trump\u2019s case for trial by the October\u200b 23, 2023 scheduled trial date of co-defendant Chesebro, \u2063who has demanded \u200ca speedy trial,\u201d Sadow wrote in a \u200ccourt filing.<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[Fulton County District Attorney Fani Willis] knows that\u2062 Donald Trump wins any fair trial that\u2019s put before any court,\u201d Binnall\u200d said. \u201cAnd so a fair\u2063 trial is her enemy. It is \u2064what she does not want. She wants a railroad job.\u201d <\/p>\n<p>\u201cAnd so that\u2019s why she would love the \u200copportunity to try to \u2063get this case \u200dtried \u2063in \u200bOctober, because, \u2062at that point, there\u2019s no way to review the millions and\u2062 millions of pages\u2062 of documents that are likely to be at issue in this case,\u201d\u200c Binnall\u200b continued.<\/p>\n<\/blockquote>\n<p>Trump <a href=\"https:\/\/www.oann.com\/newsroom\/trump-pleads-not-guilty-to-election-charges-in-georgia\/\">pleaded\u200b not guilty<\/a> \u2062 to the charges \u200cin the\u2064 Georgia case and will now avoid having to appear at a scheduled arraignment hearing \u2062on Sept. 6.<\/p>\n<p>Trump\u2019s latest court filing continues to \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pres-trump-files-to-sever-ga-case-from-co-defendants-seeking-speedy-trial\/\" title=\"Trump seeks speedy trial by filing to sever Georgia case from co-defendants.\">amplify pre-trial legal battles<\/a> that will likely continue to dominate and\u200b highlight the difficulty of trying 19 co-defendants at once.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI think these cases will probably be severed,\u201d Binnall told OAN. \u200d\u201cAnd on top of that, truth be told, I think it\u2019s\u2062 very, very\u2063 likely that these cases are gonna be removed to the federal court.\u201d<\/p>\n<\/blockquote>\n<p>If\u2063 Trump succeeds in\u2064 severing \u2062his case, Binnall explained it will have the desired effect\u200d of slowing\u2063 down proceedings for\u200d the 45<sup>th<\/sup> president.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIf he severed \u2064from the defendants that want the speedy trial, then that\u2019s not going to speed things up,\u201d Binnall said. \u201cI think that is something that is going to make this case proceed at the reasonable pace that \u200byou would expect of a \u200bcase that involves millions and millions\u2063 of documents and extraordinarily important constitutional issues that are going to have to be litigated before trial.\u201d<\/p>\n<\/blockquote>\n<p>Binnall says any reasonable judge would do everything he\/she could \u200bto ensure that both sides have ample \u2064amount of time to prepare before going to trial.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cSomething that the judges\u2064 always ask parties \u2062in a criminal trial before they\u2019re ready to start is, \u2018Is the prosecution ready to proceed \u2064and is the defendant ready to\u2063 proceed,\u2019\u201d \u2063Binnall explained. \u200d\u201cAnd if you\u200d try to railroad someone, then I expect a defense attorney \u2064would stand\u200d up and\u2062 say, \u200c\u2018No, your Honor, \u2064we have \u200ctold the\u200c court that we \u2063need more time. We have not\u200c been\u2064 able to\u2064 review\u2064 documents to find\u2062 out if \u2062there\u2019s evidence that\u2019s \u200dbeen\u2063 presented to the\u2064 court or that presented to us \u200bin discovery that exonerates our client, something that we call Brady evidence. We haven\u2019t been able\u200d to fully be able to synthesize the information that\u2019s given to us to properly put\u2063 together \u200bour case. We\u2019re not \u200bready to proceed.\u2019 And\u200c that\u2019s an\u2064 important Sixth Amendment \u200cissue \u2063to the United States Constitution.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed!
