This \u200copen-records request lawsuit, filed on Wednesday, alleges a violation of the law.<\/p>\n<p>But this \u2062is not the first time the DOJ has been under scrutiny. Just \u200drecently, a federal\u2063 judge ordered the DOJ to stop stalling and hand over communications between the DOJ and David Weiss. These documents, as reported exclusively by The Federalist, reveal the DOJ&#8217;s attempts to hinder congressional\u2064 inquiries into the\u200d handling of the Hunter Biden investigation.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-851835327\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-17e77d51f0318f173f3fab9a7051adb9 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-17e77d51f0318f173f3fab9a7051adb9\"><\/div>\n<p>The Heritage Foundation, along with its director of the Oversight Project, Mike Howell, has taken legal \u2063action \u200cby filing a lawsuit under the Freedom of Information Act (FOIA). They are seeking to compel the Delaware U.S. attorney\u2019s office to disclose its policy on pretrial diversion agreements. \u2063The complaint emphasizes that the DOJ&#8217;s\u200c manual mandates each\u200d U.S. Attorney&#8217;s Office to develop and implement such\u200d a policy.<\/p>\n<p>The Heritage Foundation explains in the court filing\u200b that they submitted the FOIA \u200crequest on\u2063 August 2, 2023, directly to the Delaware U.S.\u200d attorney\u2019s office and \u2064the Department of Justice. The request seeks &#8220;all records pertaining to the policy on the \u200buse of pre-trial diversion required by Justice Manual 9-22.010 for the Office of the United States Attorney for the\u200c District of \u2064Delaware (&#8216;USADE&#8217;).&#8221;\u200c <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>All records pertaining to the policy on the use of pre-trial diversion required by Justice Manual 9-22.010 \u200bfor the Office of the United States\u200d Attorney for the\u2064 District of Delaware (\u201cUSADE\u201d).<\/p>\n<\/blockquote>\n<p>The FOIA request also includes a fee waiver and a\u200b request for\u200d expedited\u200d processing. The Heritage Foundation argues that the \u2062controversy\u2062 surrounding the proposed Hunter Biden pretrial diversion agreement is a matter of significant public interest\u200d and \u200cquestions the \u2063government&#8217;s integrity.\u2063 To support their\u2064 request,\u200c they have included a comprehensive appendix with relevant documents and media coverage.<\/p>\n<div class=\"fdrlst__b89e9-36c9145dd5a99689c50a9d2128c478bf fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-36c9145dd5a99689c50a9d2128c478bf\"><\/div>\n<p>The DOJ acknowledged receipt \u2062of the FOIA request on August\u2062 3 and noted the\u200d request for expedited processing. However, they have failed\u2062 to respond within\u2062 the required 10-day timeframe. This violation of the FOIA mandate has led to the \u2062lawsuit and the\u2062 Heritage Foundation&#8217;s\u2063 request for a preliminary and permanent injunction, demanding the DOJ to produce\u2064 the policy \u2064and any other relevant records\u200c within 20 days of the court\u200d order.<\/p>\n<p>While it is \u200cuncertain how long the court will take to address the complaint and the request \u200bfor a preliminary injunction,\u200b this\u2063 case\u2064 highlights the urgency of expediting\u200c the production of documents.<\/p>\n<p>A little over a\u200d month ago, Hunter Biden\u200d appeared \u2063in federal court to plead guilty to two misdemeanor tax counts. The pretrial diversion agreement for\u200b a\u200d felony gun count \u2062was\u2064 also\u2062 set to be accepted \u2064on \u2063the same day. However, the plea deal fell apart when the \u200cpresiding judge questioned the validity of the agreement and its broad promise of non-prosecution for crimes unrelated to\u200d the gun charge. The court requested additional briefing before adjourning the hearing.<\/p>\n<p>Two weeks later, U.S. Attorney Weiss&#8217;s team informed the court that a plea deal could not be finalized\u200b and requested the dismissal of\u2063 the \u2062tax\u200d charges. This would allow them \u200cto refile in \u2064a more \u200bappropriate venue, following Attorney General\u200c Merrick Garland&#8217;s appointment \u200dof Weiss as special counsel.<\/p>\n<div class=\"fdrlst__b89e9-2c84eee2e30924f7f7b625b75d14d0e1 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-2c84eee2e30924f7f7b625b75d14d0e1\"><\/div>\n<p>As of now, Weiss has not filed any charges against \u2064Hunter Biden, unless\u2062 they have been\u200c filed under\u2062 seal. \u200dThis raises doubts about the impact of \u200cWeiss&#8217;s appointment\u2063 as special counsel. \u200bRegardless, \u2062his involvement in negotiating the\u2063 controversial plea deal, which included \u200bthe pretrial diversion agreement, has \u200deroded trust.
