The lawsuit, which was filed in the \u200bU.S. District Court for the Southern District of Indiana, seeks to allow Richardson to undergo transgender \u2064genital surgery while serving his sentence. The lawsuit provides minimal information about\u200b Richardson, only stating that\u200b he is an &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/a-male-prisoner-who-murdered-a-baby-wants-a-vagina-the-aclu-wants-taxpayers-to-pay-for-it\/\" title=\"Male prisoner convicted of murder seeks gender reassignment surgery, ACLU seeks taxpayer funding.\">adult transgender female\u200b prisoner confined<\/a> \u200bin a \u2064male \u200cinstitution within the Indiana Department of Correction.&#8221;<\/p>\n<p>According to records \u2063from the Indiana Department of Correction, Richardson was convicted of murdering his stepdaughter in 2001. \u2063The\u2064 baby&#8217;s autopsy \u200drevealed that she had been manually strangled to \u2064death while her mother was at work. Richardson admitted to shaking the child in a\u2063 rough manner. In fact, while\u200c incarcerated, Richardson even confessed to corrections officers,\u200d saying, &#8220;Well all I know is\u2064 I killed the little f***ing bitch.&#8221;<\/p>\n<p>Richardson was \u200dsentenced to\u2063 55 \u200cyears behind bars in 2002, with his earliest possible <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/aclu-demands-gender-surgery-for-trans-identifying-male-who-murdered-baby\/\" title=\"ACLU urges gender surgery for trans-identifying male who killed baby.\">release date set<\/a> for 2027. Despite this, the complaint\u2064 argues that Richardson still suffers\u200b from \u2063serious \u2063depression \u200dand anxiety, \u200cand gender surgery is now\u200d deemed a medical necessity.<\/p>\n<p>The ACLU argues that Indiana&#8217;s new law violates the Eighth Amendment, which prohibits excessive \u200dpunishments, and the Fourteenth Amendment&#8217;s Equal Protection clause, as it discriminates\u200b against transgender \u2063individuals. The organization \u200dis demanding a preliminary injunction to block the law so that Richardson can \u2064undergo an orchiectomy \u200cand\u2062 vaginoplasty.<\/p>\n<p>According to\u200d the complaint, Richardson has identified as female since childhood and \u2063has experienced distress due to his genitals. The complaint even states that Richardson has soiled himself rather than use the toilet because of the stress caused by his gender dysphoria.<\/p>\n<p>Indiana Attorney General Todd Rokita&#8217;s office \u200chas \u200dpushed back \u200cagainst the \u2064lawsuit, stating that taxpayers should not be\u200b responsible\u200c for funding gender surgeries for prisoners. The\u2063 office argues \u2062that these \u200csurgeries are not necessary medical treatments but rather \u200ban atrocity.<\/p>\n<p>It \u2062is worth noting \u2064that\u200b this is not the first\u200b time incarcerated transgender individuals have sought cross-sex hormones\u200c and genital surgeries. Last year, a \u2062federal prisoner in Texas \u2062became the first \u2062to\u2063 receive gender surgery while serving time\u200b for\u2062 threatening to use a weapon of mass destruction. Similarly, an Idaho\u2062 state\u2064 prison inmate received \u2063gender surgery after\u200d a lengthy legal battle with the\u2062 state, which initially refused to cover the cost.
