(Photo by\u2062 Chip Somodevilla\/Getty Images)<\/figcaption><\/figure>\n<h2>Overtime Pay \u2064Eligibility\u200c Expanded for Millions of Workers<\/h2>\n<p>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/james-meyers\">James Meyers<\/a><br \/>5:40 PM \u2013 Wednesday, August 30, 2023<\/p>\n<p>The \u2062Biden \u2064administration proposed \u2063a new rule on\u200d Wednesday\u200c that \u2062would make 3.6 million more workers eligible for overtime pay.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The new\u200c rule \u200crevealed by the Department of Labor, would require employers to pay overtime to salaried workers\u200b who make less \u200dthan \u2064$55,000 a year that are in executive, administrative\u2063 and professional roles.  <\/p>\n<p>The new threshold is up from the current one of $35,568, which has been\u200c in place \u2063since 2019 under\u200c the Trump administration, \u2064who raised \u200dit\u200d from $23,660 under the Obama \u2064administration.<\/p>\n<p>The new\u200d rule is subject to a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/millions-more-workers-would-be-entitled-to-overtime-pay-under-a-proposed-biden-admin-rule\/\" title=\"Biden Admin. proposes rule to expand overtime pay for millions more workers.\">public commentary period<\/a> and wouldn\u2019t take effect for several months. \u200bThe new \u2063changes would\u2063 have the largest impact on \u2062retail,\u200c hospitality, food,\u200c manufacturing and other industries where managerial employees\u2064 meet the requirements of \u200cthe threshold. <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cI\u2019ve heard from workers again and again about working \u200clong \u2062hours, for no extra pay, all\u200c while earning low salaries that don\u2019t come anywhere \u2063close\u200d to compensating them for their sacrifices,\u201d acting Secretary of Labor\u2064 Julie Su said \u2064in a statement. <\/p>\n<\/blockquote>\n<p>The new rule could face pushback from businesses who \u2064won a legal challenge against a similar\u2063 regulation Joe Biden announced as Vice President \u2063with the Obama administration, where they advocated to raise\u200b the threshold up to $47,000. <\/p>\n<p>Currently under \u2062the \u200b <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\" data-type=\"link\" data-id=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\">Fair Labor Standards Act<\/a>,\u200b almost all U.S. hourly workers are entitled to\u2062 overtime pay\u2063 after \u2063working over 40 hours a week, at no less than \u2064time-and-half their regular \u2062rates. <\/p>\n<p>However, salaried\u2062 workers who perform \u200cexecutive, professional or administrative roles are exempt from that requirement unless\u200b they earn below\u200b a certain threshold. <\/p>\n<p>27% of salaried workers would be entitled to overtime pay under the new rule, because they make less than the threshold, according\u200b to the Labor Department. <\/p>\n<p>However, business leaders argue the new \u2064salary requirement would force small businesses to convert salaried workers to hourly ones to track working time. <\/p>\n<p>The National Association of Manufacturers \u200cwarned last year that this\u2064 would challenge any expansion \u2064of overtime coverage, saying the new changes would \u2063disrupt\u200d supply \u200bchain\u2064 and labor supply issues. <\/p>\n<p>Additionally, \u200b300,000 more \u200bmanufacturing \u2062workers\u2064 would \u2063be entitled to overtime pay. Along \u2062with another 180,000\u2063 hospitality \u200dand\u200b leisure workers, and 600,000\u200b in the health\u2064 care and social services sector, according to the \u200bLabor\u200d Department. <\/p>\n<p>Stay informed!
