Michael Luttig, \u2062a\u2063 former federal \u200cappellate judge with notable conservative views, put forth an argument stating\u200d that the 14th Amendment renders the former \u2064president ineligible for a return to the presidency.<\/p>\n<p>The argument is specifically referring to section 3 of the 14th Amendment,\u2063 and its stipulation that individuals who have &#8220;engaged in insurrection \u2064or rebellion&#8221; against the government are ineligible \u200bfor <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mitch-mcconnells-betrayal-hurts-the-nation-goodwin\/\" title=\"Mitch McConnell\u2019s betrayal hurts the nation\">holding public office<\/a>.<\/p>\n<p>&#8220;This protection, embodied in the amendment\u2019s\u200b often-overlooked Section 3, automatically excludes from future \u2064office and position of power \u2064in \u2063the United States government\u2014and \u2064also from\u2064 any\u2062 equivalent office\u200b and position of power in the sovereign states and their subdivisions\u2014any person who has \u2063taken an oath to support\u2062 and defend our Constitution \u200dand thereafter rebels against that sacred charter, \u2062either through overt insurrection or by giving aid or comfort to the Constitution\u2019s\u2063 enemies,&#8221; they wrote.<\/p>\n<p>They contend that the attempted overturning of the 2020\u200b presidential election, coupled with the events at the U.S. Capitol, unequivocally place\u200c President Trump within\u200d the\u200c ambit of Section 3&#8217;s disqualification clause.<\/p>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Newly elected Arizona\u200b Secretary of State Adrian Fontes gives a speech at American Legion Post 41 in Phoenix, \u200cAriz.,\u2064 on Nov. 14, 2022. (Jon \u200dCherry\/Getty Images)<\/figcaption><\/figure>\n<p>However, Mr.\u200d Fontes\u200d pointed out that the Arizona Supreme Court had previously determined that enforcing this disqualification is not feasible due to the \u200cabsence of a \u2064specific statutory mechanism within federal law to\u200b do so.<\/p>\n<p>\u201cThe Arizona Supreme Court said that because there&#8217;s no statutory process\u200c in federal law to enforce Section 3 \u200dof the\u200b 14th amendment, you \u200dcan&#8217;t\u200c enforce it,&#8221; Mr. Fontes said. \u200d&#8221;That&#8217;s what\u200d the Arizona \u2062Supreme Court said. That&#8217;s the state of the law in Arizona.\u200c Now, do I\u200b agree \u200cwith that? No. That&#8217;s stupid.\u201d<\/p>\n<p>Mr. Fontes\u2062 offered\u200b a hypothetical \u200bscenario to illustrate his position. He \u2063questioned whether, in the absence of a statutory scheme \u2064to \u200cenforce criteria such as natural-born citizenship\u200d or\u200b age restrictions, \u2062individuals from foreign countries or even 25-year-olds could run for president in Arizona.<\/p>\n<p>&#8220;According to \u200dthe logic \u200dof\u2062 the Arizona Supreme Court, they do,&#8221; he added, arguing that the court&#8217;s conclusion, which is \u2063based on the absence of \u2062enforcement\u200b mechanisms, is flawed and lacks a comprehensive\u2062 resolution.<\/p>\n<p>Mr. \u2062Fontes explained that the court&#8217;s \u200cinterpretation of the law has limited \u200cthe avenues available \u2064for him to act upon the demands to \u2063exclude President Trump from the ballot.<\/p>\n<p>Despite his personal disagreement with the court&#8217;s decision, Mr. \u200bFontes stressed his commitment to upholding the \u2063law \u200cand ensuring fair \u2063elections in Arizona.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Arizona Secretary of State Adrian Fontes stated that he disagrees with liberal and conservative legal scholars who claim that former President Donald Trump should be prohibited from running for president in the state.
