Section 3 of the amendment, enacted in the wake of the <a href=\"https:\/\/www.theepochtimes.com\/us\/pulling-out-every-stop-activists-looking-to-disqualify-trump-under-14th-amendment-5382397\" target=\"_blank\" rel=\"noopener\">Civil<\/a> War,\u2064 bars a \u200dcitizen from holding office if they have engaged in \u201cinsurrection or \u200crebellion\u201d \u200bagainst the United States \u201cor \u200bgiven aid or comfort \u2063to\u2064 the enemies thereof.\u201d<\/p>\n<p>Mr. Messner, who won the 2020 Republican Senate nomination in part due\u2064 to President Trump\u2019s \u200dsupport, is considering a <a href=\"https:\/\/www.theepochtimes.com\/article\/republican-who-was-endorsed-by-trump-seeks-to-have-him-disqualified-from-2024-election-5480805\" target=\"_blank\" rel=\"noopener\">legal<\/a> path \u200dto prevent the former president from becoming the 2024 Republican\u200c nominee. Chris Sununu, a vocal critic of President Trump, has clarified that he will not be involved in the issue.<\/p>\n<p>\u201cThe \u200cGovernor first heard about this effort over the weekend. The Governor is not making any attempt or assisting any \u2063effort to keep anyone off the ballot,\u201d Mr. \u2063Sununu\u2019s spokesman told Fox News in \u200ca statement.<\/p>\n<p>\u201cHe has not spoken to and\u2062 has nothing to do with Mr. Messner\u2019s actions &#8230; Providing he (Trump) follows the same\u2063 rules as \u200ball other candidates, the Governor doesn\u2019t <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attempt-to-block-trump-from-new-hampshire-ballot-receives-no-gop-support\/\" title=\"GOP does not support blocking Trump from New Hampshire ballot.\">expect ballot access<\/a> will be a problem for the former president.&#8221;<\/p>\n<p>Mr. Messner has \u200dmet with New Hampshire\u2019s Republican Secretary of State Dave\u2063 Scanlan who is responsible for overseeing elections in the state.<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Bryant &#8220;Corky&#8221; \u200dMessner, Republican candidate for\u2064 U.S. Senate,\u200d in an undated photograph. Formella and Mr. Scanlan said that neither of their offices have \u201ctaken any position regarding the potential applicability of Section Three of the Fourteenth Amendment to the \u200bUnited States \u200dConstitution\u2062 to \u2062the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elites-disdain-for-trump-is-thinly-veiled-hatred-for-you\/\" title=\"Elites\u2019 Disdain For Trump Is Thinly Veiled Hatred For You\">upcoming presidential election cycle<\/a>.\u201d<\/p>\n<p>Mr. Scanlan\u2019s office requested Mr. Formella\u2019s\u200d office to advise them \u201cregarding\u2062 the meaning\u201d of Section\u2064 3 and the \u2062provision\u2019s \u201cpotential applicability\u201d for the 2024\u200d elections. \u201cThe Attorney General\u2019s Office is now carefully reviewing the \u2063legal issues involved.\u201d<\/p>\n<p>Chris Ager, the \u200dstate GOP\u2063 chairman, called \u200bMr. Messner a \u201cfriend\u201d whose opinions and judgment he respects. \u201cBut I totally disagree with him on\u200d this issue,\u201d he said, according to Fox News.<\/p>\n<p>\u201cI have\u200d communicated with Secy. \u2063Scanlan and I\u2019m confident that all the current people \u2062listed as presidential candidates\u2014I\u2019m very confident that all of them, should they apply\u2014would be on our ballot.\u201d<\/p>\n<h2>Legal Debate Over Trump\u2019s Qualification<\/h2>\n<p>Some legal scholars claim that the 14th Amendment could be used to block President Trump\u2019s reelection\u2064 bid for 2024.<\/p>\n<p>In a\u2064 recent <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4532751&#038;et_rid=961271383&#038;s_campaign=NH:newsletter\" target=\"_blank\" rel=\"noopener\">paper<\/a> at the University of Pennsylvania Law Review, a group of conservative scholars \u2063argued that Section 3 \u200bof the 14th Amendment \u201cdisqualifies \u2063former President Donald Trump, and potentially many others, because of their participation in the attempted \u2063overthrow of the 2020 presidential election.\u201d<\/p>\n<p>The scholars insisted that Section 3\u200d is \u201cself-executing\u201d and operates as an immediate disqualification from office without requiring any additional action from \u200cCongress.<\/p>\n<p>Section 3 also \u201csupersedes\u201d many other constitutional rules\u200d in case of conflict with them,\u200b including the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-kraken-released-attorney-sidney-powell-files-104-page-bombshell-complaint-of-massive-fraud-in-georgia-election-update-michigan-too\/\" title=\"BREAKING: KRAKEN RELEASED! Attorney Sidney Powell Files 104 Page BOMBSHELL COMPLAINT of Massive Fraud in Georgia Election - Update: Michigan too\">due process clause<\/a> and also the free speech provisions of the First Amendment,\u200d they said, while adding that the section remains an \u201cenforceable\u201d part of the Constitution not limited by the Civil War.<\/p>\n<p>However, some have \u200dpointed out that using the 14th Amendment to block President Trump\u2019s\u2064 reelection bid may not be possible.<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Attorney and law professor Alan Dershowitz \u2063in Washington on Jan. 29, 2020. \u2064(Mario Tama\/Getty Images)<\/figcaption><\/figure>\n<\/p><\/div>\n<p>In an Aug. 14 <a href=\"https:\/\/dersh.substack.com\/p\/no-the-14th-amendment-cant-disqualify\" target=\"_blank\" rel=\"noopener\">newsletter<\/a>, legal \u200cexpert Alan Dershowitz said that \u2063a \u201cfair reading\u201d \u2064of the history of the 14th Amendment would \u200bmake it clear\u200d that the \u2063law \u201cwas intended to apply to those who served the Confederacy during the Civil War.\u201d<\/p>\n<p>\u201cIt wasn\u2019t intended as a general provision empowering one party\u200c to disqualify the leading candidate of the other party in\u200d any future elections.\u201d<\/p>\n<p>\u201cIf the disqualification had been intended as a general\u200c rule applicable to all future elections, it would have been essential to designate the appropriate decision maker, the\u2063 procedures, and the criteria for making so important a decision.\u201d<\/p>\n<p>However, the law provides no such mechanism for determining whether a candidate is disqualified, he\u2062 said. Mr. Dershiowitz warned that\u200d if President Trump were to\u2064 be disqualified from\u2063 running for the 2024 election \u200bby any individual or institution linked to Democrats and the matter is not resolved by the Supreme Court, \u201cthere would be a \u200cconstitutional crisis.\u201d<\/p>\n<p>\u201cThe Constitution articulated limited qualifications for presidential eligibility. \u200dBeyond those neutral criteria, the decision \u200dshould be made by voters, who are free to consider the participation of a candidate in activities with which they disagree,\u201d he\u2062 stated.<\/p>\n<p>In an <a href=\"https:\/\/www.theepochtimes.com\/us\/pulling-out-every-stop-activists-looking-to-disqualify-trump-under-14th-amendment-5382397\" target=\"_blank\" rel=\"noopener\">interview<\/a> with CBS back in 2021, Senate Majority Whip Dick \u2063Durbin (D), who had vo<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Republican Bryant &#8220;Corky&#8221; Messner&#8217;s bid to bar ex-President Donald Trump from New Hampshire&#8217;s 2024 primary faces resistance from the state&#8217;s GOP leaders.
