Asa Hutchinson alluded to in last \u2062week\u2019s Republican presidential <a href=\"https:\/\/www.westernjournal.com\/post-debate-poll-shows-rival-within-margin-error-trump-head-head-matchup-key-race\/\" target=\"_blank\" rel=\"noopener\">primary debate<\/a>, that Trump \u200dis barred\u2063 by the 14th Amendment from ever \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/left-launches-effort-to-win-midterms-by-disqualifying-republicans-for-insurrection\/\" title=\"Left Launches Effort to Win Midterms by Disqualifying Republicans for 'Insurrection'\">holding federal office<\/a> again.<\/p>\n<p>Originally \u200cintended to keep former \u2064Confederate officials out of the federal government after the <a href=\"https:\/\/www.westernjournal.com\/doj-resurrects-civil-war-era-charge-conservative-group-faces-rarely-used-accusation\/\" target=\"_blank\" rel=\"noopener\">Civil War<\/a>, Section 3 of the <a href=\"https:\/\/www.law.cornell.edu\/constitution\/amendmentxiv\" target=\"_blank\" rel=\"noopener\">14th Amendment<\/a> disqualifies\u2064 from public office any individual who \u201cengaged in \u2062insurrection or rebellion against\u201d\u2062 the Constitution. The Amendment was \u200dratified\u2063 in 1868.<\/p>\n<p>Conservative legal scholars William Baude and Michael Stokes Paulsen argued in \u200da <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4532751\" target=\"_blank\" rel=\"noopener\">paper<\/a> scheduled for publication \u2062in the University of Pennsylvania Law Review \u200bthat <a href=\"https:\/\/www.westernjournal.com\/post-debate-poll-shows-rival-within-margin-error-trump-head-head-matchup-key-race\/\" target=\"_blank\" rel=\"noopener\">Trump<\/a> should, in fact, be disqualified from holding \u2062the presidency \u200dagain.<\/p>\n<p>In addition to the Arizona inquiry, the Attorney General\u2019s Office of New Hampshire is \u201ccarefully reviewing\u201d the question of whether the 14th Amendment to the U.S. Constitution could keep former President Donald\u2063 Trump\u200b off the state\u2019s ballots next year.<\/p>\n<p>According to a \u200cjoint statement from New\u200c Hampshire\u2019s Attorney\u200b General John Formella and Secretary of State David Scanlan, no decision has been made regarding the question\u2062 of Trump\u2019s alleged involvement in the Jan. 6, 2021, <a href=\"https:\/\/www.westernjournal.com\/ap-fbi-informant-entered-capitol-testifies-jan-6-defendants\/\" target=\"_blank\" rel=\"noopener\">U.S. Capitol \u200cincursion<\/a>, and\u200b neither office is arguing that Trump\u2019s actions on that day\u2063 should or should not preclude him from being elected president \u2063again.<\/p>\n<p>The <a href=\"https:\/\/www.doj.nh.gov\/news\/2023\/20230829-14th-amendment-election.htm\" target=\"_blank\" rel=\"noopener\">joint statement<\/a> said that the state AG\u2019s office was \u200b\u201creviewing the legal issues involved\u201d at the\u200b request of the secretary of state\u2019s office.<\/p>\n<p>Unlike Fontes,\u200c both Formella and Scanlan are Republicans.<\/p>\n<p>News of the\u2063 article \u2063by Baude and Paulsen apparently prompted talk show host <a href=\"https:\/\/www.westernjournal.com\/pastor-follows-charlie-kirk-experiences-cancel-culture-local-govt-cuts-ties-church\/\" target=\"_blank\" rel=\"noopener\">Charlie Kirk<\/a> \u2062to tell listeners that <a href=\"https:\/\/www.westernjournal.com\/new-hampshire-prepared-publicly-embarrass-biden-hand-shocking-statewide-defeat\/\" target=\"_blank\" rel=\"noopener\">New Hampshire<\/a> officials\u2062 were working to keep Trump off the ballot, <a href=\"https:\/\/www.nbcnews.com\/politics\/2024-election\/trump-supporters-flood-nh-election-office-calls-false-claims-ballot-ac-rcna102252\" target=\"_blank\" rel=\"noopener\">NBC News<\/a> reported\u200c separately.<\/p>\n<p>Scanlan denied \u2064that claim, telling NBC that he was\u200d \u201cnot seeking \u2062to \u200cremove any names from the presidential\u2062 primary ballot, and I have not said that I am seeking to remove any names from\u2064 the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorney-general-carefully-reviewing-argument-to-keep-trump-off-the-ballot\/\" title=\"AG reviewing argument to exclude Trump from ballot.\">presidential primary ballot<\/a>.\u201d<\/p>\n<p>He said that\u2063 his request for \u2062\u201cappropriate legal\u200c input\u201d from the AG\u2019s office was so that \u201cwhen the time comes to make a decision on those challenges, to \u2062qualifications, that I can respond appropriately with the\u2063 facts.\u201d<\/p>\n<p>New Hampshire GOP Chairman Chris\u200d Ager appeared on Kirk\u2019s show\u200b Monday,\u200b the\u200b same\u200c day Kirk told listeners to call the\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/2024-battleground-state-ag-could-have-trump-removed-from-ballot-by-december\/\" title=\"2024 AG in Battleground State May Remove Trump from Ballot by December.\">state election administration office<\/a>, and said that the whole matter\u200b was a non-issue.<\/p>\n<p>\u201cI\u2019ve talked to the secretary of state,\u201d Ager told Kirk. \u201cI\u2019ve talked to the attorney \u2064general. I am very confident that all of the 14 current candidates who apply will be on our ballot.\u201d<\/p>\n<p>In a separate <a href=\"https:\/\/nh.gop\/2023\/08\/17\/let-voters-decide\/\" target=\"_blank\" rel=\"noopener\">statement<\/a>, Ager said, \u2062\u201cI have confidence in our secretary\u2062 of state and attorney general to make the right decisions.\u201d<\/p>\n<p>The full text of Section 3 of the 14th Amendment appears here:<\/p>\n<blockquote>\n<p style=\"padding-left: 40px\"><em>Section 3.<\/em><br \/>\n<em>No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or\u200c hold any office,\u200d civil or military, under the \u200bUnited States, \u200dor under any state, \u200bwho, \u200dhaving previously taken an oath,\u200b as a member of Congress,\u200d or as an officer of the \u200bUnited States, or as a member of any state legislature, or \u200das an executive or judicial officer of any state, to \u200csupport the Constitution\u200c of the United \u200dStates, shall have \u200cengaged\u200b in insurrection or rebellion against the \u200csame, or given aid or comfort to the enemies thereof.
