Trump Has That Now\">press secretary<\/a> Karine Jean-Pierre declined to provide a definitive \u200banswer when asked by a reporter whether the Biden administration believes it&#8217;s &#8220;fair&#8221; for men who identify as\u200b women to\u200b compete in female\u200b sports, adding that &#8220;it is complicated.&#8221;<\/p>\n<p>A reporter asked Ms. Jean-Pierre during\u200d an Aug. 29 White House press\u200d briefing whether\u200b President \u200dJoe Biden\u200b cares whether &#8220;girls are allowed \u200bto compete in sports without\u2063 fear of\u2064 injury&#8221; or if he believes \u2063it&#8217;s &#8220;fair for girls to have to compete against biological males.&#8221;<\/p>\n<p>Ms. Jean-Pierre replied by\u2062 saying that the issue is &#8220;complicated&#8221;\u200d and defies a simple yes or no answer.<\/p>\n<blockquote>\n<p>&#8220;It is truly \u2064a \u2063complicated issue with a wide range of views,&#8221; Ms. Jean-Pierre said. &#8220;There is no yes or no\u200c answer to this. It \u2062is complicated.&#8221;<\/p>\n<\/blockquote>\n<p>The press secretary then provided\u200d some context, namely that there&#8217;s\u2064 a proposal\u200b of \u200drulemaking put forward by the Department of Education (DOE) that is currently being considered that\u2064 targets the\u2063 issue of \u200bbiological males playing in female sports.<\/p>\n<blockquote>\n<p>&#8220;There&#8217;s a rule that the \u2062Department of Education has\u200b put forward, and we&#8217;re going to let that\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mcconnell-gets-what-he-asked-for-a-back-seat-to-debt-ceiling-negotiations\/\" title=\"McConnell gets his wish: Less involvement in debt ceiling talks.\">process move forward<\/a>,&#8221; Ms. Jean-Pierre said.<\/p>\n<\/blockquote>\n<p>&#8220;Again, we want to make sure that while \u200bwe \u2062establish \u200dguardrails \u200cwith this\u2064 rule, that we also prevent discrimination as\u200b well against\u200b transgender \u200ckids,&#8221; she said. &#8220;But again, a complicated issue with a wide range of\u2062 views, and \u200dwe respect\u2064 that.&#8221;<\/p>\n<h2>Title IX Modification \u2062Proposal<\/h2>\n<p>Ms. Jean-Pierre&#8217;s\u2064 remarks about the DOE rule refers to a <a href=\"https:\/\/blog.ed.gov\/2023\/05\/a-timing-update-on-title-ix-rulemaking\/#:~:text=The%20Department%20received%20more%20than,the%20final%20rule%20is%20enduring.\" target=\"_blank\" rel=\"noopener\">proposal to amend<\/a> the department&#8217;s regulations that implement Title\u2062 IX of the\u200c Education Amendments of\u2064 1972, which\u2064 seeks to\u2062 expand protections at \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-blocks-biden-admins-attempt-to-rewrite-major-civil-rights-law\/\" title=\"Federal Court Blocks Biden Admin\u2019s Attempt To Rewrite Major Civil Rights Law\">federally-funded schools<\/a> against sex\u2064 discrimination to include &#8220;discrimination \u200bon the \u2064basis of sex stereotypes,\u200b sex \u2063characteristics, \u2064pregnancy or related conditions, sexual orientation, and gender identity.\u201d<\/p>\n<p>In particular, the <a href=\"https:\/\/www.regulations.gov\/document\/ED-2021-OCR-0166-0001\" target=\"_blank\" rel=\"noopener\">regulation seeks<\/a> to\u2063 explicitly prohibit policies or actions that prevent a person from\u200c taking part in \u200can &#8220;education program or activity consistent with\u2063 their \u200cgender identity,&#8221; meaning that it would open the \u2062door to males competing in \u200cfemale \u2063sports.<\/p>\n<p>When announcing the proposed \u200dTitle IX rule modification, Education \u2062Secretary Miguel\u200c Cardona said the changes are in accordance\u200c with President Joe Biden&#8217;s <a href=\"https:\/\/www.whitehouse.gov\/briefing-room\/presidential-actions\/2021\/03\/08\/executive-order-on-guaranteeing-an-educational-environment-free-from-discrimination-on-the-basis-of-sex-including-sexual-orientation-or-gender-identity\/\" target=\"_blank\" rel=\"noopener\">March\u200d 2021 \u2064executive order<\/a>, which promised to guarantee an educational environment\u2063 &#8220;free\u200c from discrimination \u200bbased on\u2063 sex, including \u200csexual orientation \u2064or gender identity.&#8221;<\/p>\n<p>Ms. Jean-Pierre said during the press conference that the proposed rule &#8220;gives \u2062schools\u2062 the\u2064 flexibility to establish their own athletic policies&#8221;\u2064 and\u200d that it seeks to strike a balance between establishing guardrails \u2062to\u200b protect women it also seeks\u2063 &#8220;to prevent discrimination against\u200b transgender kids.&#8221;<\/p>\n<p>&#8220;That\u2063 is something that is incredibly important, that the president wants to make sure that we also do that as well. So, I&#8217;m just not going to get \u2062ahead\u200d of that,&#8221; she added.<\/p>\n<p>The public comment on the proposed Title IX modification lasts until October \u20622023, with the DOE saying in an\u200b <a href=\"https:\/\/blog.ed.gov\/2023\/05\/a-timing-update-on-title-ix-rulemaking\/#:~:text=The%20Department%20received%20more%20than,the%20final%20rule%20is%20enduring.\" target=\"_blank\" rel=\"noopener\">update\u2063 in May<\/a> that \u200cit had\u200c received over 240,000 public comments.<\/p>\n<p>&#8220;Carefully considering and reviewing these comments takes \u2062time, and is essential to ensuring the final rule\u2064 is enduring,&#8221; the DOE said in the update.<\/p>\n<p>Comments both in support and in opposition to the rule have been submitted.<\/p>\n<h2>Freedom of Speech Concerns<\/h2>\n<p>The Alliance Defending Freedom (ADF), an Arizona-based public interest law firm that \u200dsubmitted comments, <a href=\"https:\/\/www.theepochtimes.com\/article\/biden-urged-to-drop-title-ix-reform-that-jeopardizes-freedom-of-speech-religion-4725391\" target=\"_blank\" rel=\"noopener\">said that<\/a> expanding the definition of sex discrimination in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/its-complicated-white-house-waffles-on-whether-men-competing-in-womens-sports-is-fair\/\" title=\"White House unsure if men in women's sports is 'fair'\">education threatens free speech<\/a>.<\/p>\n<p>&#8220;Students who identify as transgender commonly request to be addressed by different names and\u200c pronouns,&#8221; \u200bADF\u2062 said in\u2064 its comment.<\/p>\n<p>&#8220;The use of pronouns inconsistent with a person\u2019s sex communicates a message: that\u200c what makes a person a man or a woman is solely that person\u2019s sense of being a man or \u200ba woman,&#8221; the group continued.<\/p>\n<p>&#8220;Students who take \u2062a contrary\u2063 view of the \u200crelationship between biological sex and personal identity (for religious, philosophical, scientific, or other \u2064reasons) may be reluctant to use those terms because using them contradicts their own <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-hhs-pick-xavier-becerra-rejected-request-to-bring-humanitarian-aid-on-1996-cuba-trip-to-meet-castro-report\/\" title=\"Biden HHS Pick Xavier Becerra Rejected Request To Bring Humanitarian Aid On 1996 Cuba Trip To Meet Castro: Report\">deeply held views<\/a>,&#8221; ADF\u2063 said.<\/p>\n<p>The\u200b group argued that the DOE&#8217;s proposed revisions would both \u200brestrict\u200b what people \u2064can \u2063say (such as addressing someone by pronouns consistent with their biological sex) and force them to speak certain utterances (such as referring \u200dto someone by the pronouns of their choice).<\/p>\n<h2>Fight Over Definition of &#8216;Sex&#8217;<\/h2>\n<p>The DOE&#8217;s \u2062proposed regulation marks\u2063 the latest \u2062move in\u200c a long-running\u200b dispute over what exactly &#8220;sex&#8221; means\u200b in Title IX.<\/p>\n<p>The Obama \u2063administration first tried\u2063 to expand the definition, writing in an April 2011 <a href=\"https:\/\/www2.ed.gov\/print\/about\/offices\/list\/ocr\/letters\/colleague-201104.html\" target=\"_blank\" rel=\"noopener\">&#8220;Dear Colleague&#8221; letter<\/a> that Ti<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Tuesday&#8217;s press briefing whether the Biden administration supports men who identify as women participating in female sports.
