However, the judge has given prosecutors with the \u2063Attorney General&#8217;s Office 10\u2062 days to refile\u2062 the charges against\u200c Dr. Grant Robicheaux and Cerissa Riley. However, Mr. Robicheaux still faces several misdemeanor \u200dcharges and two felony counts. With the judge&#8217;s decision, Ms. Riley is no longer facing any charges. A demurrer is a legal move to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/prosecutors-ask-u-s-supreme-court-to-reinstate-bill-cosby-sex-crimes-conviction\/\" title=\"Prosecutors Ask U.S. Supreme Court to Reinstate Bill Cosby Sex Crimes Conviction\">dismiss charges<\/a> based on an argument that there&#8217;s not enough evidence to\u2062 support the allegations.<\/p>\n<p>Mr. Robicheaux&#8217;s \u200dattorney, Philip Cohen, argued that the statute of limitations prevents prosecutors from\u2064 pursuing the remaining charges. However, Deputy Attorney \u200bGeneral James\u2062 Toohey argued that the \u2062case was filed within the three-year deadline. The dispute revolves around when the clock began ticking on\u2062 prosecuting the filed \u200ccase, which\u200c dates back to 2018.<\/p>\n<p>In his decision, \u2062Judge Leversen stated, &#8220;The real question I have in front of me is counts one through three and whether they&#8217;re sufficiently alleged, and they&#8217;re not. The demurrer is sustained. But\u2064 I&#8217;ll give you leave to amend, and that has \u200cto be done in 10 days.&#8221;<\/p>\n<p>Deputy Attorney General Namita Patel confirmed their intention to file an amended information.
