He stated that he needed to research certain points of law and would aim to issue a ruling before Sept. 6. \u200cHowever, if\u200d he fails to do so, \u200dMeadows will have to report\u200b to state court on that day for arraignment.<\/p>\n<p>In the \u2062new order, Judge Jones noted that the racketeering count against Meadows includes several <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-in-mark-meadows-case-orders-extra-briefing-from-attorneys\/\" title=\"Federal Court orders additional briefing from attorneys in Mark Meadows case.\">overt acts\u2063 attributed<\/a> to him. The order\u2064 poses the question\u200c of whether a finding that at least one of these overt acts occurred under the color of Meadows&#8217;s office would be\u200b sufficient for federal\u2063 removal \u2062of a criminal prosecution.<\/p>\n<p>The \u200dattorneys\u2064 representing Meadows and Fulton County District Attorney Fani Willis have \u200dbeen directed to respond to the court by\u200d Aug.\u200d 31 at 5 p.m.<\/p>\n<p>Meadows argues that he\u2064 is immune \u2063from \u2064state \u2063prosecution under the \u200dU.S. Constitution&#8217;s Supremacy Clause, which prioritizes federal law over state \u2062law. He contends that he cannot \u2064be \u2064prosecuted in \u200bstate \u2063court \u200dbecause any actions he took were done in \u200bhis official capacity as a\u2062 federal officer, and he has federal defenses available to him.<\/p>\n<h2>Bellwether Case<\/h2>\n<p>This hearing is of great significance as\u2062 it marks the first <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-white-house-chief-meadows-says-his-actions-in-georgia-recount-shielded-by-federal-law\/\" title=\"Meadows: Federal Law Protects My Actions in Georgia Recount\">time substantive arguments<\/a> have\u200d been presented in court for any \u200bof the four\u200d criminal cases brought \u200bagainst former President \u200cDonald Trump and his\u2063 co-defendants this year.<\/p>\n<p>Many view this\u200c hearing as a mini-trial for\u2063 President Trump and\u2063 his co-defendants, speculating that the treatment\u200b Meadows receives\u200d in federal court\u2062 will set the tone for \u200dthe other Trump-related prosecutions.<\/p>\n<p>President Trump, Meadows, and 17 co-defendants were indicted by a state\u200b grand \u200bjury in Fulton \u2063County on Aug. 14 \u200bin relation to the former chief executive&#8217;s challenge to the election.<\/p>\n<figure style=\"width:640px;margin-left:auto;margin-right:auto\" class=\"alignnone\"><figcaption>Former President Donald\u200c Trump speaks to\u2063 reporters after being booked at the Fulton County Jail on 13 charges related to the 2020 election in Atlanta, Ga., \u2063on Aug. 24, 2023. \u2064(Joe Raedle\/Getty Images)<\/figcaption><\/figure>\n<p>Prosecutors have focused on a Jan. 2, 2021, telephone\u200d conversation between President\u2062 Trump and Georgia Secretary of State Brad Raffensperger. They allege that President Trump and others unlawfully attempted to \u2062interfere \u2062in \u2063the electoral process.\u2063 Charges against the defendants range from \u2062violating Georgia&#8217;s Racketeer Influenced and Corrupt Organizations (RICO) Act \u2064to soliciting the violation of\u200c an oath by a public officer.<\/p>\n<p>Meadows himself is charged with one count of violating the Georgia RICO\u2062 Act and one count of solicitation of\u200c violation of oath by a \u200bpublic\u200d officer.<\/p>\n<p>The indictment specifically alleges \u200cthat on Jan.\u200c 2, 2021, Meadows\u200c unlawfully solicited, requested, and importuned Raffensperger \u2064to engage in conduct constituting the\u200b felony offense of Violation\u2063 of \u2063Oath by Public Officer. It further claims that Meadows unlawfully altered, adjusted, and influenced the certified returns for presidential electors for the November 3, \u200b2020, election in Georgia.<\/p>\n<p>The\u2063 defendants are \u2062accused of violating the Georgia RICO Act from Nov. 4, 2020, to Sept. 15, 2022, through a pattern of racketeering activity.<\/p>\n<p>During the removal hearing on Aug. 28, Act 19, which referred to a December 2020 meeting with White House staffer John McEntee,\u2064 was\u200c discussed. President Trump and Meadows \u2064allegedly asked for a strategy memorandum \u200dto disrupt\u2064 and \u200bdelay the joint session of Congress on Jan. 6, \u20642021. The indictment claims that the strategy involved Vice President Mike \u200dPence counting only \u200chalf of the \u2063electoral votes\u200d from\u200b certain\u200d states\u200b and returning the remaining electoral votes to state legislatures.<\/p>\n<p>Meadows stated that he did not recall this act and would have been \u2064surprised if he had been involved in it, as it would have been handled by White House \u2062counsel.
