Spivak<\/a><br \/>August 29, \u20642023<\/p>\n<p><em>(Views expressed \u2062by guest commentators may not reflect the views of OAN or its affiliates.)<\/em><\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<h2>The RICO case against Trump demonstrates the radical Left\u2019s commitment to ending free speech.<\/h2>\n<p>Georgia\u2019s \u200dFulton County District Attorney Fani Willis\u2019s <a href=\"https:\/\/www.scribd.com\/document\/665036274\/Trump-Indictment-Georgia-081423#fullscreen=1\">indictment<\/a> of Donald Trump and 18 \u2062other <a href=\"https:\/\/www.axios.com\/2023\/08\/15\/georgia-indictment-trump-co-defendants\">defendants<\/a> for knowingly and willfully conspiring to unlawfully change \u200cthe outcome of\u2062 the \u200dGeorgia \u200belection, Jack Smith\u2019s similar federal <a href=\"https:\/\/www.politico.com\/f\/?id=00000189-b2ee-dee7-a7ab-faffe6790000\">indictment<\/a> of Trump for lobbying Congress and the vice president\u200b to delay certification of 2020 election results, the\u200d Biden Administration\u2019s whole-of-government censorship enterprise (see <a href=\"https:\/\/americanmind.org\/salvo\/ending-free-speech\/\">here<\/a> and <a href=\"https:\/\/www.nationalreview.com\/2022\/09\/biden-administration-engaged-in-a-massive-censorship-campaign\/\">here<\/a>), the Department of Justice\u2019s\u2062 targeting of pro-life demonstrators, and \u200cwidespread ostracism and termination of <a href=\"https:\/\/www.nationalreview.com\/2021\/11\/the-new-loyalty-oaths\/\">academics<\/a>, \u2064executives, other professionals, parents, and people of faith who refuse to tow the \u2063progressive line are all part of an intensifying effort by progressives to deprive Americans\u200c of their bedrock\u2062 free speech rights.<\/p>\n<p>The Georgia indictment \u2062alleges that the defendants conspired to falsely overturn the 2020 \u200cGeorgia election, falsely lobbied elected officials, fraudulently created a slate \u2063of alternative \u2063electors, and \u2063tampered with election machines and voting records.<\/p>\n<p>The federal and \u2064Georgia indictments overwhelmingly rely on allegations that constitutionally \u2062protected\u2063 political speech becomes a\u2064 crime \u2063when used to support goals that the\u200b Left abhors. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/georgia-on-our-mind\/\" title=\"Georgia is on our minds.\">indictments\u200b invade attorney-client privilege<\/a> \u200dto \u2064expose the legal advice Trump received and\u2064 allege that because the advice was outside of prevailing\u200d legal doctrine, \u2063the lawyers committed crimes by giving that advice. Though the indictments\u2064 also \u2062allege unlawful actions, as a basis for the \u200bindictments, \u2062the alleged actions are inconsequential compared to the alleged speech.<\/p>\n<p>With rare exceptions, political speech cannot constitutionally be the basis for a prosecution. In <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/319\/624\/\"><em>West Virgina State Board of\u2062 Education v.\u2064 Barnette<\/em><\/a> (1943), the Supreme Court held\u2064 that protecting political\u200b speech is part of\u2062 the \u201cfixed star in our constitutional constellation.\u201d \u2063It makes no\u200b difference if Trump and his co-defendants were wrong about election fraud, or, generally, even if \u200dthey <em>knew<\/em> they were wrong. The Supreme Court has made it clear that the First Amendment \u2064protects false political speech, <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/11-210#writing-11-210_OPINION_3\"><em>United \u2063States v.\u2063 Alvarez<\/em><\/a> (2012), and that \u2064the remedy is\u200b more free speech setting \u200bthe record straight.\u2062 There is no exception for misinformation, let alone \u201c<a href=\"https:\/\/www.cisa.gov\/topics\/election-security\/foreign-influence-operations-and-disinformation\">malinformation<\/a>,\u201d which the \u2063Department of Homeland Security defines as \u201cbased on fact,\u200c but used out of context to mislead, harm, or manipulate.\u201d<\/p>\n<p>For at least two reasons, \u2064it is inconsequential if the purpose \u2064of the\u200d defendants\u2019\u200b tweets and other statements was to\u2064 convince government officials to re-examine, delay, or change the\u2062 basis \u2063on which they would certify election results. Regardless of whether \u2062the action promoted\u200d was criminal, advocating the commission of a crime, or even the use of violence, to advance\u200c political goals is protected by the Free Speech Clause, unless it is a direct\u200b incitement to imminent lawless action and is likely \u200cto \u2063succeed, <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/395\/444\/\"><em>Brandenburg v. Ohio<\/em><\/a><em> <\/em>(1969). And under a separate clause\u200c of the First Amendment, \u2064each American also\u200b has the right to \u201cto\u200d petition the Government for a redress of grievances.\u201d It is unconstitutional to\u200c bring criminal charges against an American for exercising his\u2062 or \u200bher First Amendment rights.<\/p>\n<p>My analysis of Smith\u2019s indictment is <a href=\"https:\/\/americanmind.org\/salvo\/taking-aim-at-the-first-amendment\/\">here<\/a>.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-2\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-2'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<h3>Willis\u2019s 98-page indictment is \u2063replete with \u2062161 allegations, most of which concern\u200d tweets, phone calls,\u2063 or other statements made \u200dby Trump or his lawyers.<\/h3>\n<p>There is no allegation that Trump or any other defendant threatened physical harm to anyone, though \u2062there is a single vague allegation that certain defendants \u201ctraveled\u200d from out of state to harass\u200b [a county election worker],\u2063 intimidate \u200bher, and \u200dsolicit her to falsely confess\u200d to \u2063election crimes\u2063 that she\u200c did not commit.\u201d<\/p>\n<p>Rather, the indictment is largely a litany of\u200d protected speech. Typical are \u2063these Trump \u2062tweets: \u201cGeorgia \u200chearings \u2064now on @OANN. Amazing!\u201d; and, \u201cGee, what a surprise. Has anyone informed the so-called (says he has no power to do anything!) Governor @BrianKempGA\u200d &#038; his puppet Lt. Governor\u2063 @GeoftDuncanGA,\u2062 that they could easily solve this mess, &#038; \u2062WIN. \u2064Signature verification &#038; \u2062call a Special Session. So easy!\u201d; and this tweet from co-defendant \u2062and Trump\u2062 lawyer Rudy\u2064 Guliani, \u200d\u201cGeorgia Patriot Call\u200b to Action: today is the day we need you \u200cto call your state Senate &#038; House Reps \u2064&#038;\u2063 ask them to sign\u200b the petition for a special session. We must \u200chave free &#038; fair elections in GA &#038; a [sic] this is our only path to ensuring \u200devery legal vote is \u2063counted.\u201d<\/p>\n<p>Other statements described in the \u200dindictment \u2064are constitutionally-protected efforts to lobby Georgia legislators and \u200cother Georgia officials.<\/p>\n<p>The cover, tables\u200b of contents, \u200cand signatures take 14 pages. The\u200d largest\u2062 section, 58 pages, is a single count under <a href=\"https:\/\/law.justia.com\/codes\/georgia\/2010\/title-16\/chapter-14\/16-14-4\/\">Georgia\u2019s equivalent <\/a>of \u200bthe Racketeer\u2062 Influenced and Corrupt \u2062Organizations Act (RICO).\u200d Ironically,\u2062 Guiliani became famous by using the federal \u2062RICO statute \u2063against the Mafia in New York.<\/p>\n<p>The federal \u2064RICO statute, and apparently the Georgia \u200cequivalent, are <a href=\"https:\/\/www.nationalreview.com\/2023\/08\/fani-williss-flawed-rico-charge-against-trump\/\">premised<\/a> on an enterprise formed\u200d for an unlawful purpose. Re-electing\u2063 Trump \u200dwas not unlawful.\u2062 Willis will have difficulty proving \u2062that\u2063 this enterprise existed to commit unlawful acts, even if some of the \u206219 defendants\u200c broke the law. It is particularly far-fetched \u2063that the\u200c protected speech attributed to Trump and the other defendants is individually or \u2063collectively a\u2063 crime.<\/p>\n<p>The remaining 26 pages allege that one or more defendants impersonated a\u2062 public officer, forged and filed \u2062false documents, influenced witnesses, and engaged in computer theft, trespass,\u2064 invasion of privacy, and acts involving\u2064 theft\u2063 and perjury.<\/p>\n<p>Claims of improperly influencing \u200dwitnesses, conspiracy to defraud\u2064 the state, and filing\u2062 false documents\u2062 largely relate to lobbying efforts and other \u200bactivities protected by \u2064the constitutional right to petition government for redress. If Willis can show\u200b that a defendant attested to the accuracy of a filing the\u200b defendant knew was false, this could be \u2064a misdemeanor, or in some instances a felony. These crimes\u200c are seldom prosecuted, except as an \u2062adjunct\u200d to a much \u2064more serious claim.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-3\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-3'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<h3>Claims of forgery, \u2063filing false documents, and impersonating a public officer tie back to a\u2063 slate\u2062 of alternative Trump electors recruited to vote for Trump if he\u200b prevailed in his Georgia lawsuit, or if\u200c the legislature \u200caccepted his entreaties.<\/h3>\n<p>As Margot Cleveland compellingly <a href=\"https:\/\/thefederalist.com\/2023\/05\/15\/the-lefts-2020-fake-electors-narrative-is-fake-news\/\">explained<\/a> in The Federalist, the use of\u200c alternative\u2062 electors to protect a candidate challenging the\u200c outcome of an election is neither fake nor \u200bfraudulent, with bipartisan antecedents. If the\u200b courts \u2062disagree with \u2063Cleveland\u2019s analysis, \u2062Trump and other defendants\u2064 are at peril for these claims.<\/p>\n<p>Some\u200c of the claims\u200b relate to phone calls\u2064 and Oval Office meetings in which then-White House Chief of Staff, defendant \u200bMark Meadows, participated, and an\u200d official letter written\u2063 by then-Assistant Attorney General, defendant Jeff\u2062 Clark. Both have sought to\u2064 remove their cases\u200b to federal court\u2062 on grounds \u200bthey were acting within the scope of their federal duties. A federal court in Atlanta <a href=\"https:\/\/abcnews.go.com\/US\/live-updates\/trump-georgia-surrender\/judge-denies-meadows-motion-to-move-case-to-federal-court-102512415?id=102463778\">denied<\/a> a portion\u200d of \u2062Meadows\u2019 motion but, ultimately, both should prevail. \u200dBoth should\u200c also prevail in the defense that \u200dtheir \u200dactions were not \u2062unlawful.<\/p>\n<p>Aside\u2063 potentially from\u200d the alternative elector\u200c structure, the\u2063 most problematic \u2063claims allege that\u200d an electronics forensic company retained by co-defendant and lawyer for\u200d Trump Sydney Powell,\u2064 SullivanStrickler LLC, accessed and tampered with voting machines and election results. If\u200b true, these are serious \u200ccrimes. Whether they can be \u2064attributed to other\u200b defendants largely will depend \u200con whether the\u200b RICO claim survives legal\u200b motions.<\/p>\n<p>As\u2062 a core constitutional principle,\u200d with \u2064few \u200bexceptions, no federal or state prosecutor can criminalize lobbying government for redress,\u200d false tweets,\u2063 or false statements on \u2062contentious political issues.\u2064 In <em>United States v. Cruikshank<\/em> (1876), the Supreme Court held that\u2064 the Sixth \u200cAmendment requires an\u2063 indictment that apprises the defendant of the \u200bcrime\u200c charged with reasonable certainty so he\u2062 can make his defense. The\u200c Georgia indictment fails to allege any of the exceptions to First Amendment\u2062 protections, instead using conclusory language\u2063 like \u201ccorrupt intent.\u201d<\/p>\n<p>The criminalization and censorship<a> <\/a>of\u200c protected\u2063 speech, and the progressive effort to steamroll Americans into using \u2063vocabulary they approve to express only concepts they\u2063 support, are gradually transforming America into an <a href=\"https:\/\/www.nas.org\/blogs\/article\/progressive-doctrine-embraces-george-orwells-1984\">Orwellian\u200c dystopia<\/a> in which fundamental\u200d rights and freedoms are\u2062 being stripped away.<\/p>\n<p>There are times when sounding the alarm\u200b is hyperbolic. Conservatives \u2063who believe that progressive outrages\u2062 are\u200c transitory fail \u200cto \u2062understand \u2063that they\u2063 have \u2063been diligently\u2063 working for <a href=\"https:\/\/www.mindingthecampus.org\/2021\/09\/07\/the-hard-bigotry-of-no-expectations-part-ii\/\">50 years<\/a> to come to this point. Aside from a \u200dsetback \u200cat the Supreme Court, progressives are in a dominant \u2063position \u2062in <a href=\"https:\/\/www.mindingthecampus.org\/2022\/05\/20\/the-tip-of-the-racist-spear\/\">education<\/a>, most government bureaucracies, media, entertainment, professional associations such as the AMA \u200b(see <a href=\"https:\/\/americanmind.org\/salvo\/woke-medicines-critical-harm\/\">here<\/a> and <a href=\"https:\/\/www.nationalreview.com\/2022\/08\/association-of-medical-colleges-prioritizes-radical-left-dogma-over-patient-care\/\">here<\/a>) and <a href=\"https:\/\/www.nationalreview.com\/2021\/10\/the-american-bar-association-adopts-an-anti-racism-agenda\/\">ABA<\/a>, and many <a href=\"https:\/\/www.nationalreview.com\/2022\/03\/the-private-sector-succumbs-to-diversity-equity-and-inclusion\/\">public corporations<\/a>. They dominate other \u2062fields that rely on elite universities for their professionals.<\/p>\n<p>Because of the weaponization of the American justice system, Trump has been\u200c indicted\u200b four times, and the \u2064DOJ allowed the\u2062 statute\u2063 of limitations\u200b to run on most of \u200cHunter and Joe Biden\u2019s offenses. This corruption can be mitigated \u200cif a Republican, or even\u200c an honest Democrat, is elected president.<\/p>\n<p>The attack on free \u2063speech\u200b is metastasizing, public support for free speech is declining, and correcting\u2063 course\u200c will be much more difficult than fixing the \u200dDOJ, or\u200b even state prosecutions.<\/p>\n<p>A Knight \u2064Foundation-Ipsos<a href=\"https:\/\/knightfoundation.org\/reports\/free-expression-in-america-post-2020\/\"> poll<\/a> last year found free speech is \u201cextremely important\u201d to 63 percent of Americans, \u2062but only 39 percent of Democrats \u2063thought\u200b protests\u200d against certifying the 2020 election should be protected, \u2063and only 20 percent thought \u201conline misinformation\u201d\u2062 should be \u200bprotected. A July 2023 Pew\u200d Research <a href=\"https:\/\/www.pewresearch.org\/short-reads\/2023\/07\/20\/most-americans-favor-restrictions-on-false-information-violent-content-online\/\">poll<\/a> found the share of U.S. \u2063adults who say the federal \u200dgovernment should restrict false \u2063information has risen from 39 percent \u2063in 2018 to\u2062 55 percent, including 70 percent \u2062of Democrats\u200b \u201ceven if it limits people from freely\u2064 publishing or accessing information.\u201d<\/p>\n<p>Conservative and libertarian litigation groups, notably<a> <\/a><a href=\"https:\/\/nclalegal.org\/\">New Civil Liberties\u200c Alliance<\/a> which \u2064played a key role in <a href=\"https:\/\/dockets.justia.com\/docket\/louisiana\/lawdce\/3:2022cv01213\/189520\"><em>Missouri\u200d v. Biden<\/em><\/a>,\u2063 winning a preliminary\u200b injunction against\u2062 the Biden Administration censorship efforts, <a href=\"https:\/\/adflegal.org\/support\/standing-for-religious-freedom?sourcecode=10027949_r500&#038;msclkid=b53eb1ea0b7b1dbe30d2d5009615ce32&#038;utm_source=bing&#038;utm_medium=ppc&#038;utm_campaign=general_adf\">Alliance Defending Freedom<\/a>, <a href=\"https:\/\/www.judicialwatch.org\/\">Judicial Watch<\/a>, <a href=\"https:\/\/will-law.org\/\">Wisconsin Institute for\u200c Law &#038;\u200d Liberty<\/a>, <a href=\"https:\/\/aflegal.org\/\">America First Legal<\/a>, and the <a href=\"https:\/\/www.thefire.org\/\">Foundation for Individual Rights and Expression<\/a> (FIRE),\u200b among other groups and Republican \u2064state attorneys general, have taken the lead \u200bin filing litigation to\u2062 protect First\u2063 Amendment rights.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-4\" style=\"min-width: 320px; min-height: 50px; text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-4'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>Given the progressive domination of the\u200b levers of power, \u2063supporting these \u2063litigation groups and\u2062 electing centrists \u2062and conservatives steeped in America\u2019s commitment to the Bill of Rights \u200dis the most productive\u200b course. It is\u2062 distressing that expansive\u2063 litigation is the best \u200bpath forward. But it\u200b is better than the alternatives, which are \u2064unimaginably worse.<\/p>\n<p><em>Kenin M.
