Hear the argument.<\/strong><\/p>\n<p>Anti-Trump legal scholars have been \u200barguing that the third \u2063clause of the\u2064 14th Amendment, a post-Civil War measure barring Confederates from\u200c holding\u2064 public office after participating in an \u200cinsurrection, can \u2062be used against Donald \u200dTrump. Attaching a broken boxcar to the\u2062 back\u2062 of\u2063 this moving train, an Aug. 25 essay at <a href=\"https:\/\/www.politico.com\/news\/magazine\/2023\/08\/25\/14th-amendment-insurrection-00112777\" target=\"_blank\" rel=\"noreferrer noopener\">Politico<\/a> casually \u2064compares\u200b the case for 14th Amendment disqualification from the\u200b presidency to the disqualification of southern congressmen <em>during<\/em> the Civil War.<\/p>\n<p>You may have already spotted a problem in that last\u2063 sentence\u2063 because\u2063 the\u2064 story Joshua \u2063Zeitz writes about Trump and the \u200b14th Amendment \u200dhas nothing to do with the 14th Amendment: It\u2019s a story about the refusal of the House \u2063of Representatives\u2063 to take notice of southern\u200d congressman in 1864, well before the <a href=\"https:\/\/billofrightsinstitute.org\/activities\/the-reconstruction-amendments-thirteenth-amendment-1865-fourteenth-amendment-1868-and-fifteenth-amendment-1870\" target=\"_blank\" rel=\"noreferrer noopener\">Reconstruction amendments<\/a> were\u2062 ratified. With that in mind, <a href=\"https:\/\/www.politico.com\/news\/magazine\/2023\/08\/25\/14th-amendment-insurrection-00112777\" target=\"_blank\" rel=\"noreferrer noopener\">go read\u200c it<\/a>.<\/p>\n<p>The subtext speaks louder than the\u200b text. Notice the framing; notice the language that\u2062 colors the argument.\u200c Here\u2019s how Zeitz describes the \u200ccontext\u2064 for the \u206214th \u2064Amendment: \u201cThey \u2064had vanquished\u200b the\u200d Confederacy and compelled Southern states to remain\u2064 in the Union.\u201d<\/p>\n<p>Here\u2019s\u2062 how he opens his description \u2063of the \u2062contest over \u2062who would \u200cbe seated in the \u200cHouse \u200din 1864:<\/p>\n<blockquote>\n<p>These events alarmed and appalled\u2063 most Republicans, and especially radicals\u2063 like Rep. Thaddeus Stevens \u2063of Pennsylvania,\u2064 the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tom-brady-asks-elon-musk-to-remove-infamous-combine-photo-if-twitter-purchase-goes-through\/\" title=\"Tom Brady Asks Elon Musk to Remove Infamous Combine Photo if Twitter Purchase Goes Through\">grim-faced<\/a>, irascible \u201cDictator of the House.\u201d With his piercing gaze \u200dand ruthless authority, Stevens, \u200cwho served as \u200dchair of \u200dthe Ways and\u200b Means Committee during the war, was \u2062also the unspoken floor \u200dleader for the House \u200cRepublican caucus. He maintained tight control over the chamber, even as he\u2063 advocated policies that were far more radical than his caucus in his\u200c desire to\u2063 punish the South and impose Black \u200cpolitical and economic equality. Stevens\u200c advanced the \u2063idea that the Southern states \u200cwere \u201cconquered territories,\u201d\u2063 their residents no longer\u200b citizens of the U.S. and certainly not entitled to govern themselves, \u200dlet \u200balone participate\u2063 in the \u2064governance of the whole nation.<\/p>\n<\/blockquote>\n<p>So what should we do about Donald Trump? Well, \u2064there\u2019s this great moment \u2062in history in which a grim-faced\u200b dictator maintained tight control for the purpose of implementing radically punitive policies over conquered territories\u200d to \u2064dominate people who were not entitled to govern themselves.<\/p>\n<p>That\u2019s the discussion we\u2019re \u200bhaving. The people\u200c Angelo \u2063Codevilla called \u200bthe \u200dAmerican ruling\u2064 class,\u200c the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/authoritarian-ruling-class-mulls-post-civil-war-measures-to-bar-trump-from-the-presidency\/\" title=\"Authoritarian rulers consider ways to prevent Trump from becoming president after the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/happy-thanksgiving\/\" title=\"Happy Thanksgiving!!\">civil war<\/a>.&#8221;>hegemonic\u2063 academic-political-media\u2064 hive people<\/a>, are now casually discussing Trump and Trump \u200dvoters as a conquered people who have to be dominated\u2064 and kept out of the system of self-government. Because Trump\u2064 is a dangerous authoritarian, you see.<\/p>\n<p>Start looking for this unstated premise, and you\u2019ll start finding it everywhere. There are \u200bno legitimate arguments to the right of Hakeem Jeffries; there is only dangerous Putin-influenced extremism that must be \u200dfirmly suppressed. We are not engaged in anything resembling <em>political debate<\/em>.<\/p>\n<p>I find NYU professor Ruth Ben-Ghiat, a hilariously obtuse expert on authoritarianism,\u2062 an especially helpful\u2064 source for parsing \u2064the eliminationist radicalism of the moment because she has the quality of mind that allows her to slop her\u2064 givens all over the \u2063page without ever thinking about them at all. What should we do\u2063 about Trump? <a href=\"https:\/\/twitter.com\/ruthbenghiat\/status\/1694891039427883199\" target=\"_blank\" rel=\"noreferrer noopener\">Well<\/a>, \u201clots of other heads of\u2063 state have been prosecuted, convicted, sentenced \u2062to jail or house arrest,\u201d so we just need to\u200c be \u200dmore like the countries \u2064that\u2064 imprison their political leaders. <a href=\"https:\/\/twitter.com\/ruthbenghiat\/status\/1694856210657218818\" target=\"_blank\" rel=\"noreferrer noopener\">In fact<\/a>, \u201cTrump arrest=democracy\u2064 in \u200daction.\u201d \u2062What\u200d should we\u2063 think of the presidential candidacy of Vivek \u2063Ramaswamy? It\u2019s authoritarian\u2063 for him to\u200c be allowed a platform <a href=\"https:\/\/twitter.com\/ruthbenghiat\/status\/1695949676141277374\" target=\"_blank\" rel=\"noreferrer noopener\">because<\/a> it\u2019s \u201cdesigned to get more poisonous extremist ideas into the mainstream and further degrade democratic politics.\u201d Allowing Republicans \u200cto speak is an extremist assault on democracy; arresting them is \u201cdemocracy\u2063 in action.\u201d And again, that\u2019s \u200cwhere we are.<\/p>\n<p>Politico, \u2064the house organ of the American ruling class, has \u200ban\u200d idea \u2064about how we can deal with Trump\u2062 and his\u2063 supporters, and their \u200cidea calmly starts\u200b with a comparison to \u200bthe way the federal\u200c government \u200bdealt with the vanquished Confederacy.<\/p>\n<p>It\u2019s\u200c no longer\u2063 correct\u2062 to say the mask is slipping.\u2063 At\u2063 this late\u200c moment, \u200cthere is no mask.<\/p>\n<hr>\n<p>Chris \u2062Bray is a former infantry sergeant in the \u200dU.S. Army, and has a history PhD \u200bfrom the University of California Los \u200cAngeles.
