8\/21\/2023<\/li>\n<\/ul>\n<\/blockquote>\n<p>The lawmakers specifically \u2062requested any new scope memos, directions, or instructions pertaining to Mr. Weiss&#8217;s appointment to be\u200d provided by Sept. 11.<\/p>\n<p>&#8220;The Department \u200dpulled punches in this investigation, handicapping veteran investigators and preventing \u200bthem from freely pursuing the facts,\u201d the letter states (<a href=\"https:\/\/www.documentcloud.org\/documents\/23929700-2023-08-28-jdj-js-jc-to-garland-re-weiss-appt-to-special-counsel\" target=\"_blank\" rel=\"noopener\">pdf<\/a>).<\/p>\n<p>&#8220;Now you have appointed as special counsel an \u200bindividual who oversaw all the investigation\u2019s\u200d irregularities, who\u200d spent the past two months claiming that he did not need special counsel status, \u2064and who was responsible for the plea \u2064agreement that collapsed in court and is widely viewed as an embarrassment\u2064 for the Department.&#8221;<\/p>\n<p>The letter points out the \u2062disintegration of the June\u200d plea deal for two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-plea-merrick-garland-responds-to-question-about-presidents-sons-deal\/\" title=\"Merrick Garland addresses Hunter Biden's plea deal query.\">tax-related misdemeanors<\/a> \u200cand \u200cfirearm possession by\u200d an &#8220;unlawful user of\u200d or addicted to any controlled substance&#8221; over its implications for further charges against Mr. Biden.<\/p>\n<p>The lawmakers contend that Mr. Biden\u2063 received preferential treatment from \u2063the DOJ due to his relation \u2062to President Joe Biden. IRS whistleblowers testified in a recent committee hearing that prosecutors deliberately delayed the investigation, suggesting that Mr. Biden should have faced more severe tax \u200dcharges than the misdemeanors initially presented.<\/p>\n<p>The letter also highlights \u2062claims made by DOJ insiders \u2064that \u2063Mr. Biden received privileges \u200dnot available to\u200b others, \u200dincluding advance notice to his counsel about an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jordan-gop-demand-clarity-and-documents-in-hunter-biden-probe-after-special-counsel-appointment\/\" title=\"Jordan and GOP seek clarity and documents in Hunter Biden probe following special counsel appointment.\">upcoming storage unit search<\/a>.<\/p>\n<p>Additionally, it questions the timing of Mr. Weiss&#8217;s appointment, given that he had \u200d&#8221;ultimate&#8221; authority over the case prior to becoming \u200dspecial counsel.<\/p>\n<p>\u201cIt is not clear why \u200byou have only\u2064 now, after the investigation has been going on for five years, \u200copted to appoint Mr. Weiss as \u200bspecial counsel, especially after you and the Department represented\u200c that Mr. Weiss \u2063already had \u2018ultimate\u2019 authority over the case,\u201d the letter states.<\/p>\n<p>The lawmakers assert that if Mr. \u200dWeiss had the authority he \u200dand Mr. Garland had\u2063 previously claimed at a Senate Judiciary Committee in March, then there\u2062 was &#8220;no reason&#8221; to\u200d appoint\u200d him as special counsel to &#8220;prosecute federal crimes in any\u2063 federal judicial district arising from the \u200binvestigation \u2064of these matters.&#8221;<\/p>\n<p>Mr. Weiss was \u2062appointed\u2064 after the two\u2064 IRS whistleblowers criticized how the prosecutors handled the case.\u200b The whistleblowers, both \u200dIRS investigators, suggested that Mr. Weiss&#8217;s team found stronger evidence of tax crimes in California and Washington, D.C., but faced\u200b resistance \u2063in bringing charges outside their jurisdiction.<\/p>\n<p>The letter addresses \u200cdiscrepancies between \u200bprevious statements by both Mr. Garland and Mr. Weiss regarding Mr. Weiss&#8217;s authority, raising concerns\u2063 of possible deviations from the initially declared approach.
