Special Counsel Jack Smith proposed\u200b Jan. 2, \u20632024 and Trump\u2019s attorneys pitched April 2026. Chutkan rejected both, but settled on a date eight\u2062 weeks later than Smith\u2019s proposal.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThere\u2019s no\u2062 way that any defense \u2063attorney\u200b can prepare this kind of defense for this kind of a case\u2063 in that short amount of time,\u201d Kamenar said.<\/p>\n<\/blockquote>\n<p>A Trump spokesperson slammed this trial date, saying it \u200bdeprived the 45<sup>th<\/sup> president of his \u2064\u201cConstitutional right to a fair\u2064 trial.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cCrooked\u2063 Joe Biden, Deranged Jack Smith, and their henchmen\u200c continue to abuse the American\u2064 justice system\u200d in their goal of interfering in the 2024 Presidential Election in order\u2064 to\u2062 prevent President \u2063Trump from returning to the Oval Office,\u201d said\u2064 the \u200dunnamed spokesperson. \u201cThe date set today deprives \u200bPresident Trump of his Constitutional right to a fair trial,\u2063 a seminal bedrock of America, and continues to expose the corruption \u200cof the witch hunts being thrown \u2062against President Trump. From setting \u200ba trial date for the day before \u201cSuper\u2062 Tuesday\u201d to sending a fundraising email the moment \u2062of President Trump\u2019s processing in Fulton County,\u200b the\u200c Biden regime \u200cis no longer hiding its nakedly political motivations. President Trump will \u2062not be deterred, he will fight these\u2062 hoaxes\u2063 at every turn, and will win for the \u2064American people.\u201d<\/p>\n<\/blockquote>\n<p>Central to Chutkan\u2019s ruling was the access \u2064Trump\u2019s legal team\u2063 had\u2064 to the 12.8 million documents the\u200b government handed over in\u2064 discovery. Prosecutors claimed that Trump\u2019s team had access to more than seven million of these documents as they stemmed from his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/amid-threats-of-corporate-donation-withdrawals-gop-senate-fund-hauls-in-8-3-million\/\" title=\"Amid Threats Of Corporate Donation Withdrawals, GOP Senate Fund Hauls In .3 Million\">political action committees<\/a>, the National Archives\u2064 and Records Administration, and Secret Service. They also claimed there\u200b were numerous duplicate documents in discovery as\u2062 well.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cYou have\u200b to look at these\u200c documents to make sure that they are \u200bduplicates,\u201d Kamenar explained. \u2063\u201cThat takes\u200c time. You can\u2019t just push a\u2063 button and find out that things are duplicated or look \u200cfor\u200b search terms. \u200dYou have to read these. You have \u2064to analyze these, you have\u200c to\u2062 prepare\u2062 for cross-examination \u200bof these witnesses.\u201d<\/p>\n<\/blockquote>\n<p>Chutkan also appeared to be sympathetic to prosecutors arguing that Trump \u200dhad nearly a year to begin\u200b preparing to face\u200b charges in this case as he and his team were aware of the grand jury\u200d investigation since September\u200b 2022.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe judge is basically saying, \u2018Well, you knew this indictment was going to come along, because we \u2062had the grand jury \u2064last fall convene,\u2019\u201d said Kamenar. \u201cWell, just because you have a grand jury convening does not\u2064 obligate a defense attorney who\u2019s not\u200d even\u2063 hired in \u2062the case to start preparing for defense. You don\u2019t even know what the charges are. This is a totally unfair \u200dviolation of President Trump\u2019s due process rights.\u201d<\/p>\n<\/blockquote>\n<p>Chutkan, \u2063an Obama appointed judge who \u200ccalled Black Lives Matter protests \u201c<a href=\"https:\/\/www.oann.com\/newsroom\/judge-presiding-over-j6-trump-case-called-blm-protests-mostly-peaceful-ranted-about-how-trump-remains-free\/\">mostly peaceful<\/a>\u201d in a\u2063 previous ruling, also said Trump\u2019s team \u201cknew\u201d the indictment was coming. Kamenar claimed that phrasing sent a message \u2063loud and clear.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThat to me showed that the deal\u2064 was done, so \u200cto speak, to go after\u2064 Trump,\u201d Kamenar said.<\/p>\n<\/blockquote>\n<p>Lauro informed Chutkan he would be\u2062 submitting pretrial motions regarding executive \u200bimmunity and selective prosecution.\u200b He\u2062 indicated the motion on\u2062 executive immunity could come as soon as \u200bthis week.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cExecutive immunity basically says \u200cthat everything that \u200cwas charged \u200din this indictment occurred while President Trump was \u200dstill president,\u201d Kamenar explained. \u201cAnd under\u200c Supreme \u200cCourt law, he has executive immunity\u2064 in \u200cterms of any civil suits that are filed against him. And there\u2019s a \u2062good legal argument that\u2064 he should have immunity for\u2064 any criminal\u200c charges that are brought against him in the course of his executing his duties.\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIf [executive immunity] is denied, [Trump\u2019s legal team] has \u2063a right to\u200b go\u200d immediately to the Court of Appeals to get that \u2064reviewed,\u201d Kamenar continued.\u200c \u201cAnd that\u2019s going \u200dto take three to six \u2062months just to sort\u200c that\u2063 out.\u201d<\/p>\n<\/blockquote>\n<p>The March 4<sup>th<\/sup> trial date will also overlap \u200dwith \u200cTrump\u2019s New\u200b York case, which \u200dis scheduled to go \u2063to trial on \u2063March 25<sup>th<\/sup>.<\/p>\n<p>Stay informed!
