Knudsen, along with a group of \u200b19 attorneys general, \u2064is urging the U.S. \u200cCourt of\u200c Appeals \u2062for \u200cthe 4th Circuit to\u2063 side with plaintiffs who argue that the\u2063 law creates &#8220;unconstitutional&#8221; gun-free\u2064 buffer\u2062 zones.<\/p>\n<h3>A Personal Passion for the Second Amendment<\/h3>\n<p>When asked about Montana&#8217;s\u200d involvement in a Maryland county law, Knudsen expressed his personal connection to the Second Amendment. As an avid \u2064hunter, \u200creloader, and competitive shooter, he\u2064 closely \u200dmonitors issues \u2063related to\u2062 firearms. He firmly believes that \u200dif these\u200c types of regulations go unchallenged, they will spread to other states, not just Maryland.<\/p>\n<p>Montana&#8217;s \u200dassistant solicitor \u200dgeneral, in the brief provided to the Washington Examiner, highlighted Section 57 of Montgomery County Code, which\u2064 prohibits\u2064 the sale, transfer, or possession of firearms within 100 yards of a place of public assembly. The definition of a &#8220;place of public assembly&#8221; includes various locations such as parks,\u200d places\u200c of worship, schools, libraries, recreational facilities, multipurpose exhibition facilities, and childcare facilities.<\/p>\n<p>The plaintiffs, supported by the 19 states, argue that the \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-leads-18-states-in-court-to-strike-down-maryland-buffer-zones-gun-law\/\" title=\"Montana leads 18 states in challenging Maryland's gun law.\">law effectively prevents<\/a> anyone besides designated security guards and active\u200b police officers from carrying a \u200cgun \u2062for self-defense in public. They claim that it is practically impossible for permit holders to legally carry\u2064 a handgun\u200c within Montgomery County.<\/p>\n<p>The Supreme \u2062Court&#8217;s 2022 decision in Bruen v. New York \u2063Rifle &#038;\u200b Pistol Association established that \u200dwhile governments can regulate the public carrying of \u2064guns, they cannot prohibit it for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-sheriffs-tell-newsom-they-wont-enforce-covid-curfew\/\" title=\"California Sheriffs Tell Newsom They Won't Enforce COVID Curfew\">law-abiding citizens<\/a>. However, the court did not clearly\u2062 define what constitutes a &#8220;sensitive place&#8221; for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gun-rights-activist-tells-congress-education-can-reduce-shootings-not-more-laws\/\" title=\"Gun Rights Activist Tells Congress Education Can Reduce Shootings, Not More Laws\">gun-free zones<\/a>, leaving it up to lower courts to decide.<\/p>\n<p>Montana&#8217;s\u200d brief argues that \u2063the historical\u2063 record does not support\u2062 the\u200c county&#8217;s \u2062regulations, as there\u2062 is no enduring \u200dAmerican tradition of\u2063 restricting the right \u2063to carry in places like worship, parks, recreational facilities, libraries, \u2064or buffer zones.<\/p>\n<p>The amicus\u200b brief was signed by \u2064the attorneys general\u200c of Alabama, \u2063Alaska, Arkansas,\u200d Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana,\u200b Mississippi, Missouri, Nebraska, South Carolina, South Dakota, Texas, West Virginia, and Wyoming.<\/p>\n<p>Outside of the Montgomery County dispute, legal battles are also underway regarding Maryland&#8217;s SB1\u2062 law, which <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/montana-leads-19-states-in-court-to-strike-down-maryland-buffer-zones-gun-law\/\" title=\"Montana leads 19 states in challenging Maryland's gun law.\">increases concealed carry permit fees<\/a> and expands &#8220;gun-free zones&#8221; in the state.
