Wins by Tesla could raise confidence and \u2063sales for \u200cthe software, which\u200c costs up to $15,000 per\u2062 vehicle.<\/strong><\/p>\n<p><strong>Tesla faces two\u2062 trials in\u200d quick\u200c succession, with more \u200cto follow.<\/strong><\/p>\n<p><strong>The first, \u2064scheduled for mid-September in a California state court, is\u200b a civil lawsuit containing\u200c allegations \u200bthat the Autopilot system caused owner \u2063Micah Lee\u2019s Model \u20623 \u2063to suddenly veer off a highway east of Los \u2062Angeles at 65 miles per hour, strike a palm tree and burst into flames, all in \u200bthe span \u200cof seconds.<\/strong><\/p>\n<p><strong>The 2019 \u2063crash, which has not been previously reported, killed Lee and seriously injured his two passengers, including a\u2063 then-8-year \u200dold\u200d boy who was disemboweled. The lawsuit, filed against Tesla by the\u200b passengers and Lee\u2019s estate, accuses Tesla of knowing that \u200bAutopilot \u2062and other \u200csafety\u200c systems were defective when it sold the car.<\/strong><\/p>\n<p><strong>MUSK \u2018DE FACTO LEADER\u2019 OF AUTOPILOT TEAM<\/strong><\/p>\n<p><strong>The \u200dsecond trial, set\u200d for early October in \u2063a Florida state court, arose out of a 2019 crash north of Miami \u200cwhere owner Stephen\u200b Banner\u2019s Model 3 \u200bdrove \u2063under the trailer\u200d of an \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tesla-braces-for-its-first-trial-involving-autopilot-fatality\/\" title=\"Tesla prepares for its inaugural trial concerning a fatality involving Autopilot.\">18-wheeler big \u2062rig \u2063truck<\/a> that had \u2064pulled into the road, shearing \u2064off the \u2064Tesla\u2019s roof\u2062 and killing Banner. Autopilot\u2062 failed to brake, steer or do anything to avoid the\u200b collision, according to the lawsuit filed by Banner\u2019s wife.<\/strong><\/p>\n<p><strong>Tesla denied liability for both accidents, blamed driver error and said Autopilot is\u2063 safe when monitored by humans. Tesla said in court documents that drivers must pay attention to the\u2064 road and keep their hands on the \u2064steering wheel.<\/strong><\/p>\n<p><strong>\u201cThere are no self-driving cars on\u200b the road today,\u201d the company said.<\/strong><\/p>\n<p><strong>The civil proceedings will\u2064 likely \u2063reveal new evidence about what\u200c Musk and other company officials knew about Autopilot\u2019s\u200c capabilities \u2013\u200c and any possible deficiencies.\u2062 Banner\u2019s attorneys,\u2062 for instance, argue in a pretrial \u200dcourt\u200d filing that internal emails show Musk is the Autopilot team\u2019s \u200d\u201cde facto leader\u201d.<\/strong><\/p>\n<p><strong>Tesla and Musk did not respond to Reuters\u2019 \u2064emailed questions for this article, but Musk has made \u200bno\u2062 secret\u2064 of his involvement \u2064in self-driving software\u2064 engineering, often tweeting about his test-driving of a Tesla\u200d equipped with\u2062 \u201cFull\u2064 Self-Driving\u201d software.\u2063 He has for years promised that\u2063 Tesla \u2063would achieve self-driving \u2062capability only to miss his own targets.<\/strong><\/p>\n<p><strong>Tesla\u2064 won\u200d a bellwether \u200dtrial in Los Angeles in April with a strategy of saying\u2063 that it tells drivers that its technology\u200c requires human monitoring, despite the \u201cAutopilot\u201d and \u201cFull \u200cSelf-Driving\u201d names. The case was about \u2064an accident where a Model S swerved into \u200dthe curb and injured its driver, and jurors told Reuters after the verdict that they believed \u2064Tesla warned drivers about its system\u2064 and driver distraction was to blame.<\/strong><\/p>\n<p><strong>STAKES HIGHER FOR TESLA<\/strong><\/p>\n<p><strong>The stakes for Tesla\u2062 are much higher in the September and October \u200dtrials, \u200cthe first of \u200da series related \u200cto \u2064Autopilot this\u200b year and next, because\u2063 people \u200cdied.<\/strong><\/p>\n<p><strong>\u201cIf Tesla backs up a lot of wins in these \u2062cases, I think they\u2019re going to get more favorable settlements in other cases,\u201d \u200bsaid Matthew Wansley, a former General \u2063Counsel of nuTonomy,\u200c an automated\u2064 driving \u200cstartup and Associate \u200dProfessor of Law\u200d at Cardozo School of Law.<\/strong><\/p>\n<p><strong>On the other hand, \u201ca\u2063 big\u2064 loss \u2064for Tesla \u2013 especially with\u2063 a big \u2064damages\u200c award\u201d \u2062could \u201cdramatically shape the narrative going forward,\u201d said Bryant Walker Smith, a law professor at the University of South \u200bCarolina.<\/strong><\/p>\n<p><strong>In\u200c court filings, the company has argued that \u2064Lee consumed alcohol before getting behind the wheel and that it is not clear whether Autopilot was on at the time of crash.<\/strong><\/p>\n<p><strong>Jonathan Michaels, an attorney for the plaintiffs, declined to comment on Tesla\u2019s specific arguments, \u2064but said \u201cwe\u2019re fully aware of Tesla\u2019s false claims\u200c including their \u2062shameful attempts\u200c to blame the victims for their known defective\u200d autopilot system.\u201d<\/strong><\/p>\n<p><strong>In the Florida case, Banner\u2019s attorneys also filed a \u2062motion arguing punitive \u2063damages were \u2064warranted. The attorneys have deposed\u200d several \u2062Tesla executives and received internal documents from the company that they\u2063 said show Musk and engineers were aware of, and did not fix, shortcomings.<\/strong><\/p>\n<p><strong>In one deposition, former executive Christopher Moore testified there are limitations to Autopilot, saying it \u201cis not designed\u200d to detect every possible hazard or every\u200c possible obstacle or\u200b vehicle that could be on the\u2062 road,\u201d according to a transcript reviewed by Reuters.<\/strong><\/p>\n<p><strong>In\u200c 2016, a few months after a fatal\u2063 accident where a \u2063Tesla crashed into a semi-trailer truck, Musk told reporters that the \u2063automaker was updating Autopilot\u200b with improved\u200d radar sensors that likely \u200dwould have prevented the fatality.<\/strong><\/p>\n<p><strong>But Adam (Nicklas) Gustafsson, a Tesla Autopilot systems engineer \u2063who investigated\u2063 both accidents in Florida, said that in \u2063the almost three years between that\u2062 2016 crash and\u200c Banner\u2019s accident,\u2063 no\u200c changes were made to Autopilot\u2019s systems to account for\u200d cross-traffic, according \u200cto court \u200bdocuments submitted by plaintiff lawyers.<\/strong><\/p>\n<p><strong>The lawyers tried\u2062 to \u2064blame \u2062the lack\u2062 of change\u200c on Musk. \u201cElon\u2063 Musk has\u2064 acknowledged problems\u200b with the Tesla\u200b autopilot system not working properly,\u201d according to \u200bplaintiffs\u2019 documents. Former\u200b Autopilot engineer Richard\u2062 Baverstock, who was also deposed, \u200bstated that\u2063 \u201calmost everything\u201d he did at Tesla was done at the request of \u201cElon,\u201d according to the documents.<\/strong><\/p>\n<p><strong>Tesla filed an emergency motion\u200d in court late on Wednesday seeking to keep deposition transcripts of its employees and \u2063other documents secret.
