remove former President Donald Trump from\u200b state \u2063ballots\u200b in the 2024 election \u200care ramping up nationwide after critics argued the leading Republican contender is constitutionally \u200ddisqualified from serving as president after he \u201cengaged in \u2063insurrection\u201d against \u200cthe United States.<\/p>\n<p>Trump, \u2063who \u200bis leading the GOP primaries by a landslide, \u200dfaces four\u2063 separate \u200bindictments along \u2062the East Coast, including charges related to hush money, classified\u2064 documents, election interference, and racketeering. \u200dTrump has broadly\u2063 denied any wrongdoing in \u2062the charges brought against him and \u200chas \u200d<a title=\"14th Amendment used to remove Trump from 2024 ballot: Report\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/efforts-to-remove-trump-from-2024-ballot-using-14th-amendment-ramp-up-report\/\">claimed \u2063politically motivated \u200dforces<\/a> are targeting\u200b him\u2063 in a \u201cwitch hunt\u201d propagated \u2064by the \u2062Biden administration and Democrat \u200cprosecutors.<\/p>\n<p>But\u200d now opponents across\u2064 the political spectrum of the former president are arguing that under the U.S. Constitution\u2019s\u2062 14th Amendment, \u2063Trump \u2062is barred from holding office ever again after the January 6 Capitol attack.<\/p>\n<blockquote>\n<h3>Challenging Trump&#8217;s Eligibility<\/h3>\n<p>Lawrence Caplan,\u200d a Florida tax attorney, became the \u2063first to challenge Trump\u2019s candidacy for president in federal court last week,\u200c pointing to the \u2063Amendment\u2019s \u201cdisqualification clause\u201d that says those who \u201chave engaged in insurrection\u200d or rebellion\u201d against the government cannot\u2062 hold office.<\/p>\n<p>He <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4171623-florida-lawyer-files-challenge-to-disqualify-trump-from-2024-race-citing-14th-amendment\/\" target=\"_blank\" rel=\"noopener\">told<\/a> The Hill that the former president\u2019s \u2063<a title=\"President Trump \u201cHas Put His Boat In the Water For His Trip to Cross the Delaware\u2026 On Christmas Eve\u201d \u2013 Attorney Lin Wood\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/president-trump-has-put-his-boat-in-the-water-for-his-trip-to-cross-the-delaware-on-christmas-eve-attorney-lin-wood\/\">grand jury indictments<\/a> in the Washington, D.C., election\u2063 interference federal case and\u200b the\u200c Georgia case stemming from alleged efforts to overturn the\u200b 2020 election make \u2062his disqualification automatic, despite\u00a0neither\u2062 indictment accusing Trump of inciting the \u200cmob that attacked the Capitol.<\/p>\n<p>\u201cThe bottom line here is that\u200d President Trump both engaged in an insurrection and also gave aid and comfort \u2063to other individuals who were engaging in such actions, within the clear meaning of those terms as defined in Section Three of the Fourteenth Amendment,\u201d Caplan wrote in a <a href=\"https:\/\/www.courtlistener.com\/docket\/67724934\/1\/caplan-v-trump\/\" target=\"_blank\" rel=\"noopener\">filing<\/a> last week, challenging Trump\u2019s eligibility to run for office again. \u201cAssuming \u2062that the public \u2064record to date is accurate, and we \u2062have no evidence\u200d to the contrary, Trump is \u2064no longer eligible\u2062 to seek the \u200boffice of the President of the United\u2064 States, or of \u200cany other state of the Union.\u201d<\/p><\/blockquote>\n<p>The Fourteenth Amendment to the U.S. Constitution was ratified in \u200c1868 in \u2064the aftermath of the Civil War during the Reconstruction \u2064Era and was designed to represent a new birth of freedom for previously disenfranchised \u2063citizens,\u200c according to <a href=\"https:\/\/www.law.cornell.edu\/wex\/fourteenth_amendment_0\" target=\"_blank\" rel=\"noopener\">Cornell University\u2019s Legal Information Institute.<\/a> The Amendment\u2019s \u2064\u201cdisqualification clause\u201d was\u200d written \u200dto bar those \u2064who had\u2063 joined the Confederacy \u200bfrom serving in \u2062state or federal office, but would \u201ctheoretically still apply\u201d to those who engage \u2063in future rebellions or\u200c insurrections against \u2064the\u2063 U.S.<\/p>\n<p>Two legal \u200dprofessors\u200b and members of the conservative\u200c Federalist Society, William \u200cBaude and Michael Stokes\u2063 Paulsen, endorsed the \u2062\u201cself-executing\u201d idea in the <a href=\"https:\/\/deliverypdf.ssrn.com\/delivery.php?ID=351084105114074089068001113120119074037024090008032052023106011111104104092003067011059012033058039112110017080119106087084110103046069078020025010108082105098027007006042074017095015085115074083111095085028120001070124099112070021103069025007005017&#038;EXT=pdf&#038;INDEX=TRUE\" target=\"_blank\" rel=\"noopener\">Pennsylvania Law \u200bReview<\/a>, \u2062writing the clause \u201cis alive\u2062 and in force\u201d \u2064and that if any\u200c government official \u2062\u201cplanned, supported, assisted, encouraged, endorsed, or aided in a material way those who engaged in \u2062the insurrection of January 6, or otherwise knowingly and willfully participated in a broader\u2063 rebellion \u200bagainst the constitutional system, \u200bsuch persons are constitutionally disqualified from office.\u201d<\/p>\n<p>Former Arkansas Gov. Asa Hutchinson said during the \u200dGOP presidential debate in Milwaukee last week that he would \u201cnot going \u2064to support somebody who\u2019s been convicted of a serious felony or who is disqualified under\u2064 our \u200cConstitution.\u201d<\/p>\n<p>Former conservative 4th Circuit Appeals Court Judge\u2064 J. Michael Luttig and liberal Harvard legal \u2063scholar Laurence\u200b Tribe published \u200can article last\u200d week in <a href=\"https:\/\/www.theatlantic.com\/ideas\/archive\/2023\/08\/donald-trump-constitutionally-prohibited-presidency\/675048\/\" target=\"_blank\" rel=\"noopener\">The Atlantic<\/a> claiming Trump\u2019s effort to allegedly remain in power after the 2020 election \u201cplace him squarely\u2063 within the ambit\u200d of the disqualification clause.\u201d<\/p>\n<p>Two civil rights organizations \u2014 \u2064Mi Familia Vota and Free Speech for People \u2014 also \u200claunched campaigns in July to pressure state \u2062officials in \u200bNevada, California,\u2063 Oregon, Colorado, and \u200cGeorgia\u2063 to disqualify Trump from appearing on \u200dballots\u200b in those \u200bstates\u2063 in 2024, according to <a href=\"https:\/\/thehill.com\/homenews\/campaign\/4086124-activists-want-to-disqualify-trump-from-ballot-in-key-states-under-14th-amendment\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>And Bryant \u201cCorky\u201d Messner, a\u2064 former New Hampshire U.S.\u200b Senate candidate in\u2063 2020 previously endorsed by Trump,\u200b announced plans to materialize the former president\u2019s disqualification \u2062at the state level, ABC <a href=\"https:\/\/www.washingtonpost.com\/politics\/2023\/04\/18\/trump-ballots-january-6\/\" target=\"_blank\" rel=\"noopener\">reported<\/a>.<\/p>\n<blockquote>\n<h3>Opposition and Criticism<\/h3>\n<p>But \u2062despite\u2063 the opposition from lawmakers, \u200dactivists, \u2064and never-Trumpers, others warn \u200dagainst using the clause against the \u2063former \u2063president.<\/p>\n<p>Harvard Law School Professor\u200d Emeritus Alan Dershowitz said the notion puts the\u2064 Constitution in \u201cgrave danger.\u201d<\/p>\n<p>\u201cIt \u2064would put\u200c the decision\u2064 about who the President is in the hands \u200dof local\u2063 Secretaries of State and Democratic governors, instead\u2063 of \u2062in the hands of the\u200d people,\u201d Dershowitz <a href=\"https:\/\/justthenews.com\/politics-policy\/all-things-trump\/florida-lawyer-says-trump-cant-run-office-under-14th-amendment?utm_source=mux&#038;utm_medium=social\" target=\"_blank\" rel=\"noopener\">told<\/a> Just the News.<\/p>\n<p>Constitutional \u2064law attorney \u2063and\u200d former Trump ally \u2062Jenna Ellis \u2064said in an <a href=\"https:\/\/twitter.com\/JennaEllisEsq\/status\/1693987685558530491\" target=\"_blank\" rel=\"noopener\">X-post<\/a>, \u201cThe Left is purposefully calling J6 an \u2018insurrection\u2019 to \u2064justify a baseless 14th Amendment \u200bchallenge.\u201d<\/p>\n<p>\u201cIt\u2019s like baselessly calling\u200d election challenges on behalf of \u200ba campaign \u201cracketeering\u201d\u200b to justify a RICO charge,\u201d Ellis, who is also named a co-conspirator in \u2064Trump\u2019s \u200cGeorgia indictment, said.<\/p>\n<p>And\u2062 Fox News host Mark Levin slammed Judge Tribe and \u2062Harvard legal scholar Luttig for writing \u201ca self-humiliating piece\u201d in the \u2062leftwing Atlantic \u200cMonthly claiming the constitutional clause stops Trump from being elected \u2064president.<\/p>\n<p>\u201cThis has to be one of the truly dumbest essays ever written on the \u2063subject,\u201d Levin \u200dsaid in an <a href=\"https:\/\/twitter.com\/marklevinshow\/status\/1693742724879384584\" target=\"_blank\" rel=\"noopener\">X-post<\/a>. \u201cAnd it is something \u200bthe Marxist left\u200c has been pushing \u200cfor years against\u2063 Trump.
