J.B. Pritzker, a Democrat, signed \u2062House Bill 3751, which allows individuals\u2064 \u201cagainst whom\u200c immigration action has been deferred by the U.S. \u2063Citizenship and Immigration Services \u2063(USCIS) under the federal Deferred Action for Childhood Arrivals (DACA)\u2062 process\u201d to \u2064apply for law enforcement positions such as a police officer and deputy sheriff.<\/p>\n<p>Comparable legislation has passed in the blue states of California and Colorado.<\/p>\n<p>While this state legislation may not conflict with federal laws, it does raise several ethical problems, according to Mr. \u2062O\u2019Brien.<\/p>\n<h2>Foley v. Connelie<\/h2>\n<p>In \u200dthe\u200b 1978\u200c <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/435\/291\/\" target=\"_blank\" rel=\"noopener\">Foley v. Connelie<\/a> ruling, the Supreme \u200bCourt stated, \u201cIn short, it \u2062would be as anomalous to conclude that citizens may be\u200b subjected to the \u2063<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musk-can-use-the-first-amendment-to-make-twitter-open-to-free-speech-again\/\" title=\"Elon Musk Can Use The First Amendment To Make Twitter Open To Free Speech Again\">broad discretionary powers<\/a> of noncitizen police officers as it would be to say judicial officers and jurors \u200cwith power to \u2063judge citizens can be aliens. It is not surprising, \u200ctherefore, that most States expressly confine the employment of police officers to \u200ccitizens, whom the State may reasonably presume to be more familiar with and sympathetic to American traditions.\u201d<\/p>\n<p>The \u2064case centered around plaintiff Edmund Foley, an Irish citizen in New York who was admitted into the U.S. \u2062as a permanent resident.<\/p>\n<p>He had applied for the position of New York state trooper but was refused because\u2062 he was not a citizen. State law \u201cclearly excludes aliens\u2064 from employment as state troopers,\u2063 and the State admittedly adheres strictly to its mandate,\u201d according to the\u2062 complaint.<\/p>\n<p>Foley then brought a\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musk-slams-woke-esg-initiatives-its-communism-rebranded\/\" title=\"Elon Musk criticizes woke ESG initiatives as 'rebranded communism'.\">class action \u2062lawsuit<\/a> against the state, arguing that the exclusion of aliens from employment for the state \u2062troopers violates the equal protection \u2063clause of the Fourteenth Amendment.<\/p>\n<p>The defendant in the case was New York State Police Superintendent William Connelie.<\/p>\n<p>\u201cAfter that case, most states took the approach that people who were <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nyc-moves-to-grant-800k-non-citizens-ability-to-vote-in-local-elections\/\" title=\"NYC Moves To Grant 800K Non-citizens Ability To Vote In Local Elections\">green-card holders<\/a> and who had \u2062made a\u200d declaration of intent to become U.S. citizens as soon as they were eligible could\u2062 be hired as a police \u2064officer,\u201d Mr. O\u2019Brien said. \u201cSo, historically, this hasn\u2019t been an\u2062 issue, and to the \u2062extent that \u2062it applies\u200d to people who have permanent authorization to reside here and are going to naturalize, it\u2019s not a\u2064 big problem.\u201d<\/p>\n<h2>The Limbo Status of a Parolee<\/h2>\n<p>However, Mr. O\u2019Brien said, what the new laws do is allow people who have been paroled into the United States and those who have been granted deferred \u2062action through DACA to be eligible candidates \u2062for\u200c law enforcement with the \u201cvery weak\u201d modifying proviso at the end of the \u200dlegislation stating that \u2063they\u2062 must otherwise qualify to become a police officer and to use a firearm.<\/p>\n<p>\u201cFrom the standpoint of people who are\u200b paroled \u200dinto the United States, the term is a legal fiction,\u201d\u200c he said. \u201cYou\u2019re actually not in the United States; you\u2019re an \u200bapplicant at\u200c the border applying for permission to come into the United\u2064 States, and this doesn\u2019t give you immigration status, but it does put you in\u200d a limbo status. As a matter of convenience to the government, you can be given \u2062a work authorization to be allowed to\u200d do certain things.\u201d<\/p>\n<p>As a \u2064result of its legal ambiguities, this allowance for parolees to become police officers has been difficult to decipher, \u2062Mr. O\u2019Brien said.<\/p>\n<p>According to Elizabeth Jacobs, the director of Regulatory Affairs and Policy for the Center for Immigration Studies, illegal aliens have \u200cmany\u2063 ways in which they can get temporary work authorization,\u2064 such as presenting a case for economic need.<\/p>\n<p>\u201cInadmissible aliens who have\u2062 crossed the\u200c Southern border illegally and made an asylum claim are likewise eligible to receive work authorization under federal law after their application has been pending for at least 180 days,\u201d Ms. Jacobs said in <a href=\"https:\/\/cis.org\/Jacobs\/Can-Aliens-Who-Are-United-States-Illegally-Become-Cops-New-Illinois-Law-Says-Why-Not\" target=\"_blank\" rel=\"noopener\">her writing<\/a> on the\u200d issue. \u201cGiven the extreme backlog in the asylum \u200csystem, which now stands at approximately 1.6 million \u2064cases, asylum applicants are nearly guaranteed eligibility\u200d to apply \u2063for work authorization and may remain in the United \u200cStates without a lawful immigration status for many years\u200c before they receive a final decision on their claim.\u201d<\/p>\n<p>That\u2019s if they \u2063aren\u2019t first paroled\u200b into the U.S., she said.<\/p>\n<p>\u201cIn recent years, the \u2064Biden administration has transitioned away from using\u200d expedited removal procedures to process migrants who\u2064 submit\u2063 asylum claims in favor\u200b of instead paroling such applicants out of mandatory detention or directly into the United States via one of the administration\u2019s new parole programs,\u201d she said. \u201cBut even inadmissible aliens who have received parole (even after crossing the border illegally) are \u2062eligible to \u2062apply for work authorization.\u201d<\/p>\n<p>Still, she said, these inadmissible aliens\u20141.4 million of whom\u2062 have been granted parole by the Biden administration, remain in what O\u2019Brien described\u2062 as\u200b \u201climbo status.\u201d<\/p>\n<p>\u201cRegardless of the\u2062 messy legal issues at hand, the new Illinois law was \u2062clearly passed to at least message a disregard for the validity of U.S. immigration law,\u201d she writes. \u201cAllowing aliens who \u200dare removable from the\u200b United States\u200b on account \u2063of their unlawful immigration status\u2063 to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-depth-legislation-permitting-illegal-immigrants-to-be-sworn-in-as-law-enforcement-officers-concerns-legal-scholars-2\/\" title=\"Legal scholars express concerns over legislation allowing illegal immigrants to become law enforcement officers.\">hold law\u200b enforcement positions<\/a> that will \u200crequire them to enforce other federal, state, and local laws should be \u200dconcerning to any \u2063American who values the rule of law.\u201d<\/p>\n<h2>Ethical \u200cDilemmas<\/h2>\n<p>On DACA, many advocates have the misunderstanding that people who receive deferred action are protected from removal from the United States, O\u2019Brien said.<\/p>\n<p>\u201cThat\u2019s incorrect,\u201d he \u200csaid. \u201cIt says on the USCIS website that DACA is deferred action, and deferred action is defined in case law as a form of prosecutorial discretion \u200dthat enables the federal government,\u200d for matters of \u200bits own convenience, to defer the removal of someone who has come forward and \u2063admitted that they &#8230;\u200b never had any immigration status or that they no longer have it \u2062because they violated the terms\u200c of the status.\u201d<\/p>\n<p>To obtain deferred action, one must acknowledge that they don\u2019t have an immigration status and are subject to removal, Mr. O\u2019Brien explained.<\/p>\n<p>This creates several noteworthy ethical dilemmas.<\/p>\n<p>\u201cThe first of which is, how do you have people who have violated \u200cthe law \u200ccome into the \u200dUnited States without authorization enforcing the law against\u2062 U.S. citizens?\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>movement,\u201d warns one expert.
