All \u200bdefendants surrendered <a href=\"https:\/\/www.theepochtimes.com\/us\/5-more-surrender-overnight-at-fulton-county-jail-after-trump-booking-5480645\" target=\"_blank\" rel=\"noopener\">before the deadline<\/a>.<\/p>\n<p>Jeffrey Clark, former Justice Department (DOJ) official, filed a notice of removal on Aug. 21, requesting that his case be moved from state to federal court, \u2063where he\u2063 is \u200dexpecting\u2064 the charges to be dismissed. A request \u200dto expedite \u2064the process before the arrest deadline was denied by Judge Steve Jones \u200cof the U.S. District Court for the Northern District of Georgia,\u200c who \u2062will oversee the hearings related to removals.<\/p>\n<blockquote>\n<h2>Related \u200dStories<\/h2>\n<ul>\n<li><a href=\"http:\/\/www.theepochtimes.com\/epochtv\/georgia-case-has-turned-trump-into-martyr-against-politicized-law-5480885\">Georgia Case\u2064 Has Turned Trump \u200bInto Martyr Against Politicized Law<\/a>\n<p class=\"text-comp-caption\">8\/25\/2023<\/p>\n<\/li>\n<li><a href=\"http:\/\/www.theepochtimes.com\/us\/5-more-surrender-overnight-at-fulton-county-jail-after-trump-booking-5480645\">All Defendants in Georgia Election \u2063RICO Case Surrender<\/a>\n<p class=\"text-comp-caption\">8\/25\/2023<\/p>\n<\/li>\n<\/ul>\n<\/blockquote>\n<p>The hearing will take place Monday, Sept. 18, and the <a title=\"19-year-old arrested in Calif. for double murder\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/19-year-old-arrested-in-calif-for-double-murder\/\">district attorney&#8217;<\/a>s office has until Sept. 5 to\u200c file\u2063 a response.<\/p>\n<p>The indictment accuses Mr. Clark of \u2064violating the RICO Act as well as allegedly\u200c making a false statement\u200b when \u2063he issued a DOJ statement alerting Georgia officials to election \u2062fraud concerns. \u2063He is arguing that he\u200b acted as a federal official, and thus &#8220;asserts federal jurisdiction&#8221; in the case.<\/p>\n<p>&#8220;The Court now must determine if it\u200d clearly <a title=\"Federal judge orders second hearing to remove Georgia election case.\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-orders-2nd-hearing-removing-georgia-election-case\/\">lacks \u2063subject matter jurisdiction<\/a> over Clark&#8217;s removal action, which would require summary remand,&#8221; Judge Jones wrote, adding that he is not commenting on\u200c the assertions at this time but expects to hear arguments from both sides at the Sept. 18 hearing.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/div>\n<\/div>\n<h2>4 \u200dNotices of Removal<\/h2>\n<p>Notices of removal must be\u2064 filed \u2063no later than 30 days after arraignment \u2064or anytime before trial,\u2064 whichever is earlier. Besides Mr. \u2064Clark, three other defendants have filed notices of removal.<\/p>\n<p>Mark Meadows, former chief of staff to the president, was the first to do so on Aug. 15, a day\u2064 after \u2062the \u200dindictment. An evidentiary hearing \u200dwill take place Monday, Aug. 28.<\/p>\n<p>Ahead of the hearing, Ms. Willis and Mr. Meadows&#8217;s lawyers have filed responses that give a preview of their arguments. Mr. \u2062Willis is arguing that Mr. Meadows&#8217;s \u2062actions were not\u2062 the actions of a federal officer, but that in fact he neglected the duties of his federal office and \u200cparticipated in\u2062 <a title=\"Foreign billionaire exploiting 'loophole' to promote leftist policies in US, warns watchdog. Potential new George Soros?\" href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/a-new-george-soros-watchdog-warns-foreign-billionaire-is-using-loophole-to-push-leftist-policies-in-us\/\">illegal political activity<\/a> \u2063under the Hatch Act. \u2063Mr. Meadows&#8217;s lawyers argued that the political or election-related nature\u2064 of Mr. Meadows&#8217;s actions \u2063don&#8217;t disqualify them from being part of federal conduct.<\/p>\n<p>&#8220;The only dispute the State asserts here is whether Mr. Meadows is entitled to immunity based on the \u2063nature of the conduct charged and the scope\u2063 of his \u200bduties,&#8221; they <a href=\"https:\/\/www.courtlistener.com\/docket\/67694389\/45\/the-state-of-georgia-v-meadows\/\" target=\"_blank\" rel=\"noopener\">wrote<\/a>, arguing\u200d that even \u2064if there \u2064is something disputable about Mr. Meadows&#8217;s actions, they still do not fall under state court jurisdiction.<\/p>\n<p>The district attorney&#8217;s office has already <a href=\"https:\/\/www.theepochtimes.com\/us\/brad-raffensperger-subpoenaed-to-testify-in-hearing-on-georgia-election-case-removal-to-federal-court-5479977\" target=\"_blank\" rel=\"noopener\">subpoenaed<\/a> four\u200b witnesses to testify\u2062 in Monday&#8217;s hearing. Georgia Secretary of State Brad Raffensperger, \u2062Chief Investigator \u2064for the Secretary of State&#8217;s office Frances Watson, and attorneys Kurt Hilbert and Alex Kaufman are expected to testify \u200bat\u200c the hearing.<\/p>\n<p>Mr. \u2062Meadows was\u200d accused of arranging or taking meetings and phone calls involving the\u2062 subpoenaed witnesses, and \u200dMs. Willis is expected to ask them to recount the meetings and calls.<\/p>\n<p>David Shafer, \u200ban alternate elector in the 2020 general election in Georgia and former chair \u2063of the Republican Party in \u2064Georgia, also filed a\u200b notice of removal. He <a href=\"https:\/\/www.theepochtimes.com\/us\/numerous-arguments-filed-to-remove-georgia-trump-case-from-state-court-5478537\" target=\"_blank\" rel=\"noopener\">argued<\/a> that the alternate \u200delector position was legitimized by an <a href=\"https:\/\/www.theepochtimes.com\/us\/numerous-arguments-filed-to-remove-georgia-trump-case-from-state-court-5478537\" target=\"_blank\" rel=\"noopener\">act of Congress<\/a>, and therefore he can claim federal immunity as well. He also argued\u200d that, because \u200dhe was\u200d working &#8220;at direction&#8221; of \u2064President Trump and the president&#8217;s lawyers,&#8217; he would\u2064 at minimum qualify for acting under color of a federal officer if not considered one himself.<\/p>\n<p>On Aug. 24, Shawn Still, a Georgia state senator and also\u200b an \u2063alternate elector during the 2020 election, filed the \u200c <a href=\"https:\/\/www.courtlistener.com\/docket\/67728704\/1\/the-state-of-georgia-v-still\/\" target=\"_blank\" rel=\"noopener\">latest\u2064 notice<\/a> of removal.<\/p>\n<p>&#8220;The prosecution of Mr. Still is based on his attendance at\u200b a <em>single<\/em> meeting on December 14, 2020, in his capacity as a contingent United States presidential elector,&#8221; where, his attorneys argued, he &#8220;was, or was acting \u200dunder, an officer of the United States.&#8221;<\/p>\n<p>The notice claims Mr. Still, and Mr. Shafer,\u200d followed\u2062 procedure and the advice of the president&#8217;s attorneys in their actions to cast\u200b the alternate ballots.
