Pritzker, a Democrat, signed House Bill \u20643751, which allows individuals \u201cagainst whom immigration action has been deferred by the U.S. Citizenship and Immigration Services (USCIS) under the federal Deferred Action for Childhood Arrivals (DACA) process\u201d\u2063 to apply for law enforcement positions such \u200cas a\u2064 police \u200cofficer and deputy sheriff.<\/p>\n<p>Comparable legislation has passed in the\u2062 blue states \u2064of California and Colorado.<\/p>\n<p>While\u200d this state legislation \u200dmay not conflict with federal\u2062 laws, it does raise several\u2064 ethical \u200bproblems, according to Mr.\u2062 O\u2019Brien.<\/p>\n<div class=\"shortcode\">\n<div class=\"lazyload-wrapper\">\n<div class=\"lazyload-placeholder\"><\/div>\n<\/p><\/div>\n<\/p><\/div>\n<p>\u201cThere\u2019s nothing specifically in federal legislation that prohibits people \u200cwho are not\u200d yet citizens from becoming police officers,\u201d Mr. O\u2019Brien \u200csaid. \u201cHowever, there is\u200b a Supreme Court case holding\u200b that states can\u2062 prohibit people from becoming police officers \u2064when they\u200d are not yet citizens\u200b because there is an essential government function being carried\u2064 out when a police \u2064officer \u2063is entrusted to \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-oversight-board-punts-on-trump-ban-decision\/\" title=\"Facebook Oversight Board Punts on Trump Ban Decision\">make snap decisions<\/a> about the law such as the \u2062use of force that have a significant impact on people\u2019s constitutional rights.\u201d<\/p>\n<h2>Foley v. Connelie<\/h2>\n<p>In the 1978 <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/435\/291\/\" target=\"_blank\" rel=\"noopener\">Foley v. Connelie<\/a> ruling, the \u2062Supreme Court stated, \u201cIn short, it would be as anomalous to conclude that citizens may be subjected to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/elon-musk-can-use-the-first-amendment-to-make-twitter-open-to-free-speech-again\/\" title=\"Elon Musk Can Use The First Amendment To Make Twitter Open To Free Speech Again\">broad discretionary powers<\/a> of noncitizen\u200d police officers as it would \u200dbe to say judicial officers and jurors with power to judge citizens can be aliens.\u200d It is not surprising, therefore, that most States expressly confine\u2063 the employment of police officers to citizens, whom the State may \u2062reasonably presume to be more familiar with and sympathetic to American\u200d traditions.\u201d<\/p>\n<p>The\u2064 case centered around plaintiff Edmund Foley, an Irish citizen in New York who was admitted into the U.S. as \u200ca permanent resident.<\/p>\n<p>He \u200bhad\u200b applied \u200cfor the position of New York state trooper but was refused because he was not a citizen. State law \u201cclearly excludes aliens from employment as state troopers, and the State admittedly adheres strictly to its mandate,\u201d according to \u2063the\u200c complaint.<\/p>\n<p>Foley then brought a class action lawsuit against the state, arguing that\u2063 the exclusion of aliens\u2062 from employment for the state troopers violates the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-legal-team-files-appeal-after-obama-judge-dismisses-lawsuit-seeking-to-block-pennsylvania-from-certifying-its-results\/\" title=\"Trump Legal Team Files Appeal After Obama Judge Dismisses Lawsuit Seeking to Block Pennsylvania From Certifying Its Results\">equal protection clause<\/a>\u2062 of \u200cthe Fourteenth Amendment.<\/p>\n<p>The \u200ddefendant in the case was New York State Police Superintendent William\u2062 Connelie.<\/p>\n<p>\u201cAfter that case, most states took the approach that people who were\u200c green-card holders and who had made a declaration of intent \u200dto become U.S. citizens as soon as they were eligible could \u2064be hired as a police officer,\u201d Mr. O\u2019Brien\u2062 said. \u201cSo, historically, this hasn\u2019t\u2063 been an issue, \u200band to the extent that it applies to people who have permanent authorization to reside here and\u2062 are going to naturalize, \u200cit\u2019s not a big problem.\u201d<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Illegal immigrants prepare to be transported by bus to Border Patrol \u2062processing\u2063 facilities in Yuma, Ariz., on May 18,\u2064 2023. (John Fredricks\/The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>The Limbo Status of a Parolee<\/h2>\n<p>However, Mr. O\u2019Brien said, what the new laws do is allow people who have been paroled into the United States and those who have been granted deferred \u2064action through DACA to be \u200celigible candidates for law enforcement with the \u201cvery weak\u201d \u200cmodifying proviso at the end of the legislation stating that they must \u200botherwise qualify to\u200d become a police officer \u200band to use a firearm.<\/p>\n<p>\u201cFrom the standpoint of people who are\u200b paroled into the United States, the term is a legal fiction,\u201d he said. \u201cYou\u2019re actually not in the United States; you\u2019re an applicant at \u200dthe border applying for permission to come into the\u2062 United States, \u2062and this doesn\u2019t give you immigration status, but it does put you in a \u200climbo status. As a matter of convenience to the government, you can be given a work authorization to be allowed to do certain\u2062 things.\u201d<\/p>\n<p>As a result of its legal ambiguities, this allowance \u200cfor parolees to\u2063 become\u200c police\u2062 officers has been difficult \u200bto decipher, Mr. O\u2019Brien said.<\/p>\n<p>According to Elizabeth Jacobs, the director of Regulatory Affairs and\u2064 Policy \u2063for the Center for Immigration Studies, illegal\u2062 aliens have\u200c many ways in which they can get temporary work\u200d authorization, such as \u2063presenting a case for economic need.<\/p>\n<p>\u201cInadmissible aliens who have crossed the Southern border illegally and made an asylum claim are likewise\u2064 eligible\u200c to receive work authorization \u2064under federal law after their application has been pending\u2064 for at \u2064least 180 days,\u201d Ms. Jacobs \u2062said \u2064in <a href=\"https:\/\/cis.org\/Jacobs\/Can-Aliens-Who-Are-United-States-Illegally-Become-Cops-New-Illinois-Law-Says-Why-Not\" target=\"_blank\" rel=\"noopener\">her writing<\/a> on the issue. \u201cGiven the extreme backlog in the \u2062asylum system, which\u200b now stands at approximately 1.6 million cases, asylum applicants are nearly guaranteed\u200b eligibility to apply \u2063for work authorization and may remain\u200c in \u200dthe United States without a lawful \u2064immigration status for\u2063 many years before they receive a final decision on their claim.\u201d<\/p>\n<p>That\u2019s if they aren\u2019t\u200b first paroled into \u2063the U.S., she said.<\/p>\n<p>\u201cIn recent years, the Biden\u2064 administration has\u200c transitioned away from using expedited removal procedures to process migrants who submit asylum claims in favor of instead paroling such applicants out of \u200bmandatory detention\u200d or directly \u200binto the United\u2064 States via one of the administration\u2019s \u2063new parole programs,\u201d \u2062she said. \u201cBut even inadmissible\u2063 aliens who have received parole (even after crossing the border illegally) are eligible to apply for work authorization.\u201d<\/p>\n<p>Still, she said, these inadmissible aliens\u20141.4 million of whom have been granted parole by the\u2063 Biden administration, remain in what O\u2019Brien described as \u201climbo status.\u201d<\/p>\n<p>\u201cRegardless of the \u200dmessy legal issues at hand,\u200b the new Illinois law was clearly passed\u200b to at least message a disregard for the validity of U.S. immigration law,\u201d she writes. \u201cAllowing aliens who are removable from the \u2064United States on account of their unlawful immigration status to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/in-depth-legislation-permitting-illegal-immigrants-to-be-sworn-in-as-law-enforcement-officers-concerns-legal-scholars\/\" title=\"Legal scholars express concerns over legislation allowing illegal immigrants to become law enforcement officers.\">hold law enforcement positions<\/a> that will require them to enforce other \u2064federal, state, and local laws should be \u2062concerning to any\u2064 American who values the\u2062 rule of law.\u201d<\/p>\n<div>\n<figure style=\"width:600px\" class=\"alignnone\"><figcaption>Immigrants who have crossed\u2062 the border illegally sat outside the Crossroads Hotel in Newburgh, New York, on May 15, 2023. (Cara Ding\/The Epoch Times)<\/figcaption><\/figure>\n<\/p><\/div>\n<h2>Ethical Dilemmas<\/h2>\n<p>On DACA, many advocates have the\u2063 misunderstanding that people who receive deferred action are protected from removal from the United States, O\u2019Brien said.<\/p>\n<p>\u201cThat\u2019s incorrect,\u201d he said. \u201cIt says on the \u200bUSCIS website that \u200dDACA is deferred action, and deferred\u200d action is \u200bdefined in case law as\u2063 a form of prosecutorial discretion that enables the federal government, for matters of its own convenience, to defer the removal of someone who has come forward and admitted that they &#8230; never had any immigration status or that they no longer \u2064have it because they violated\u2062 the terms of the status.\u201d<\/p>\n<p>To obtain\u200d deferred action, one must acknowledge that they don\u2019t have an immigration \u2063status and are subject to removal,\u2064 Mr. O\u2019Brien explained.<\/p>\n<p>This creates several noteworthy ethical dilemmas.<\/p>\n<p>\u201cThe first of which\u200c is, how do you have people who have violated the law\u2062 come \u2062into the United States without authorization\u2062 enforcing the law against \u200cU.S. citizens?\u201d<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>movement,\u201d warns one expert.
